Agenda 10/24/2023 Item #16E2 (To continue to provide electric, solid waste, water and sewer to County locations)10/24/2023 EXECUTIVE SUMMARY Recommendation to (1) retroactively approve as of October 1, 2023, all existing Purchase Orders for the purchase of Utility Services for electric, water and sewer needed to operate County facilities and operations; (2) authorize for the next five fiscal years ongoing Utility expenditures not to exceed $19,315,000; and (3) approve Exemption from Competition Forms for the City of Marco Island, the City of Naples, the Immokalee Water and Sewer District, Collier County Water and Sewer District, Florida Power and Light, and Lee County Electric Cooperative. _____________________________________________________________________________________ OBJECTIVE: To continue to provide electric, solid waste, water and sewer to County locations that need the utility services to conduct County operations. CONSIDERATIONS: The Procurement Ordinance 2017-08, as amended, requires that the Board execute all contracts in excess of $50,000. There are no exceptions. The Procurement Ordinance also exempts from the competitive process all “water, sewer, electrical, gas, or other regulated utility, communications and data transmission services subject to government rate control.” All contracts regardless of amount that fall within these exemptions are brought to the Board for approval through Exemption from Competition Forms. Staff has for a number of years entered into Purchase Orders for utility services with the City of Marco Island, the City of Naples, the Immokalee Water and Sewer District, Collier County Water and Sewer District, Florida Power and Light, and Lee County Electric Cooperative. As of October 11, 2023, there are currently over sixty (60) of these Purchase Orders for approximately 185 accounts for FY 2024, as many are location and account based. Neither the Purchase Orders nor Exemption from Competition Process forms were brought to the Board because as a practical matter there are no alternative options for these utility services. However, there were approximately 175 Purchase Orders for the six (6) Utility providers in FY 2023. The following Utilities Services that are in excess of $50,000 each fiscal year include: 1. Florida Power and Light - electric 2. Collier County Utility Billing - water and sewer 3. City of Marco Island - water and sewer 4. Immokalee Water and Sewer District - water and sewer 5. City of Naples - water, sewer and solid waste 6. Lee County Electric Cooperative - electric These services are essential to Countywide operations to ensure that County locations throughout the Co unty have utilities, such as electric and water and sewer. Without the services provided County operations would come to a halt in addition to causing life and health safety risks. Approval is sought for all outstanding Utility Purchase Orders as of Oct ober 1, 2023, which is the start of Fiscal Year 2024, and to authorize Utility expenditures not to exceed $19,315,000 through Fiscal Year 2029. FISCAL IMPACT: Funds are available in the various County funds and cost centers.
