EXECUTIVE SUMMARY
Recommendation to approve the release of a code enforcement lien with an accrued value of $23,679.37 for
payment of $1,681 in the code enforcement action titled Board of County Commissioners v. Phyliss
Westmoreland, in Special Magistrate Case No. CEPM20200010446 relating to property located at 2997
Wilkinson Ln., Collier County, Florida.
OBJECTIVE: To have the Board of County Commissioners accept an offer to release a code enforcement lien
with an accrued value of $23,679.37 for payment of $1,681 in relation to Special Magistrate Case No.
CEPM20200010446.
CONSIDERATIONS: As a result of a code violation at 2997 Wilkinson Ln., the Special Magistrate ordered the
imposition of a lien against Phyliss Westmoreland in Case No. CEPM20200010446. The violation consisted of an
unsecured mobile home with a broken window, exterior wall damage, roof damage, two accessory structures
(sheds), a travel trailer, a carport in deplorable condition, and damaged electrical and septic connections. The lien
was recorded in the Official Records on May 27, 2021, in O.R. Book 5954, Page 3714. The lien amount of
$34,057.65 is based on 108 days of accrued fines of $250 per day from December 7, 2020, through March 24,
2021, totaling $27,000, plus a demolition cost of $6,834 and operational costs of $223.65. Ms. Westmoreland’s
property was sold via Tax Deed Sale, and surplus funds in the amount of $10,378.28 were applied to the recorded
lien, leaving the current balance of $23,679.37. The property was brought into compliance by a vendor on March
24, 2021.
Pursuant to Resolution No. 2023-90, a request for reduction of fines may be considered, in part, when a lien
encumbers property under new ownership, and the new owner has diligently pursued abatement and achieved
compliance and/or when payment of the lien would impose a severe financial hardship on the owner. 409 Taylor St.
Trust acquired the property via Tax Deed Sale recorded on March 22, 2023, in O.R. Book 6227, Page 2755. As a
result of the Tax Deed Sale, surplus funds totaled $36,269.18; of that surplus, funds in the amount of $25,890.90
were applied to satisfy liens on Case Nos. CENANA20190010709 and CENA20210007557, related to 2997
Wilkinson Ln., Release and Satisfaction of Liens attached. The property is being actively maintained, and 409
Taylor St. Trust offered to pay $223.45 to settle the lien; however, Code Enforcement staff recommends the board
accept $1,681 to settle the fines. The recommended payment of $1,681 is based on ten percent of the Collier
County Property Appraiser’s Assessed Value of $16,810 (as of August 11, 2023), which is consistent with the
criteria outlined in Resolution 2023-90. There are no known violations at this time.
Code Enforcement is recommending reducing the accrued fines by of $21,998.37, as outlined in the attached Code
Lien Relief Application. There are currently no known violations on the property.
FISCAL IMPACT: Acceptance of a payment of $1,681 to settle the lien as outlined in Collier County Resolution
2023-90.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action.
LEGAL CONSIDERATIONS: The County Attorney’s Office has reviewed this item and approved it as to form
and legality. Majority support is required for approval. This item conforms to the Board’s policy contained in
Resolution 2023-90. RTT
RECOMMENDATION: To approve the a reduction of fines in the amount of $21,998.37, accept payment
amount of $1,681, release the lien, and authorize the Chairman to sign the attache d release and satisfaction of lien
for recording in the Official Public Records.
