EXECUTIVE SUMMARY
Recommendation to approve a Resolution and updated Statewide Mutual Aid Agreement between Collier
County and the State of Florida Division of Emergency Management.
OBJECTIVE: To allow reciprocal catastrophic emergency response and recovery assistance between Collier
County and other Florida counties, municipalities, independent special districts, and the Florida Division of
Emergency Management.
CONSIDERATIONS: Recent hurricanes, floods and wildfires in Florida have made it very clear that no
jurisdiction can respond to a catastrophic event without assistance from other jurisdictions. According to Federal
Emergency Management Agency guidelines, no assisting jurisdiction may receive remuneration for its services
without a formal mutual aid agreement between the two jurisdictions. The Board of County Commissioners
approved a prior Agreement and Resolution on November 12, 2019, under agenda item 16E6. This proposed
Agreement, in addition to the 67 Florida Counties, expands the scope to include independent special districts,
Authorities, Community Development Districts and municipalities within Florida. Additionally, the Agreement
makes use of binding arbitration to settle billing disputes between parties and forbids participating parties to hi re
employees in violation of the employment restrictions in the Immigration and Nationality Act, as amended.
By signing the Agreement, the County is not obligated to provide mutual aid if the County is unable to do so. The
Agreement provides procedures for accessing or responding to requests for mutual aid, defines reimbursable
expenses, and provides insurance requirements, indemnification, and severability.
The Division of Emergency Management will serve as the central repository for executed Agreements an d will
provide, at least annually, a listing of participating jurisdictions along with their authorized representatives and
contact information.
The agreement is for one year and shall automatically renew each year after its execution, unless within sixty days
before that date a participating party notifies the State of its intent to withdraw from the Agreement.
FISCAL IMPACT: There is no Fiscal Impact.
GROWTH MANAGEMENT IMPACT: There is no Growth Management impact associated with this Executive
Summary.
LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires a majority vote for
Board approval. -SAA
RECOMMENDATION: To approve the attached Resolution and Agreement between Collier County and the
Florida Division of Emergency Management for Statewide Mutual Aid for reciprocal catastrophic emergency
response and recovery assistance.
