EXECUTIVE SUMMARY
Recommendation to authorize the Office of the County Attorney to initiate foreclosure proceedings under
Section 162.09, Florida Statutes, in relation to $168,750 in accruing code enforcement liens, arising from
Code Enforcement Special Magistrate Case No. CENA20210008684 and Case No. CEV20210008685, entitled
Board of County Commissioners, Collier County, Florida, vs. Lee V. Lambert.
OBJECTIVE: To obtain authorization for the Office of the County Attorney to initiate foreclosure proceedi ngs
under Section 162.09, Florida Statutes, in relation to $168,750 in accruing code enforcement liens against all real
and personal property owned by Lee V. Lambert and his unknown heirs for ongoing violations at 660 Palm
Avenue, Goodland, Florida.
CONSIDERATIONS: The property located at 660 Palm Avenue, Goodland, Florida 34140, Folio No.
46470040007, in Collier County, owned by Lee V. Lambert according to the Collier County Property Appraiser,
has a long history of code enforcement violations. It is believed Lee V. Lambert died in 2010 and the property is
currently the home of his extended family, including his grandson. At the time of his death, Lee V. Lambert was a
resident of Tennessee, and the Florida property is not protected by homestead. The Florida property passed to his
wife, Helen Lambert, under the terms of his will.
Despite being found in violation of County ordinances on numerous occasions over the past several years, the
property continues to regularly violate County ordinances with storage of inoperable, non-registered vehicles, boats
and trailers, litter, and overgrown weeds.
Additional details concerning the code enforcement cases in which the subject lien was imposed include the
following:
Case No. CENA20210008684 By Order dated October 1, 2021, during a public hearing, the Code Enforcement
Special Magistrate (OSM) rendered an order finding the property owner was a “repeat” violator of Collier County’s
ordinances for outside storage, litter, and overgrown weeds. A sampling of photographs presented during the public
hearing is attached for reference. The order included $111.75 in operational costs and directed the property owner
to “mow or cause to mow all weeds, grass, or another similar non -protected overgrowth over eighteen (18) inches
in height to a height of less than six (6) inches, and remove all unauthorized accumulation of litter from the
property to a site intended for final disposal,” on or before October 8, 2021, or a fine of $100 per day for the
continued violation of Part C of the Order and an additional $100 per day for violation of Part D of the Order would
be imposed until the violation is abated.
On December 3, 2021, the Special Magistrate entered an Order Imposing Fines, which imposed an $11,311.75 lien
on all real and personal property owned by the property owner, and which provided for continuing accrual of fines
until abatement. The lien order was recorded in O.R. Book 6061, Page 278, et seq., of the Official Public Records
of Collier County.
Case No. CEV20210008685 By Order dated October 1, 2021, after a public hearing, the Code Enforcement Special
Magistrate (OSM) rendered an order finding the property owner was a “repeat” violator of Collier County’s
ordinances for inoperable, non-registered vehicles, boats, and trailers on the property. A sampling of photographs
presented during the public hearing is attached for reference. The order included $111.75 in operational costs and
directed the property owner to “abate the violation by repairing and/or affixing a c urrent, valid license plate to the
vehicle in violation, or by storing such vehicle within a completely enclosed structure, or by removing the
offending vehicle from the residentially zoned area to an area intended for such use” on or before October 8, 202 1,
or a fine of $50 per day would be imposed until abatement.
On December 3, 2021, the Special Magistrate entered an Order Imposing Fines, which imposed a $2,911.75 lien on
all real and personal property, and which provided for continuing accrual of fines until abatement. The lien order
was recorded in O.R. Book 6061, Page 284, et seq., of the Official Public Records of Collier County.

The breakdown of the lien is as follows:
The property is not protected by homestead and the Collier County Property Appraiser shows an improved value of
$236,830 based on the 2022 Final Tax Roll. There are no mortgages or other liens associated with the property in
question.
FISCAL IMPACT: Fiscal impact of initiating a foreclosure suit is approximately $410 (representing a $400 filing
fee plus the cost of service). Costs for maintaining the lawsuit (including, as necessary, any title review, copies,
mailings, service, transcripts, and other routing litigation costs) are not expected to exceed $500. The County is
expected to recover all costs in initiating and pursuing this lawsuit.
GROWTH MANAGEMENT IMPACT: No Growth Management Impact is associated with this Executive
Summary.
LEGAL CONSIDERATIONS: This item has been reviewed by the Count Attorney, is approved as to form and
legality and requires majority vote for approval. -JAK

against any non-homestead property, in relation to Special Magistrate Case No. CENA20210008684 and Case No.
CEV20210008685 entitled Board of County Commissioners, Collier County, Florida, vs. Lee V. Lambert, under
Section 162.09, Florida Statutes.

Please be advised that this matter has been referred to the Collier County Attomey's Office
for firther handling. As you know, the property located at 660 Palm Avenue, Goodland, Florida
has been the subject of various Code Enforcement cases including Case Numbers
CENA202 1 0008684 and CEV202 1 0008685.
As ofthe date ofthis letter, the fines/liens imposed by the Order ofthe Special Magistrate
on December 3,2021, on case CEV20210008685 have not been paid. A total of$10,561.75 is due
and owing as ofthe date ofthis letter and the fines will continue to accrue at a rate of$50.00 per
day until the violation is abated.
The fines/liens imposed by the Order of the Special Magistrate on December 3,2021 on
case C8NA20210008684 have not been paid. A total of$41,91L75 is due and owing as ofthe dare
of this letter and the fines will continue to accrue at a rate of $100.00 per day for the continued
violation of Part C ofthe Order and an additional $100.00 per day for violation of Part D ofthe
Order until the violation is abated.
Due to the lack of compliance with the Orders of the Special Magistrate, the Collier County
Attomey's Offrce may institute a foreclosure action pursuant to 9162.09(3) Florida Starutes and
