Agenda 10/24/2023 Item #16D11 (To authorize payment for veterinarian services that were approved by the Domestic Animal Services)10/24/2023 EXECUTIVE SUMMARY Recommendation to authorize the expense and payment of up to $8,057.74 for one (1) orthopedic surgery on a dog that has been adopted, contingent upon payment for the necessary orthopedic surgery, and deem the expense to have a valid public purpose. OBJECTIVE: To authorize payment for veterinarian services that were approved by the Domestic Animal Services Director on June 17, 2022, as part of the adoption agreement. CONSIDERATIONS: On May 20, 2022, a stray puppy (ID Number A272290) Piper, arrived at Domestic Animal Services (DAS) at the estimated age of eight (8) months. The adoption for Piper was completed on May 27, 2022. On June 6, 2022, orthopedic concerns for bilateral tibial crest avulsions, that would require future surgery, we re identified by the Harborside Animal Clinic veterinarian (Note: Veterinarian services for spay/neuter surgeries were outsourced due to no in-house veterinarian at this time) while completing the spay surgery prior to Piper being able to be taken home by the first adopter. On June 17, 2022, the DAS Director agreed, on behalf of the County, to pay for the first orthopedic surgery (multiple surgeries would be necessary to resolve the issue). A second consultation was performed, and paid by the County, confirming the orthopedic diagnosis. The first adopter returned Piper to DAS on June 28, 2022, after the initial adoption due to the costs that were anticipated for orthopedic concerns. The second adopter brought the puppy home on July 23, 2022, with the same agreement for the first orthopedic surgery to be paid for by the County to help the DAS puppy to be adopted. At the time of the adoption, the dog was too young to have the full evaluation of orthopedic future needs and for the surgery. As indicated above, the adoption agreement included a commitment by the DAS Division Director that provided: When the puppy reached the proper age for the orthopedic surgeries, the second adopter began to look for a local veterinarian who could complete the orthopedic surgery; however, they were unsuccessful in finding a veterinarian who was local to complete the necessary specialty surgery. A veterinarian that had the necessary surgery skills for the orthopedic surgeries was located and found in August 2023. The Board of County Commissioners (Board) has approved the following Resolutions for the DAS Division donations: Resolution 2017-104 provides that animals in the care of the Domestic Animal Services Division are able to receive medical treatment for low cost or free spay/neuter, other minor medical procedures that may be required, acquisition of equipment and supplies to provide sterilization for the animal including medications, drugs, diagnostics, and other related costs for sterilization 16.D.11 Packet Pg. 1254 10/24/2023 services. This donation fund is limited to sterilization of an animal, costs and related fees, and is not able to be used for the current orthopedic surgery since it is unrelated. Resolutions 2006-26 and 2007-54 were approved for a separate donation fund for animals in Domestic Animal Services Division custody. Additionally, these resolutions were intended for donations of property, pet food, toys and supplies, and for promoting community awareness for animals in the custody of the Domestic Animal Services Division. These resolutions did not contemplate or intend to be used for veterinarian care or medical services, as such, this fund was not eligible to cover the costs of the orthopedic surgery. When the DAS Division receives a donation, a letter is sent to the patron for each d onation that states “Financial donations directly benefit the animals by providing emergency medical care and rehabilitation so that they can be adopted into new loving homes.” While the donations that have been accepted have been put into restricted funds that did not allow for medical expenditures, the letter for donors earmarked the funds received to be allowed for the medical care of animals whether in or out of the DAS Division to facilitate adoptions. The resolution did not contemplate this earmark; therefore, while the current funds do not allow for the expenditure of the orthopedic surgery, the donations provided and confirmed via letter do provide that these funds can be used for the purposes of helping animals get adopted, without limitation of those animals being in the DAS Division Custody. Therefore, funds limited to the purpose of this one (1) orthopedic surgery should be paid from the earmarked medical treatment donations that were intended to help the adoption of animals, which is the purpose of the County’s commitment. The earmarked medical treatment funds were placed into the improper fund with restrictions due to there being no other fund for these purposes. As part of this Agenda, on October 24, 2023, a new fund is being established for d onations of medical treatments and services. The donation fund referenced below will continue to be used for donations of property, pet food, toys and supplies, and for promoting community awareness for animals in the custody of the DAS Division. Other expenditures for animals are being paid for with budgeted allocations from the General Fund, as intended by the Board Resolutions. The Corporate Compliance and Continuous Improvement Division is currently working with DAS for financial, procurement, and general operations for process improvement and implementation of additional controls and have implemented and are revising current operations to help prevent reoccurrences. Additionally, the Corporate Compliance team is continuing to be actively engaged in the DAS Division and is providing the Division training for process improvements. FISCAL IMPACT: Funds in an amount up to $8,057.74 are available in Domestic Animal Services Donation Fund (1135), Cost Center 155414 for the one (1) orthopedic surgery that the County committed to paying. GROWTH MANAGEMENT IMPACT: None.
