EXECUTIVE SUMMARY
Recommendation to authorize the Office of the County Attorney to initiate foreclosure proceedings pursuant
to Section 162.09, Florida Statutes, in relation to $164,041.18 in accruing code enforcement liens arising from
the Office of the Special Magistrate Case Nos. CEPM20170012229 and CENA20220004669, titled Board of
County Commissioners, Collier County, Florida, vs. Yolanda Fonseca Est.
OBJECTIVE: To obtain Board authorization for the Office of the County Attorney to initiate foreclosure
proceedings pursuant to Section 162.09, Florida Statutes, in relation to $164,041.18 in accruing code enforcement
liens against all real and personal property owned by Yolanda Fonseca Est. for ongoing violations on an
undeveloped lot located at 312 S. 6th St, Immokalee, Florida 34142. (Folio No. 66880200006).
CONSIDERATIONS: The property located at 312 S. 6th St, Immokalee, Florida 34142, Folio No. 66880200006,
in Collier County, was purchased by Yolanda Fonseca Est. via Quit Claim Deed dated October 29, 1997, recorded
at O.R. Book 2358, Page 2795, et seq., of the Official Public Records of Collier County.
This property was assigned to the mandatory lot mow program as it has been found in violation of Collier County
ordinances fourteen times over the past thirteen years and continues to do so, as evidenced below:
Case No. CEPM20170012229: On April 3, 2018, the Special Magistrate entered an Order Imposing Fines, which
imposed a $161,874.03 lien on all real and personal property owned by the property owner, and which provided for
continuing accrual of interest at 12% per annum commencing on the date the Order was recorded. The lien order
was recorded in O.R. Book 5493, Page 326, et seq., of the Official Public Records of Collier County on April 3,
2018. Fines continued to accrue; therefore, the lien amount of $161,874.03 is based on 623 days of accrued fines
($250 per day from January 3, 2018, through September 17, 2019) totaling $155,750, $5,900 in demolition costs,
plus $224.03 in operational costs, totaling $161,874.03.
Case No. CENA20220004669: On October 12, 2022, the Special Magistrate entered an Order Imposing Fines,
which imposed a $250 lien on all real and personal property owned by the property owner, and which provided for
continuing accrual of interest at 12% per annum commencing on the date the Order was recorded. The lien order
was recorded in O.R. Book 6180, Page 1641, et seq., of the Official Public Records of Collier County. In addition,
Case No. CENA20220004669 was assigned to the mandatory lot mow program and has continued to accrue fines
and fees since June 10, 2022 (see Item A). The accrued lien amounts as of September 15, 2023, consist of $2,030 in
lot mow and administrative fees, plus $137.15 in accrued interest, totaling $2,167.15.
The breakdown of the liens is as follows:
The property is not protected by homestead, which is appraised at $8,521 by the Collier County Property Appraiser
(based on the 2023 Final Tax Roll). There are no mortgages or other liens associated with the property in question.
The 2023 Property taxes of $236.90 remain unpaid, and Certificate #3640 was issued for delinquent 2022 taxes on
June 1, 2023, in the amount of $207.08.
FISCAL IMPACT: Fiscal impact of initiating a foreclosure suit is approximately $410.00 (representing a $400.00
filing fee plus cost of service). Costs for maintaining the lawsuit (including, as necessary, any title review, copies,
mailings, service, transcripts, and other routing litigation costs) should not exceed $500.00. The County should

ultimately recover all costs in initiating and pursuing this lawsuit.
GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact associated with this Executive
Summary.
LEGAL CONSIDERATIONS: The County Attorney’s Office has reviewed this item and approved it as to form
and legality. This item requires a majority vote for approval. RTT
RECOMMENDATION: To authorize the Office of the County Attorney to initiate foreclosure proceedings
against any and all non-homestead property owned by Yolanda Fonseca Est. in relation to Special Magistrate Case
Nos. CEPM20170012229 and CENA20220004669, titled Board of County Commissioners, Collier County,
Florida, vs. Yolanda Fonseca Est., pursuant to Section 162.09, Florida Statutes.

Hearing before the Special Magistrate of Collier County, who after being fully swom, deposes and says:
l. That on December I'r,2017, the Special Magistrate held a hearing and issued an Order in the above-styled
matter and stated that Defendant(s) was to abate all violations as slated in the Order of the Special Magistrate
recorded in the public records of Collier County, Florida in OR Book 5457 PG 3926.
2. That the respondent did not contact the investigator.
3. That a re-inspection was performed on September l8d', 2019.
4. That the re-inspection(s) revealed that the corrective action ordered by the Special Magistrate was in
compliance by Obtaining a Collier County Demolition Permit, Inspections and a Certificate of
Completion/Occupancy (911712019). The mobile home was removed by Collier County Vendor.
