Agenda 11/14/2023 Item #16F11 (1st Amendment to Contract #18-7469 CDI Services for Big Corkscrew Island Rebional Park w/WSP USA Environment & Infrastructure, Inc.)11/14/2023 EXECUTIVE SUMMARY Recommendation to approve the First Amendment to Agreement No. 18-7469, "CEI Services for Big Corkscrew Island Regional Park," to WSP USA Environment & Infrastructure, Inc., in the amount of $1,874,779.10, authorize the necessary Budget Amendments, and authorize the Chairman to sign the attached Amendment. (Project No. 80039). OBJECTIVE: To add scope and funding for Construction, Engineering, and Inspection (“CEI”) services for Phase II of the Big Corkscrew Island Regional Park (“BCIRP”) project. CONSIDERATIONS: On December 11, 2018 (Agenda Item 11.G), the Board awarded Agreement No. 18-7469 (the “Agreement”) to WSP USA Environment and Infrastructure, Inc. (formerly Wood Environment and Infrastructure Solutions, Inc.), for CEI services throughout the BCIRP project. The entirety of the project was identified in the original solicitation and the contract award was intended to be for the entire duration of construction and post construction activities for the BCIRP. Due to the conceptual nature of the Phase 2 schedule at the time, the County chose to negotiate the fees for only Phase 1 of the project and establish the fees at a later date for Phase 2 once funding and permitting was more clearly established. The proposed amendment enables WSP USA Environment & Infrastructure, Inc. to continue to provide the necessary support for the remainder of the project including supporting the County’s contract administration for the Design Professionals and Contractors, the coordination of the design and construction efforts, supporting the multiple sub-phased bids, monitoring the project work to ensure both adherence to technical requirements and consideration of environmental and public safety, thereby ultimately ensuring a quality, well -coordinated delivery of the Park and Utility Corridor throughout Phase II of the overall project. The negotiated fees for Phase II services are at the original rates established in 2018 and are lower relative to Phase 1 in total cost as well as percentage of construction cost (3.56% versus 4.69%). Phase II will consist of the following components: • 2A - Signalized Intersection at Oil Well Rd, Park Access Road and Utility Corridor • 2B - Site Civil, Canal Crossings, Maintenance Roads, Utility Corridor and Dog Park • 2C - Fitness Center and Parking Lot (future phase consideration) • 2D - Sports Fields and Lake Upgrades (future phase consideration) The overall program and CEI services with the First Amendment have been successfully negotiated for a total Time and Materials Fee of $1,874,779.10. This will increase the total contract amount to $4,098,547.10. Additionally, as this project is coordinated with Public Utilities to facilitate the utility corridor for the Northeast Service Area (NESA) facility, a portion of these services will be funded by the NESA project budget aligning approximately with the percentage of construction costs of the utility corridor versus the costs associated with the construction of the BCIRP. FISCAL IMPACT: The fiscal impact of this amendment is $1,874,779.10, per the table below. A budget amendment is necessary to reallocate funding within Stormwater Capital Fund (3050) from Harbor Ln Brookside Project 60195 to Big Corkscrew Island Park Project (80039). The source of funding for this pr oject resides in the Park Impact Fees Fund (3071), Stormwater Capital Fund (3050) Big Corkscrew Island Park Project 80039 and Public Utilities Fund (4019) NE Utility Facilities Project 70194. The sources of funding are General and Unincorporated Area General Funds, bond proceeds and impact fee revenues. The Big Corkscrew Island Park Project Budget has an available $45,166,116 and a conceptual estimate of approximately $41,551,500.
