Agenda 12/12/2023 Item #16D 8 (Approve the Bureau of Justice Assistance expendature extension for award CC Adult Drug Court Enhancement Program from September 30, 2023 to March 31, 2024)12/12/2023 EXECUTIVE SUMMARY Recommendation to approve the Bureau of Justice Assistance expenditure extension for award #2020-DC- BX-0138 - Collier County Adult Drug Court Enhancement Program from September 30, 2023 to March 31, 2024. (Human Services Grant Fund 1837 and Human Services Match Fund 1838) OBJECTIVE: To continue and strengthen Collier County’s Drug Court. CONSIDERATIONS: On June 9, 2020, (Agenda Item #16.D.14) the Collier County Board of County Commissioners (Board) approved the “After-the-Fact” submittal of an Adult Drug Court Discretionary funding application to the Department of Justice (DOJ) - Bureau of Justice Assistance in the amount of $500,000 with a $166,666 match requirement. On October 16, 2020, County staff was notified that the application had been approved for funding in the amount of $500,000 for a three (3) year period commencing October 1, 2020 - September 30, 2023. The grant included an award to the David Lawrence Center (DLC) to administer the drug court program as they are the only comprehensive publicly funded substance abuse agency in Collier County. On 04/27/2021, Agenda Item #16.D.6, the subrecipient agreement in the amount of $450,000 between the Board and DLC was approved. The award included funding to support improvements to the existing program including full incorporation of the ten (10) National Association of Drug Court Professionals (NADCP) best practice standards. The Collier County Adult Drug Court target population includes adults eighteen (18) years and over, who have been charged with a non-violent drug-related felony offense(s) and 1. Are substance dependent and 2. Are at risk of failing in less intensive rehabilitation programs. Due to delays in hiring personnel to implement this grant and the loss of fiscal staff, D LC experienced delays in submitting their requests for reimbursement to the County for expenditures incurred. As a result of this delay, on August 30, 2023, the Community and Human Services Division (CHS) requested an expenditure extension from the DOJ - Bureau of Justice Assistance to allow DLC and the County enough time to complete all the necessary fiscal activities to close out the project. On September 1, 2023, the DOJ approved CHS’s request to continue to complete all fiscal activities and reporting/closeout requirements. DOJ does not require the Board Chairman to sign a document for the extension to take effect. DOJ’s approval is attached as a backup to this item. FISCAL IMPACT: The proposed action has no Fiscal impact. Funds are budgeted within the Human Services Grant Fund (1837) and Human Services Match Fund (1838), Project 33737. LEGAL CONSIDERATIONS: This item has been approved for form and legality and requires a majority vote for Board approval. -DDP GROWTH MANAGEMENT IMPACT: There is no Growth Management impact due to this request. Justification On behalf of the Collier County, I am requesting a grant extension for 2020-DC-BX-0138. The grant currently expires on September 30, 2023, and we are seeking a one year no cost extension through September 30, 2024. 1. Justification and Circumstances for the Project Period Extension: 16.D.8.b Packet Pg. 2152 Attachment: GAM 2023 09-01 ADC BX-0138 Extension (27218 : Drug Court Amendment #1) The primary purpose of this grant was to allow an existing adult drug court program to scale up the drug court’s overall program capacity; provide access to or enhance treatment capacity or other critical support services; enhance court operations; expand and enhance court services; and improve the quality and intensity of services based on needs assessments. The program connected substance abuse treatment services, Medication Assisted Treatment and recovery support services to those diverted through the drug court program. However due to the Covid pandemic, it was difficult to get started because the Courts were not operating at full capacity creating delays and hiring qualified staff became a challenge. This extension will allow for the project to increase the number of participants served and expend more of the funds awarded to this project. The one year no cost extension will be used to continue enhancing the overall court system and linkage with substance abuse treatment services. It will also allow for the continued training and technical assistance support being offered. 2. Planned Activities During the Extension: During the extension period the courts will continue to enhance their ability to defer more participants to the treatment track within the court and connect them with substance abuse treatment, Medication Assisted Treatment and recovery support services which will help serve more participants. 3. Explanation of the Effect a Denial would have on the Program: Without the additional one-year time frame the project will not have reached its maximum potential for enabling the drug court program to streamline the process for referring participants to the vital services provided as a result of these grant funds. The extension will allow for more participants to receive services and the courts to solidify the enhanced treatment capacity of drug court, a critical component with reach far beyond the grant extension period. 4. Explanation of Unobligated Balances and Plans on Expending Funds in Accordance with the Remaining Project Deliverables: Originally the program was awarded $500,000, to date the program has spent $163,421. Approximately $308,311 will be used to continue the contract with the David Lawrence Center to provide substance abuse treatment services, Medication Assisted Treatment and recovery support services. The remaining $28,267 will be utilized to for administration and oversight of the project. For the next year, the Grant Manager will be replacing the Grant Coordinator. Any additional expenses this generates will be covered by Collier County, FL.
