Agenda 10/24/2023 Item #16C4 (Utilities conveyance for potable water infrastructure on Collier County Sports Complex and Events Center)10/24/2023 EXECUTIVE SUMMARY Recommendation to approve and authorize the Chairman to execute documents necessary for a utilities conveyance for potable water infrastructure on County-owned property located at the Collier County Sports Complex and Events Center, 3920 City Gate Blvd N, to the Collier County Water-Sewer District, at a cost not to exceed $200. OBJECTIVE: To convey a Utility Facilities Warranty Deed and Bill of Sale and appurtenant Utility Easement to the Collier County Water-Sewer District (“District”) for potable water infrastructure installed on County-owned property. CONSIDERATION: On December 8, 2020 (Agenda Item 11.B), the County entered into the Sixth Amendment to the Agreement with Manhattan Construction (Florida), Inc. for work on Phase 2.1 and 2.2A at the Collier County Sports Complex and Event Center (Project 50156). The construction of the facilities is now nearly complete, and in preparation for the final completion and obtaining the final Certificates of Occupancy, the County must meet the requirements of the Water-Sewer District. The attached documents (Utility Facilities Warranty Deed and Bill of Sale, appurtenant Utility Easement, and Owner’s Affidavit) are required for the conveyance of portions of the County-built utilities to the District (a location map is attached for reference). The District is the water and wastewater utility service provider in the City Gate area and will provide water and wastewater utility service to the Sports Complex and Event Center. Upon approval, the executed documents will be provided to the County as part of the permitting process for the Collier County Sports Complex and Event Center. Growth Management Community Development (GMCD) will record the appropriate conveyance documents once all District requirements have been met for Preliminary Approval. The Board of County Commissioners, acting as the Ex-Officio Governing Board of the Collier County Water-Sewer District, will then subsequently grant final acceptance of the conveyed utilities. FISCAL IMPACT: Funds in the amount of $200 for recording the Utility Easement, Utility Facilities Warranty Deed and Bill of Sale, Owner's Affidavit, and any additional needed documents are available in Sports Complex Capital Fund 3007, Sports Complex Project (50156). GROWTH MANAGEMENT IMPACT: There is no impact to the Growth Management Plan related to this action. Title to the subject utility system(s) or portion(s) thereof and/or easement(s), if any, being conveyed to the County is not encurnbered by any recorded mortgage, recorded assignment of rents or profits, by any recorded Uniform Commercial Code Financing Statement, or by any other recorded document that imposes a security interest that could negatively affect conveyance of marketable title to the utility system(s) or portion(s) thereof and/or any easement being conveyed to the County. 6.
