should be provided to the County Attorney Office at the time the item is input into SIRE. CS
Some documents are time sensitive and require forwarding to Tallahassee within a certain
time frame or the BCC's actions are nullified. Be aware of your deadlines!

A RESOLUTION BY THE BOARD OF COUNTY COMMISSIONERS,
COLLIER COUNTY, FLORIDA, AUTHORIZING ITS CHAIRMAN TO
EXECUTE AN AMENDMENT TO EXTEND THE PUBLIC
TRANSPORTATION GRANT AGREEMENT 450306-1-94-01 CONTRACT
NUMBER G2692 SET TO EXPIRE ON DECEMBER 31, 2023 TO JUNE 30,
2024, AND SUBMIT AND REVISE ANY AND ALL SUPPORTING
DOCUMENTS AND ASSURANCES RELATED TO SUCH AWARD
RELATING TO THE IMPROVEMENT OF BUS STOPS FOR ADA
COMPLIANCE IN THE RURAL SERVICE AREA.
WHEREAS, the Board of County Commissioners of Collier County, Florida ("Board"),
has the authority to apply for and accept grants and make purchases and expend funds pursuant
to grant awards made by the Florida Department of Transportation as authorized by Chapter 341,
Florida Statutes, and by the Federal Transit Administration Act of 1964, as amended; and
WHEREAS, Florida Department of Transportation required the Board to provide a
resolution memorializing and confirming the Board's affirmative vote to approve the Agreement,
and authorizing its Chairman to execute the Agreement; and
WHEREAS, on June 14, 2022, the Board adopted Resolution 2022-98, accepting and
authorizing its chairman to execute a Section 5339 Grant Award from the Florida Department of
Transportation under Grant Agreement 450306-1-94-01, contract number G2692, dated June 21,
2022, in the amount of$222,355.00 (the "Agreement"), relating to the improvement of bus stops
for ADA compliance in the rural service area; and
WHEREAS, on September 13, 2022 the Board adopted Resolution 2022-133,
authorizing its Chairman to execute an amendment to the Agreement to remove certain
references to construction as set forth in the amended Agreement; and
WHEREAS, the Florida Department of Transportation and the Board wish to modify the
Agreement to extend the end date of the Agreement to June 30, 2024.
NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Collier County, Florida, that:
1. The Board authorizes its Chairman to execute, submit, and revise any and all documents required
in connection with the Federal Transit Administration Section 5339 Grant Award including,but not
limited to: (a) executing the amended Public Transportation Grant Agreement 450306-1-94-01; (b)
accepting and executing any required certifications and assurances and all supporting documents
related to the Section 5339 grant awarded to the County, (c) approving all necessary budget
amendments to receive and use grant dollars received above or below the target award referenced
in the Section 5339 grant application, and (d) the improvement of bus stops for Americans with
Disabilities Act of 1990 (ADA) compliance in the Rural Service Area and otherwise authorizing
the expenditure of grant funds pursuant to the grant awarded,unless specifically rescinded.

2. The Board's Registered Agent in Florida is Jeffrey A. Klatzkow, County Attorney.

The Public Transportation Grant Agreement ("Agreement") between the Florida Department of
Transportation ("Department") and Collier County Board of County Commissioners/Collier Area Transit
("Agency"), dated 6/21/2022, is scheduled to expire on the 31 day of December, 2023.
The Agency requests an Amendment of the Agreement, to extend the end date of the Agreement to the 30
day of June, 2024, for additional time to complete the Project for the following reasons: The extension will
allow Collier County Board of County Commissioners/Collier Area Transit to complete the construction and
ensure they have sufficient time to address any issues that may be encountered during construction. This
extension would also provide for sufficient time to close out the grant. If not granted, the project will not be
able to move to the construction phase of the project..
The Department agrees to the requested extension of the Agreement. All of the terms and conditions of the
Agreement and any amendments thereto shall remain in full force and effect.
IN WITNESS WHEREOF,the Parties have executed this Amendment on (to be
completed by Department).
