Agenda 10/24/2023 Item #16B2 (Resolution - Parcel 528CONV for construction of a turn lane)10/24/2023 EXECUTIVE SUMMARY Recommendation to approve a resolution authorizing the conveyance via quitclaim deed to the State of Florida Department of Transportation of all Collier County’s right, title, interest, claim and demand in a parcel of land situated on the west side of US-41 between Cocohatchee River and Clear Bay Drive. OBJECTIVE: To convey to the State of Florida Department of Transportation (FDOT) the County’s right of way, drainage and preserve easement interests in a parcel of land (“Parcel 528CONV” or the “Property”) needed for construction of a turn lane on the west side of US-41 between Cocohatchee River and Clear Bay Drive. CONSIDERATIONS: FDOT has made application to the County requesting it quitclaim to it any right, title, interest, claim and demand the County may have in a 5,318 square feet parcel of land (the “Property”) located on the west side of US-41 between the Cocohatchee River and Clear Bay Drive for a nominal consideration amount of one dollar ($1.00) to construct a turn lane, further described below. The County’s interests in the Property are limited to right of way, drainage, and preserve easements dedicated to the County by the Cocohatchee River Trust P.U.D. Plat, recorded on December 4, 1991, in Plat Book 18, Pages 97 and 98 of the Public Records of Collier County. The proposed turn lane is needed to accommodate increased vehicular traffic into Clear Bay Drive on the west side of US-41. US-41 is operated and maintained by FDOT. Staff accordingly recommends approval of the attached resolution and quitclaim deed, in accordance with Florida Statutes section 125.38, which will be recorded by FDOT. FISCAL IMPACT: There is no cost to Collier County associated with this item. Florida Department of Transportation (FDOT) will be responsible for recording the quit claim deed and maintaining the turn lane. GROWTH MANAGEMENT IMPACT: None. LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires a majority vote for Board approval. -DDP RECOMMENDATION: Adopt the attached Resolution; Authorize the Board’s Chairman to execute the quitclaim deed set forth in Exhibit “A” to the Resolution on behalf of the Board; and Authorize the Board’s Chairman to execute any such other closing documents needed to effectuate transfer, after approval by the Office of the County Attorney.
