Executive Summary
Recommend that the Board of County Commissioners endorse the United States Department of
Justice and United States Department of Treasury combined Equitable Sharing Agreement and
Certification through September 30, 2024.

OBJECTIVE: To have the Collier County Commission endorse the United States Department of Justice and
United States Department of Treasury combined Equitable Sharing Agreement and Certification valid through
September 30, 2024.
CONSIDERATION: The Collier County Sheriff’s Office participates in joint investigations in which the Sheriff’s
Office works with the United States Department of Justice and the United States Department of Treasury to enforce
federal criminal laws. Local law enforcement agencies that directly or indirectly participate in an investigation or
prosecution that result in a federal forfeiture by these agencies may request an equitable share of the net proceeds of
the forfeiture. An Equitable Sharing Agreement and Certification is required to be submitted annually. The head
of the law enforcement agency and the head of the governing body must approve the Collier County Sheriff’s
Office to electronically file the Equitable Sharing Agreement and Certification. The Equitable Sharing Agreement
and Certification, valid through September 30, 2024, needs to be approved by the Chairman of the Board of County
Commissioners.
FISCAL IMPACT: Requested equitable share revenues will be accounted for separately in the Sheriff’s Office.
Funds will be used to supplement and not supplant Sheriff’s Office law enforcement purposes. The fiscal year in
which the revenues will be received depends on when a case is closed. Total revenues to be received cannot be
determined until cases are closed.
GROWTH MANAGEMENT: Approval of this item will have no impact on growth management.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is approved as to form and
legality and requires majority vote for approval. -JAK
RECOMMENDATION: That the Board of County Commissioners endorses the United States Department of
Justice and United States Department of Treasury combined Federal Equitable Sharing Agreement and Certification
valid through September 30, 2024.

EXECUTIVE SUMMARY
Recommendation to accept the November 2023 Project Update for the ‘Vanderbilt Beach Road Extension’.
(Project 60168)
OBJECTIVE: To keep the Board informed on major capital improvement projects.
CONSIDERATIONS: The Vanderbilt Beach Road Extension project extends Vanderbilt Beach Road (CR862) from
Collier Boulevard (CR951) to 16th Street NE. The work includes reconstruction of the existing two-lane Massey
Street, new roadway intersections with new traffic signals at Wilson Boulevard, 8t h Street NE and 16th Street NE,
Big Cypress Canal relocation to the south of the new roadway from 31st Street NW to 15th Street NW, three new
roadway bridges across existing canals, and maintenance ramps for SFWMD access.
On July 12, 2022, the Board awarded Invitation to Bid No. 22-7976, “Project 60168-Construction Services for
Vanderbilt Beach Road Extension,” to Sacyr Construction USA, LLC (“Sacyr”), in the amount of $152,999,999.91.
Staff issued a “Notice to Proceed” to Sacyr on September 12, 2022, to initiate the official start of the construction for
this project. The estimated project duration is three years. Construction is proceeding timely and within budget.
The excavation operation of the Big Cypress Canal, between 15th and 31st street is approximately 55% completed.
Excavation of Ponds No. 1 A&B, 3 A&B and 6 are also ongoing. Excavated material is being processed and used on
site.
Multiple crews are on site performing installation of drainage pipe and structures between 16 th Street and the
Corkscrew Canal. Embankment placement and compaction operations are also ongoing throughout the entire seven-
mile corridor.
In addition, the Corkscrew Canal bridge has been completed, the Orange Tree Canal bridge substructure has been
completed, and the Curry Canal bridge concrete test piles are scheduled for the beginning of November 2023.
Clearing and construction along the Massey Street corridor is anticipated to start by late December 2023.
This item also provides information in the attached presentation in response to the public petition by a resident at the
October 24, 2023, Board meeting concerning silt fencing, construction signing, compaction of embankment and
construction entrances.
This item is consistent with the Collier County strategic plan objective to design and maintain an effective
transportation system to reduce traffic congestion and improve the mobility of our residents and visitors.
FISCAL IMPACT: Funds for Project No. 60168 are being provided by Impact Fees, Gas Tax and Infrastructure
Surtax.
GROWTH MANAGEMENT IMPACT: This recommendation is consistent with the Long-Range Transportation
Plan and Objective 1 of the Transportation Element of the Collier County Growth Management Plan to maintain the
major roadway system at an acceptable Level of Service.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney’s Office, raises no legal issues
and requires majority vote for acceptance of the report.-SRT
RECOMMENDATION: That the Board accept the November 2023 Project Update for the Vanderbilt Beach Road
Extension project. (Project No. 60168)

•Project Temporary Traffic Control Plan (TTCP)
incorporates FDOT Standard Plans Index 102-600
for advanced warning signage;
•County staff was alerted of signage placement in
question along Collier Blvd. in January 2023 and
comments were addressed in February 2023;
•5 signs were found to have further spacing than the
TTCP stated, according to FDOT Standard Index 102-600
extending sights distances for advanced warning signs is
allowed, distances between signs do not have to be
exact;
•FDOT District 1 staff reviewed MOT and TCCP and found
no significant issues.
•No construction for VBRX has taken place to date along
Collier Blvd. that impacts the traveling public.

State of Florida Erosion & Sediment Control Design Manual
(E&SC)
•Permitting agencies and the Engineer of Record (EOR)
have approved silt fence and state it is in
compliance;
•FDEP has inspected project site 2 separate times
in the last 6 months with no issues with fence;
•1 1/8”x 1 1/8” Hardwood stakes are the standard used
in on FDOT projects due to extreme weather
conditions;
•Hardwood tends to last much longer especially in
harsh environments;
•2”x 4” Softwood stakes are generally less expensive
due to its less dense nature;
•Updated 2020-2021 FDOT Standards do not include
the option of 2”x 4” softwood stakes anymore;
•FDOT Specification 104-6.4 Details for
Temporary Erosion and Sediment Control

for compliance of permit for
stormwater and erosion control to alert
contractor of maintenance and repairs that
are needed;
•Maintenance and replacement for

year) is the contractor’s responsibility to
replace without compensation;
•The quantity estimate in the contract
anticipates replacement of silt fence after
about a year as it deteriorates as expected;

Soil Tracking Devices
•There are 14 soil tracking devices at
construction entrances for main roads and
pond accesses on side streets throughout
the project;
•All entrances were constructed/ installed in
the beginning of the project;
•Soil Tracking devices installed are in
compliance with FDEP permits and
Stormwater Pollution Prevention Plan;
•The contractor uses broom tractors to
sweep the roads daily or as needed,
especially in areas where construction is
taking place.

•All the material used for embankment
is sampled, tested and compacted per
FDOT Specification ‘120 Embankment’;
