EXECUTIVE SUMMARY
Recommendation to approve the release of a code enforcement lien with an accrued value of $27,800 for a
reduced payment of $14,683 in the code enforcement action titled Board of County Commissioners v. Marie
A. Louis, Fernande Douyon, and Jean R. Louis, in Special Magistrate Case No. CELU20210013112 relating
to property at 946 Hamilton St., Collier County, Florida.
OBJECTIVE: For the Board of County Commissioners to accept an offer to release a code enforcement lien with
an accrued value of $27,800 for a reduced payment of $14,683 in relation to Special Magistrate Case No.
CELU20210013112.
CONSIDERATIONS: Due to a code violation at 946 Hamilton St., the Special Magistrate ordered the imposition
of a lien against Marie A. Louis, Fernande Douyon, and Jean R. Louis in Case No. CELU20210013112. The
violation consisted of selling items under a tent in front of an occupied residential property. The lien was recorded
in the Official Records on December 12, 2022, in O.R. Book 6197, Page 3576, i n the amount of $8,623.45. Fines
continued to accrue; therefore, the lien amount of $27,800 is based on 84 days of accrued fines ($100 per day from
December 20, 2021, through May 17, 2023) totaling $27,800. The new owner brought the property into compliance
on May 17, 2023.
946 Hamilton St. Trust acquired the property via Foreclosure Sale with a Certificate of Title recorded on May 10,
2023, in O.R. Book 6245, Page 3208. Pursuant to Resolution No. 2023-90, a request for reduction of fines may be
considered, in part, when a lien encumbers property under new ownership, and the new owner has diligently
pursued abatement and achieved compliance and/or when payment of the lien would impose a severe financial
hardship on the owner. Immediately after obtaining ownership, 946 Hamilton St. Trust removed the tent from the
property, abating the violation. The property is being actively maintained, and 946 Hamilton St. Trust offers to pay
operational costs of $223.45 to settle $27,800 in accrued fines. Therefore, Code Enforcement recommends
accepting payment of $14,683 to settle the fines. The recommended amount of $14,683 is based on ten percent of
the Collier County Property Appraiser’s Assessed Value of $146,828 (as of August 11, 2023) and meets the criteria
outlined in Resolution 2023-90. There are no known violations at this time.
FISCAL IMPACT: Acceptance of a payment of $14,683 to settle the lien will result in a fine reduction of
$13,117. This action correlates to what is outlined in Collier County Resolution 2023-90.
GROWTH MANAGEMENT IMPACT: No growth management impact is associated with this action.
LEGAL CONSIDERATIONS: The County Attorney’s Office has reviewed this item and approved it as to form
and legality. Majority support is required for approval. This item conforms to the Board’s policy contained in
Resolution 2023-90. RTT
RECOMMENDATION: To approve the recommended reduction of fines for $27,800, accept a $14,683 payment,
release the lien, and authorize the Chairman to sign the attached release and satisfaction of lien for recording in the
Official Public Records.
