Approve Amendment 4 to the Public Transit Grant Agreement (G1V40) Commissioner LoCastro moved to approve the Agenda, Previous Minutes and Consent Items, and Commissioner Hall seconded. Passed unanimously. 5. PUBLIC COMMENTS FOR ITEMS NOT ON THE AGENDA None. 6. AGENCY UPDATES 6.A. FDOT Ms. Peters: Florida Department of Transportation (FDOT) is wrapping up our new projects for the Draft Tentative Work Program FY 2025-2029. Year 2029 is the new fifth year. We're looking forward to a possible public hearing, anticipated in the middle of October. We follow the legislative cycle. Commissioner LoCastro asked about a 951 update. We are currently constructing a noise wall at I-75 at exit 101. This is a design -build project. We have been in the design utility relocation phase from September of 2022 to July of 2023. We are starting noise wall clearing and construction. We will begin construction in late 2023 and 2024. It is anticipated to be complete by the spring of 2026. 6.11. MPO EXECUTIVE DIRECTOR None. 7. COMMITTEE CHAIR REPORTS 7.A. CITIZENS ADVISORY COMMITTEE (CAC) 7.A.1. Citizens Advisory Committee Chair Report Ms. McLaughlin indicated that the Chair was not present, and the Chair report was included in the agenda packet. 2 Packet Pg. 6 4.A.1 7.B. TECHNICAL ADVISORY COMMITTEE (TAC) 7.B.1. Technical Advisory Committee Chair Report Ms. Lantz: Your report is in your packet. TAC had a quorum. We endorsed routine projects like the Unified Planning Work Program (UPWP), Roll Forward Report, and the 2024 Calendar. We provided general comments regarding project costs related to the Transportation Improvement Plan (TIP) amendment to cover cost overruns for the Marco Island bike lane/sidewalk project and endorsed the amendment. We commented on and endorsed the proposed Transit Development Plan (TDP) Scope of Work. We received a presentation on the Collier to Polk Trail Priority Corridor and confirmed that there were no new alignments added to it, only a change in the priority so the funding could be allocated there. We also requested confirmation that the Rookery Bay segment was going to be eliminated from the SUN Trail map and endorsed the Collier to Polk Priority Trail Corridor. Our next meeting is scheduled for September 25, 2023. 7.C. BICYCLE PEDESTRIAN ADVISORY COMMITTEE (BPAC) 7.C.1. Bicycle and Pedestrian Advisory Committee Chair Report None. 7.D. CONGESTION MANAGEMENT COMMITTEE (CMC) 7.D.1. Congestion Management Committee Chair Report Ms. McLaughlin indicated that the Chair was not present, and the Chair report was included in the agenda packet. 7.E. LOCAL COORDINATING BOARD (LCB) 7.E.1. Local Coordinating Board Chair Report Ms. Siegler: LCB Chair, Mr. Pernas, is traveling. He was present at the September 6, 2023, meeting, and we did have a quorum. Board actions included the review and approval of the Florida Commission for the Transportation Disadvantaged approved rate model for fiscal years 2023-2024 for Collier County, and the Committee Transportation Coordinator's Draft FY 2022-2023 Annual Operating Report. The Board provided review and comment on the current draft major update to the Transportation Disadvantaged Service Plan (TDSP). For the reports and presentations, the Community Transportation Coordinator's Quarterly Report of Operating Statistics for the Paratransit System was presented by Omar De Leon, Public Transit Manager for Collier Area Transit (CAT). The MPO Quarterly Progress Report of Transportation Disadvantaged (TD) Program Support Accomplishments was presented by me. For the FDOT report, Michelle Peronto relayed that there has been a delay in providing some grant awarded vehicles to CAT and others because of production issues, and difficulty obtaining certain parts. FDOT is hosting a Grant Workshop related to FTA Sections 5310, 5311, and 5339 grants. Grant applications are available on September 22, 2023, and are due in December 2023. Both the Florida Public Transportation Association and the American Public Transportation Association are holding joint conferences in Orlando in October 2023. The distribution items included the Final 2023 TDSP Annual Update and updated Grievance Committee Sub -Committee roster. The next LCB meeting is a special meeting on October 4, 2023, for approval of the TDSP major update, which occurs every five years. Packet Pg. 7 4.A.1 8. REGULAR BOARD ACTION (ROLL CALL REQUIRED) 8.A. Approve Amendment Incorporating the Roll Forward Report in the FY 2024-2028 Transportation Improvement Program (TIP), and Authorizing Resolution 2023-07 Mr. Kingston: This TIP Amendment incorporates FDOT's annual Roll Forward Report. The FDOT Work Program Office provides us with an annual Roll Forward Report which includes projects from the previous fiscal year which were not authorized, and now must be incorporated into the TIP for the current year. Staff recommendation is for Board approval. Commissioner LoCastro moved to approve the Amendment Incorporating the Roll Forward Report in the FY 2024-2028 Transportation Improvement Program (TIP), and Authorizing Resolution 2023-07 and Council Member Perry seconded. Approve Amendment to the FY 2024-2028 Transportation Improvement Program (TIP) and Authorizing Resolution 2023-08 to Add Funding for the City of Marco Island Collier Alternate Bike/Ped Project Mr. Kingston: The City of Marco Island Director of Public Works sent an email in June 2023, describing how the construction cost estimates have increased approximately $1.5 million since the project application was submitted in 2019. MPO Executive Director, Anne McLaughlin, forwarded the request to FDOT to determine whether sufficient funding would be available to cover the cost increase. FDOT confirmed that funding was available, and programmed the amounts shown in the attachments in today's agenda packet. Staff is bringing the Amendment forward to the fiscal year 2024-2028 TIP, with FDOT's recommendation. Commissioner Hall moved to Approve Amendment to the FY 2024-2028 Transportation Improvement Program (TIP) and Authorizing Resolution 2023-08 to Add Funding for the City of Marco Island Collier Alternate Bike/Ped Project and Commissioner Saunders seconded. REGULAR BOARD ACTION (NO ROLL CALL) 9.A. Approve Amendment #4 to FY 22/23-23/24 Unified Planning Work Program (UPWP) and Related Resolution Ms. Siegler: The UPWP identifies and describes the MPO's budget for activities, studies, and technical support, and lists the funding sources for each planning task. The primary purpose of the Amendment is to update the amount for the fiscal year 2023-2024 Transportation Disadvantaged Planning Grant award to $29,265.00. The previous estimated award was $27,954.00. The Amendment also includes updated estimated completion dates for some studies/plans (Tasks 5 and 6), substitution of a Safe Streets for All Action Plan for Local Road Safety Plan (Task 5), and language specifying the amount of current PL funding required to be, and allocated toward, Complete Streets initiatives (Task 5). The public comment period for the proposed UPWP Amendment began on August 18, 2023, and closes at this Board meeting. No public comments have been received. The TAC and CAC voted to endorse the amendment at their August 28 meeting. Commissioner Saunders moved to approve Amendment #4 to FY 22123-23124 Unified Planning Work Program (UPWP) and Related Resolution and Council Member Perry seconded. Passed unanimously. 9.11. Approve Resolution and Letter Supporting Priority Trail Corridor Designation for the Collier to Polk Regional Trail System Ms. Chinault gave the Collier Polk Proposed Priority Trail Corridor presentation which can be viewed in the September 8. 2023 MPO Board Agenda Packet. Ms. McLaughlin: This project came as a pleasant surprise form FDOT. It connects cities and towns in the area, including places that don't always get the attention they need, and makes them part of the regional network. It is consistent with our Bicycle and Pedestrian Master Plan and the Naples Pathways Coalition's Paradise Coast Vision Plan. It even helps solve an issue you asked me to work on at your last meeting to look into what it would take to add the Marco Island Loop Trail to the SUN Trail network. The project comes at a wonderful time for us. I will share more details about that when we cover the Marco Island Loop Trail in item 9.C. Ms. Avola-Brown requested to speak on item 9. C. and expressed her enthusiasm and appreciation for FDOT and all involved. Commissioner Saunders moved to approve Resolution and Letter Supporting Priority Trail Corridor Designation for the Collier to Polk Regional Trail System and Council Member Blankenship seconded. Passed unanimously. 9.C. Approve a Resolution Accepting FDOT's Final Report on the Marco Island Loop Trail Feasibility Study and Conceptual Design and Directing Staff to Take the Necessary Steps to Request SUN Trail Funding to Conduct Future Phases Ms. McLaughlin: This is for the Board to approve a resolution accepting FDOT's Final Report on the Marco Island Loop Trail Feasibility Study and Conceptual Design and provide staff direction regarding the next step in the process. You received a presentation from FDOT and their consultant, Landis Evans, for this item at the June 9, 2023, MPO Board meeting. The report has since been finalized, without any major changes, only some clean-up and revisions. Packet Pg. 9 4.A.1 There were some items you wanted brought back to you. One was a report from me on how to add this corridor to the SUN Trail alignment, and voila, here it is. You also wanted updated cost estimates from FDOT on each corridor alternative, and FDOT did provide those at the planning level with the notation that the costs do not include design or construction engineering inspection, future maintenance, water treatment, and environmental mitigation. That's where the costs are the highest, and what a Project Development & Environmental (PD&E) Study will give us in detail. Collier County had their consultant review FDOT's cost estimates and has validated them with the same caveats. Regarding the status requested on the County Road 92 culvert, County Transportation Management Services Department reported that the design is in its final stages and construction was anticipated to begin in July with an approximate 8-month schedule. FDOT has requested a Board resolution or letter of support indicating a willingness to move the project forward. The draft Resolution 2023-10 accepts FDOT's Final Report and directs staff to take the steps necessary to request SUN Trail funding to conduct a PD&E, estimated to cost between $1.5 and $2 million. We're requesting that the Board consider approving Resolution 2023-10 accepting FDOT's Final Report on the Marco Island Loop Trail Feasibility Study and Conceptual Design and directing staff to take the steps necessary to request SUN Trail funding to conduct a PD&E Study. It was endorsed by the TAC and CAC. Mr. Musico requested to speak on item 9. C. and expressed that there is a strong desire and overwhelming support for this project. Commissioner Hall moved to approve a Resolution Accepting FDOT's Final Report on the Marco Island Loop Trail Feasibility Study and Conceptual Design and Directing Staff to Take the Necessary Steps to Request SUN Trail Funding to Conduct Future Phases and Commissioner LoCastro seconded. Passed unanimously. 9.D. Approve Proposed 2024 MPO Meeting Calendar Mr. Kingston: This is the proposed 2024 MPO Meeting Schedule which has been endorsed by TAC and CAC. Commissioner Saunders moved to approve Proposed 2024 MPO Meeting Calendar and Commissioner Kowal seconded. Passed unanimously. 10. PRESENTATIONS (MAY REQUIRE BOARD ACTION) None. 11. Letter of Support for Miccosukee Tribe's Safe Streets for All Grant Application Ms. McLaughlin: I was asked by the Miccosukee Tribe to write a letter of support for their Safe Streets and Roads for All (SS4A) Planning and Demonstration Grant Application. ll.D. Updated 2023 MPO Meeting Calendar Item distributed. 12. MEMBER COMMENTS Council Member Perry: Regarding the Joint meeting with Lee MPO on August 18, 2023, I commend Collier MPO Board for 100% attendance. I was disappointed that the Lee MPO Board did not do the same. Thank you to staff for making sure we were going to be there. Commissioner Saunders: I agree that the Joint Workshop was a good meeting. Commissioner LoCastro: I agree with what has been said. I hope that it is possible to get more of the Lee County MPO Board at the meeting in the future. We rarely have joint meetings with Lee, and it was important to be there. It was a valuable meeting. Council Member Blankenship: I agree with what has been said regarding the joint meeting with Lee. Commissioner Kowal: I agree that the Lee MPO Board attendance was disappointing, especially when it was my first joint meeting. These meetings are important, and we should all take these meetings seriously. Chair Folley: I agree with what has been said regarding the joint meeting. I am very pleased with the progress of the Marco Island Trail Loop. Shout out to Mr. Musico, FDOT and everyone involved. We appreciate the support. 13. NEXT MEETING DATE 13.A. Agency Reports • Florida Department of Transportation (FDOT) o FDOT's community liaison, Ms. Victoria Peters, reported that reported that an online hearing on FDOT's new draft tentative work program for FY 2025-2029 will be held from October 16 through October 20. On October 18 from 10 a.m. to noon, in -person and virtual public hearings will be held in Bartow and at SWAO in Fort Myers. • MPO Director o Ms. McLaughlin reported that MPO staff just learned that at a press conference earlier in the morning on the Moving Florida Forward Infrastructure Initiative, FDOT and the Lieutenant Governor announced that the Collier County projects included in the Imitative are going to be funded. There are four projects: 1-75 interchange improvements at Pine Ridge Road; I-75 widening from Golden Gate Parkway to Corkscrew Road; SR 29 from CR 846 to New Market Road (Immokalee Loop Road); and SR 29 from New Market Road north to SR 82. Part 450 Sections 326, 328, 330, 332 and 334, and by F.S. § 339.175(6), (8) and (13); and WHEREAS, the Florida Department of Transportation ("FDOT") requested the Collier MPO to amend its FY 2023/24-2027/28 TIP to add Federal Project Numbers ("FPNs") 451147- 1, 451147-2, and 451147-3, as Capital for fixed transit routes, as shown in attached Exhibit 1; and WHEREAS, FDOT has submitted a letter to the MPO stating that the amendments are necessary to include in the MPO's TIP to ensure consistency with FDOT's Work Program, as shown in attached Exhibit 2; and WHEREAS, the MPO announced the TIP Amendment on its website, distributed it via e-mail to various list -serves, and followed all of the steps of its Public Participation Plan through the expiration of the public comment period, which terminated with the MPO's meeting on October 13, 2023; and WHEREAS, the MPO has reviewed the proposed TIP Amendment for those projects and determined that it is consistent with the MPO's adopted plans and policies; and WHEREAS, in accordance with all required State and federal procedures, rules and regulations, including but not limited to the FDOT's MPO Administrative Manual, the TIP Amendment must be accompanied by an endorsement indicating official MPO approval. CONSIDERATIONS: The Florida Division of the Federal Highway Administration ("FHWA") notified Collier MPO on February 23, 2023, that the USDOT selected the MPO to receive a $200,000 SS4A Action Plan grant subject to the MPO entering into a formal grant agreement with the FHWA. As part of the grant submittal, the MPO Board agreed to provide $10,000 and the County agreed to provide $40,000 to meet the required match amount of $50,000. The attached Local Match Agreement with Collier County memorializes the agreed upon terms and conditions pertaining to the County's and MPO's financial contributions for the SS4A Action Plan Grant and establishes the FHWA approved Comprehensive Safety Action Plan as the MPO's deliverable. The Board of County Commissioners approved the Local Match Agreement at their meeting on September 12, 2023. RECITALS: WHEREAS, Public Law 117-58, the Infrastructure Investment and Jobs Act, established the United States Department of Transportation's Safe Streets and Roads for All ("SS4A") Action Plan grant program, which appropriated funds to support the development of local Comprehensive Safety Action Plans to reduce fatalities and serious injuries for all roadway users, including pedestrians, bicyclists, public transportation, personal conveyance and micromobility users, motorists, and commercial vehicle operators; and WHEREAS, on September 9, 2022, the Collier MPO approved the filing of a SS4A Action Plan grant application and authorized its Executive Director to file the application for $200,000 in Federal funds and $50,000 in local matching funds for a total amount of S250,000, along, with all required documents, and to take any action necessary to obtain approval of such grant fund application; and WHEREAS, on September 13, 2022 (Agenda Item 16.A.36), the County approved contributing S40,000 in County funds towards meeting the local matching funds requirement, subject to the Collier MPO contributing $10,000 in local funds, and with the condition that the Parties enter into an agreement with deliverables should the grant be awarded, prior to acceptance of the grant by the Collier MPO; and WHEREAS, on February 23, 2023, the Florida Division of the Federal Highway Administration ("FHWA") notified the Collier MPO that the U. S. Department of Transportation selected the Collier MPO to receive an SS4A Action Plan grant subject to the Collier MPO entering into a formal Grant Agreement with the FHWA; and WHEREAS, pursuant to Florida Statute, § 339.175, the Collier MPO is considered an entity separate from the State and the local governments representing the governing board of the Collier MPO, and as such the Collier MPO possesses such powers and privileges allowing it to enter into agreements and to perform all acts required by federal or State law that are necessary to qualify for federal aid action, including entering into interlocal agreements enabling them to Packet Pg. 37 9.A.1 cooperate with other localities on the basis of reaching a mutual advantage as provided in Florida Statute, § 163.01, the Florida Interlocal Cooperation Act of' 1969; and WHEREAS, the Collier MPO and the County have a longstanding complimentary and mutually beneficial fiscal relationship in place established by the Amended and Restated MPO Staff Services Agreement (see Exhibit 1, attached), which promotes the highest utilization of staff and County -owned facilities at reasonable expense to the taxpayers, and promotes the furtherance of the MPO's mission; and WHEREAS, the MPO and the County wish to jointly enter into this Local Match Agreement to memorialize their agreed upon terms and conditions pertaining to the Parties' respective financial contributions for the 20% local match funding toward the $200,000 SS4A Action Plan grant as further set forth below. WITNESSETH: NOW, THEREFORE, in consideration of $10.00 and other good and valuable consideration exchanged between the Parties, the Parties agree as follows: Recitals. All of the above recitals and any exhibits referenced therein are true and correct and are hereby expressly incorporated herein by reference as if set forth fully below. 2. Payment Terms. The County and the Collier MPO hereby collectively agree to reimburse up to $50,000 in local match funds for services provided in furtherance of the SS4A Action Plan grant program (hereafter the "SS4A Grant"), pursuant to the terms and conditions set forth herein. 3. Responsibilities of Collier County. The County shall dedicate to the Collier MPO local matching funds in the amount of $40,000 for the SS4A Grant project, which the Collier MPO will apply towards the payment of invoices for services provided in furtherance of satisfying the SS4A Grant project at the rate of 16% of each invoice for services provided, up to the maximum amount of the $40,000 in local matching funds provided by the County. The County agrees to provide its $40.000 in dedicated local matching funds through an interdepartmental transfer. 4. Responsibilities of the Collier MPO. The Collier MPO shall dedicate local matching funds in the amount of $10,000 for the SS4A Grant project, which the Collier MPO will apply towards the payment of invoices for services provided in furtherance of satisfying the SS4A Grant project at the rate of 4% of each invoice for services provided, up to the maximum amount of the $10,000 in local matching funds provided by the Collier MPO. The Collier MPO agrees to: i. Provide $10,000 of its local funds as part of the required local match. ii. To submit a budget amendment request to the County for the $40,000 County local funding match. Packet Pg. 38 9.A.1 iii. Process an amendment to the MPO's FY2023-2024 Unified Planning Work Program to add the SS4A Action Plan grant. iv. Manage the grant award and the development of the Comprehensive Safety Action Plan in compliance with the Amended and Restated MPO Staff Services Agreement between the Collier MPO and the County effective May 24, 2022. V. Provide the County with an electronic copy of the final FHWA approved Comprehensive Safety Action Plan as a deliverable. 5. Reimbursement Terms. Each invoice for which payment is reimbursed from the local matching funds provided by the County and the Collier MPO shall be supported by the following documentation included with each payment application: a. A Progress report toward completion of the services being provided. b. Supporting documentation for the period of services being billed shall include invoices specifically documenting the date, time. and type of services provided. c. Proof of payment/reimbursement shall be recorded for each invoice paid. 6. Term of the Agreement and Termination. This Agreement shall become effective upon the final approval by both the Collier MPO and the County. and shall remain in effect until the completion of the Comprehensive Safety Action Plan on or before November 30, 2025. This Agreement shall automatically terminate on November 30, 2025, unless the Collier MPO and the County renew or extend the Agreement via a separate written instrument mutually agreed upon by the Parties. 7. Applicable Law. Any disputes arising in connection with this .Agreement shall be governed and interpreted by the laws of the State of Florida without regard to its conflict of law provisions. 8. Non -Waiver. None of the provisions of this Agreement shall be considered waived by any Party unless such waiver is given in writing and accepted in writing by the other Party. No such waiver shall be a waiver or any past or future default, breach or modification of any of the terms, provision, conditions or covenants of the Agreement unless expressly set forth in such waiver. 9. Entire Agreement / Amendments. This Agreement shall constitute the entire understanding and agreement between the Parties with respect to the subject matter hereof and replace and supersede all prior understandings. communications, agreements or arrangements between the Parties with respect to this subject matter, whether oral or written. This Agreement may only be amended as agreed to in writing by both Parties. 10. Maintenance of Records. Consultants, contractors, and entities (hereafter "Contractors") of any kind that are engaged to provide services to produce the Comprehensive Safety .Action Plan shall keep adequate records and supporting documentation concerning or reflecting its services hereunder. Such records and documentation shall be retained for a Packet Pg. 39 9.A.1 minimum of seven years from the date of termination of this Agreement or the date the Project is completed, whichever is later. The Collier MPO and the County, or any duly authorized agents or representatives of the Collier MPO and the County, shall have the right to audit, inspect and copy all such records and documentation as often as they deem necessary during the period of this Agreement and during the seven year period noted above. WITNESSETH: WHEREAS, the MPO, pursuant to the power conferred upon it by Section 339.175, Florida Statutes, and Article 5 of the Amended And Restated Interlocal Agreement for Creation of the Collier Metropolitan Planning Organization (the "Interlocal Agreement") between the Florida Department of Transportation ("FDOT"); Collier County (the "County")- the City of Marco Island; the City of Naples; and Everglades City, dated February 26, 2015, which was subsequently Amended and Restated effective May 28, 2019, the MPO may employ personnel and/or enter into agreements, with local and/or State agencies to utilize the staff resources of such agencies or for the performance of certain services by such agencies as necessary to fulfill its responsibilities and obligations as required by law; and WHEREAS, pursuant to the aforesaid Interlocal Agreement executed between the County, the City of Marco Island, the City of Naples, Everglades City and the FDOT, it is contemplated that County personnel will perform the substantial portion of each task provided for in 23 Code of Federal Regulations (CFR) Part 450 and Chapter 339.175 Florida Statutes as necessary to carry out the continuing, cooperative and comprehensive transportation planning process mandated by federal regulations as a condition precedent to the receipt of federal capital or operating assistance in the urbanized area; and WHEREAS, Section 339.175, Florida Statutes provides, in part, that a Metropolitan Planning Organizations' Executive Director reports directly to his or her Governing Board, and that the Executive Director and staff are employed by the Metropolitan Planning Organization or through a staff services agreement between the Metropolitan Planning Organization and another governmental entity; and WHEREAS, it is deemed by the parties to be appropriate and necessary that the duties and obligation of the County, in relation to its role providing staff and services to the MPO, be defined and fixed by formal agreement. NOW, THEREFORE, in consideration of the mutual covenants, premises, and representations herein, the parties agree as follows: 1.00 Purpose For the reasons recited in the preamble, which are hereby adopted as part hereof, this Agreement is to provide for professional services to carry out the terms of the Interlocal Agreement and any other agreement to which the MPO is a party, and to provide staff services and support for the C Packet Pg. 43 9.A.1 administration of the MPO. 2 00 Scope of Services It is agreed by the County that it shall famish the MPO with the staff necessary for professional, technical, administrative, and clerical services, equipment, office and other space, and other incidental items as may be required and necessary to manage the business and affairs of the MPO and to carry on the transportation planning and programming process specified by the Interlocal Agreement and any other agreement to which the MPO is a party; provided, it is understood and agreed that, unless otherwise provided for, the performance of such service and functions shall be limited to those specified and allocated to the County in the annual Unified Planning Work Program (UPWP) budget and all approved budgets and management reports under federal or State grant contracts with the MPO. The County's annual charge for furnishing office space to the MPO, including all common area maintenance and utility costs, shall be $15,249; as more specifically provided in a separate lease agreement executed by the parties. To minimize disruption, the County shall firnish the MPO with the aforementioned office and other space so as to be continuously co -located with the Collier County Growth Management Department and shall make reasonable efforts to avoid frequent relocation of said office and other space. The MPO is responsible for the selection of, and execution of an employment agreement with, the Executive Director of the MPO. Each year, the MPO shall review and evaluate the performance of the MPO Executive Director in accordance with the performance -based merit plan as provided in the Collier Metropolitan Planning Organization/Executive Director Employment Agreement. The MPO authorizes the MPO Executive Director to secure FDOT approval for amendment of UpWP tasks, which change their dollar value by an amount less than or equal to $25,000, and which do not change their scope or the total approved fiords for the UPWP. Any amendment of the UPWP greater than $25,000 shall require the approval of the MPO. The UPWP shall be prepared by the MPO Staff in cooperation with all related State and federal agencies and MPO committees in accordance with the rules and regulations governing the MPO and shall be subject to the approval of the MPO before submittal to State or federal agencies. 2.01 MPO Executive Director The MPO Executive Director shall be responsible to the MVO for the conduct of the transportation planning process as detailed in the UPWP as well as the appointment, assignment, direction, and control of all personnel necessary thereto; the development of an appropriate organizational structure to carry out the responsibilities set forth in a well Agreement -, an the development of procedures to monitor and coordinate the planning Process, as Positions shall be oall administration of MPO programs. The financial records and accounts of the MPO including revenue receipts and expenditures shall be administered by the County in accordance with its ordinary procedures. b. Contracts and bids for the purchase of MPO materials and services shall be in accordance with County procedures for the same purposes and the MPO adopts by reference the County's Purchasing Ordinance, Policy and any administrative regulations governing procurement matters. The MPO shall review and approve all Requests for Proposals (RFP), Requests for Professional Services (RPS), and subsequent contracts. Contracts and bids for the purchase of materials and services using PL, FTA and TD funds allocated to the MPO and identified in the UPWP will be in accordance with County procedures, but any actions taken within the authority of the MPO relating to such matters shall be independent of Board of County Commissioners (BCC) approval. C. Through the adoption of this Agreement, the MPO adopts the United States Department of Transportation's goals regarding the procurement of services from firms registered as Disadvantaged Business Enterprises (DBE). In addition, the MPO adopted a DBE Policy in accordance with FDOT's DBE Plan. 2.06 Information Technology and Office Equipment a. The MPO may need to purchase, maintain and upgrade office equipment, office / computer hardware, software, and other resources, This may include, but is not limited to, the purchase of office equipment such as printers, facsimile machine, copier, computers and hardware upgrades, reference documents, software and supporting maintenance. Grant funds allocated to the MPO and identified in the UPWP for such requirements will be used. All resources purchased by the MPO shall be the property of the MPO. Collier County's Information Technology department is responsible for all maintenance of MPO computers and may be paid for services through annual interdepartmental allocations. The MPO may on occasion request additional administrative or public relations assistance due to MPO staff turnover or attrition. Such temporary assistance may be provided upon the MPO Executive Director and the County Manager or his/her designated representative reaching agreement on. the appropriate re -allocation of County personnel on a case -by -case basis. b. The MPO may on occasion request GIS assistance to update various MPO maps and GIS data files. Such assistance may be provided upon agreement reached in the same manner set forth in the above subsection (a). c. If the MPO utilizes such temporary assistance from the County, the County will be reimbursed through an interdepartmental transfer at the actual cost of the utilized employee's salary, plus any other actual documented additional cost. County staff time spent supporting MPO activities shall be documented on the MPO timesheet, approved by the MPO Executive Director. 3.00 Reimbursement to the County The MPO hereby agrees that it shall reimburse the County for all services rendered under this Agreement as specified in the UPWP budget and all approved budgets under federal or State grant contracts with the MPO. The determination of eligible costs shall be in accordance with 2 CFR § 200 and all other applicable rules, regulations, and laws (both State and federal), as appropriate. Administration over grants will also follow the policies and procedures set forth in the County's Grant Administration Handbook and CMA 5330, which is compliant with 2 CFR Part 200. 3.01 Local Share The MPO will provide cash or in -kind services for the required match for federal funds from the Federal Highway Administration (FHWA), the Federal Transit Association (FTA), FDOT and the Florida Commission for Transportation Disadvantaged (CTD), where appropriate. These funds may also be derived from financial contributions made by the MPO's member local governments, including Collier County and the Cities of Naples, Marco Island and Everglades City. 3.02 Invoices and Progress Reports The MPO shall provide to the FDOT or appropriate federal agencies quarterly progress reports and invoices for reimbursement for all federal grants with FHWA, FTA and State grants received through the CTD. The progress reports and invoices shall be in sufficient detail for audit purposes. s 1 Packet Pg. 46 9.A.1 3.03 Payment Payment to the County of all monies by the MPO is contingent upon the MPO first receiving the funds for the work tasks from the FDOT, FHWA, FTA or CTD. Requests for County services may not be made unless sufficient funding is available to reimburse the County for related expenditures. 3.04 Travel Expenses Reimbursement from federal and State funds for per diem and mileage expenses incurred by MPO staff and Board members for MPO business shall be consistent with the federal government rates. 4.00 Information and Reports The County will provide all required information and reports and will permit access to its books, records, accounts, and other sources of information, and its facilities as may be determined by FDOT, FHWA, or FTA to be pertinent to ascertain compliance with such regulations, orders, and instructions. Where any information required of the County is in the exclusive possession of another who fails or refuses to furnish this information, the County shall certify to FDOT, FHWA, or FTA as appropriate, and shall set forth what efforts it has made to obtain the information. 5.00 Continuity of Operations Plan (COOP) The MPO shall adhere to Collier MPO's Continuity of Operations Plan (COOP). The COOP is consistent with Collier County 9s Comprehensive Emergency Management Plan (CEMP). Collier County shall provide the MPO with an alternate facility for a reasonable period if one is required. 6.00 Amendment of Agreement The County and the MPO may, upon initiation of either party, amend this Agreement to cure any ambiguity, defect, omission or to grant any additional powers, or to confer additional duties which are consistent with the intent and purpose of this Agreement This Agreement shall become effective upon approval by the MPO and the County and remain in effect for a period of three years. At that time, the MPO shall review this Agreement to determine if any changes are warranted. CONSIDERATIONS: The Florida Division of the Federal Highway Administration ("FHWA") notified Collier MPO on February 23, 2023, that the USDOT selected the MPO to receive a $200,000 SS4A Action Plan grant subject to the MPO entering into a formal grant agreement with USDOT. As part of the grant submittal, the MPO Board agreed to provide $10,000 in funds and the County agreed to provide $40,000 to meet the required match amount of $50,000. The Board of County Commissioners approved a Local Match Agreement for the $50,000 at their meeting on September 12, 2023. MPO Board approval of the Local Match Agreement is the preceding item on today's meeting agenda. The attached Grant Agreement memorializes the agreed upon terms and conditions between the MPO, FHWA, and USDOT pertaining to the Comprehensive Safety Action Plan that is to be developed. This designation is accomplished by agreement between the Governor and the affected units of local government. The federal rules allow the states and units of local government to largely determine the specific composition of the MPOs. In Florida, Section 339.175, Florida Statutes, provides the requirements for MPO membership composition and apportionment of the voting membership. Pursuant to these state and federal rules, the Collier MPO was created in 1982. Metropolitan Planning Area Boundary The boundaries of the MPA are determined by agreement between the MPO and the Governor and, at minimum, encompass the entire existing urban area (as defined by the Census Bureau) plus the contiguous area expected to become urban within a 20-year forecast period (23 CFR 450.312). Collier County, also known as the Cape Coral — Fort Myers - Naples Metropolitan Statistical Area (MSA)1, is located along Southwest Florida's subtropical Gulf Coast. The Collier MPO's boundaries are coterminous with Collier County. Collier County is the largest County in Florida with a total area of 2,305 square miles and a land area of 2,025 square miles. The cities of Naples, Everglades City and Marco Island are the County's three incorporated areas. Collier County's 2020 population according to the US Census was 375,752. Figure 1 on the following page shows Collier MPO's Metropolitan Planning Area Boundary and incorporated municipalities. A significant portion of Collier County is protected conservation land, as shown in Figure 2 on page 3. Packet Pg. 73 9.C.2 Federal laws and regulations require metropolitan planning organizations (MPOs) to be designated for each urban area with a population greater than 50,000 people [23 CFR 450,310(a), 23 USC 134(d)]. This designation is accomplished by agreement between the Governor and the affected units of local government. The federal rules allow the states and units of local government to largely determine the specific composition of the MPOs. In Florida, Section 339.175, Florida Statutes, provides the requirements for MPO membership composition and apportionment of the voting membership. Pursuant to these state and federal rules, the Collier MPO was created in 1982. Metropolitan Planning Area Boundary The boundaries of the MPA are determined by agreement between the MPO and the Governor and, at minimum, encompass the entire existing urban area (as defined by the Census Bureau) plus the contiguous area expected to become urban within a 20-year forecast period (23 CFR 450.312). Collier County, also known as the Cape Coral — Fort Myers - Naples Metropolitan Statistical Area (MSA)', is located along Southwest Florida's subtropical Gulf Coast. The Collier MPO's boundaries are coterminous with Collier County. Collier County is the largest County in Florida with a total area of 2,305 square miles and a land area of 2,025 square miles. The cities of Naples, Everglades City and Marco Island are the County's three incorporated areas. Collier County's 2020 population according to the US Census was 375,752. Figure 1 on the following page shows Collier MPO's Metropolitan Planning Area Boundary and incorporated municipalities. A significant portion of Collier County is protected conservation land, as shown in Figure 2 on page 3. The Florida Department of Transportation (FDOT) is a non -voting member of the Board. The composition of the board was agreed to by the MPO members in a membership apportionment plan approved by the Governor in 2013. There are no changes in Board membership in this apportionment plan. Table 2: Current & Proposed MPO Membership ..2 22.2% 2 22.2% 5 Packet Pg. 78 9.D 10/13/2023 EXECUTIVE SUMMARY MPO Budget Report and Recommendation to Eliminate Vacant Position OBJECTIVE: For the Board to receive a report on the MPO's budget related to hiring a new Executive Director and consider the Director's recommendation to eliminate a long-standing vacant position. CONSIDERATIONS: The MPO's current fixed operating costs and federal Planning (PL) fund revenues are shown in the attached MPO budget tables. (Attachment 1) Federal Surface Transportation Block Grant - Urban (SU) fund revenues can be used to supplement PL to cover the cost of planning studies prioritized by the Board, but not the essential operating costs listed in Table 1. In round numbers, the MPO currently receives $812,000 in PL funds; personnel costs total $473,000; and other fixed operating costs total $69,000, which leaves $270,000 available for consultant services. The recent cost of consultant services to develop the MPO's current plans and studies are shown in Table 2. Covering the costs using PL funds would require setting aside between $350,000 - $500,000 on an annual basis. The MPO began covering the shortfall by using SU funds, primarily to develop the Long Range Transportation Plan and the Congestion Management Program updates every five years. Tables 4 and 5 project how the increase in personnel costs associated with bringing in a new Executive Director at an annual salary of $120,000 and at $150,000 and other operating expenses of $70,000 would decrease the amount of PL available for consultant services to $256,000 and $219,000 respectively. This would shift between $14,000 - $51,000 in additional costs to SU for plans and studies. This is not an insurmountable amount, but demonstrates the MPO's budgetary constraints, particularly if the Board does not wish to increase the amount each entity contributes to local funds, currently set at $1,000 per voting membership on the Board. Due to budget constraints, the current MPO Director has chosen to keep a planner position vacant over the past eight years. (Attachment 2) Consultant services, personnel costs and other operating costs continue to increase. However, the MPO's allocation of PL and SU funds have not kept up with the pace of increase. The past eight years have demonstrated that the MPO's workload can be accomplished without filling the vacant position. Section 2.01 on page 2 of the MPO's Staff Services Agreement with Collier County stipulates that "Changes to the number of MPO staff positions shall be subject to the approval of the MPO Board." WITNESSETH: WHEREAS, the MPO, pursuant to the power conferred upon it by Section 339.175, Florida Statutes, and Article 5 of the Amended And Restated Interlocal Agreement for Creation of the Collier Metropolitan Planning Organization (the "Interlocal Agreement") between the Florida Department of Transportation ("FDOT"); Collier County (the "County"); the City of Marco Island; the City of Naples; and Everglades City, dated February 26, 2015, which was subsequently Amended and Restated effective May 28, 2019, the MPO may employ personnel and/or enter into agreements, with local and/or State agencies to utilize the staff resources of such agencies or for the performance of certain services by such agencies as necessary to fulfill its responsibilities and obligations as required by law; and WHEREAS, pursuant to the aforesaid Interlocal Agreement executed between the County, the City of Marco Island, the City of Naples, Everglades City and the FDOT, it is contemplated that County personnel will perform the substantial portion of each task provided for in 23 Code of Federal Regulations (CFR) Part 450 and Chapter 339.175 Florida Statutes as necessary to carry out the continuing, cooperative and comprehensive transportation planning process mandated by federal regulations as a condition precedent to the receipt of federal capital or operating assistance in the urbanized area; and WHEREAS, Section 339.175, Florida Statutes provides, in part, that a Metropolitan Planning Organizations' Executive Director reports directly to his or her Governing Board, and that the Executive Director and staff are employed by the Metropolitan Planning Organization or through a staff services agreement between the Metropolitan Planning Organization and another governmental entity; and WHEREAS, it is deemed by the parties to be appropriate and necessary that the duties and obligation of the County, in relation to its role providing staff and services to the MPO, be defined and fixed by formal agreement. NOW, THEREFORE, in consideration of the mutual covenants, premises, and representations herein, the parties agree as follows: 1.00 Purpose For the reasons recited in the preamble, which are hereby adopted as part hereof, this Agreement is to provide for professional services to carry out the terms of the Interlocal Agreement and any other agreement to which the MPO is a party, and to provide staff services and support for the Packet Pg. 85 9.D.3 administration of the MPO. 2.00 Scope of Services It is agreed by the County that it shall furnish the MPO with the staff necessary for professional, technical, administrative, and clerical services, equipment, office and other space, and other incidental items as may be required and necessary to manage the business and affairs of the MPO and to carry on the transportation planning and programming process specified by the lnterlocal Agreement and any other agreement to which the MPO is a party; provided, it is understood and agreed that, unless otherwise provided for, the performance of such service and functions shall be limited to those specified and allocated to the County in the annual Unified Planning Work Program (UPWP) budget and all approved budgets and management reports under federal or State grant contracts with the MPO. The County's annual charge for furnishing office space to the MPO, including all common area maintenance and utility costs, shall be $15,249; as more specifically provided in a separate lease agreement executed by the parties. To minimize disruption, the County shall furnish the MPO with the aforementioned office and other space so as to be continuously co -located with the Collier County Growth Management Department and shall make reasonable efforts to avoid frequent relocation of said office and other space. The MPO is responsible for the selection of, and execution of an employment agreement with, the Executive Director of the MPO. Each year, the MPO shall review and evaluate the performance of the MPO Executive Director in accordance with the performance -based merit plan as provided in the Collier Metropolitan Planning Organization/Executive Director Employment Agreement. The MPO authorizes the MPO Executive Director to secure FDOT approval for amendment of UPWP tasks, which change their dollar value by an amount less than or equal to $25,000, and which do not change their scope or the total approved funds for the UPWP. Any amendment of the UPWP greater than $25,000 shall require the approval of the MPO. The UPWP shall be prepared by the MPO Staff in cooperation with all related State and federal agencies and MPO committees in accordance with the rules and regulations governing the MPO and shall be subject to the approval of the MPO before submittal to State or federal agencies. 2.01 MPO Executive Director The MPO Executive Director shall be responsible to the MPO for the conduct of the transportation planning process as detailed in the UPWP as well as the appointment, assignment, direction, and control of all personnel necessary thereto; the development of an appropriate organizational structure to carry out the responsibilities set forth in the Agreement; and the development of procedures to monitor and coordinate the planning process, as well as the overall administration of MPO programs. Changes to the number of MPO staff positions shall be subject to the approval of the MPO Board. Packet Pg. 86 9.D.3 2.05 Financial Administration a. The financial records and accounts of the MPO including revenue receipts and expenditures shall be administered by the County in accordance with its ordinary procedures. b. Contracts and bids for the purchase of MPO materials and services shall be in accordance with County procedures for the same purposes and the MPO adopts by reference the County's Purchasing Ordinance, Policy and any administrative regulations governing procurement matters. The MPO shall review and approve all Requests for Proposals (RFP), Requests for Professional Services (RPS), and subsequent contracts. Contracts and bids for the purchase of materials and services using PL, FTA and TD funds allocated to the MPO and identified in the UPWP will be in accordance with County procedures, but any actions taken within the authority of the MPO relating to such matters shall be independent of Board of County Commissioners (BCC) approval. C. Through the adoption of this Agreement, the MPO adopts the United States Department of Transportation's goals regarding the procurement of services from firms registered as Disadvantaged Business Enterprises (DBE). In addition, the MPO adopted a DBE Policy in accordance with FDOT's DBE Plan. 2.06 Information Technology and Office Equipment a. The MPO may need to purchase, maintain and upgrade office equipment, office / computer hardware, software, and other resources. This may include, but is not limited to, the purchase of office equipment such as printers, facsimile machine, copier, computers and hardware upgrades, reference documents, software and supporting maintenance. Grant funds allocated to the MPO and identified in the UPWP for such requirements will be used. All resources purchased by the MPO shall be the property of the MPO. Collier County's Information Technology department is responsible for all maintenance of MPO computers and may be paid for services through annual interdepartmental allocations. The Executive Director and MPO staff shall comply with all County rules governing the use of the County's computer network. b. All proposed equipment purchased by the MPO with grant funds must comply with 2 C.F.R. Part 200 and all other applicable rules, regulations and laws (both State and federal), as appropriate. C-Al Packet Pg. 87 9.D.3 2.07 County Staff Assistance a. The MPO may on occasion request additional administrative or public relations assistance due to MPO staff turnover or attrition. Such temporary assistance may be provided upon the MPO Executive Director and the County Manager or his/her designated representative reaching agreement on the appropriate re -allocation of County personnel on a case -by -case basis. b. The MPO may on occasion request GIS assistance to update various MPO maps and GIS data files. Such assistance may be provided upon agreement reached in the same manner set forth in the above subsection (a). c. If the MPO utilizes such temporary assistance from the County, the County will be reimbursed through an interdepartmental transfer at the actual cost of the utilized employee's salary, plus any other actual documented additional cost. County staff time spent supporting MPO activities shall be documented on the MPO timesheet, approved by the MPO Executive Director. 3.00 Reimbursement to the County The MPO hereby agrees that it shall reimburse the County for all services rendered under this Agreement as specified in the UPWP budget and all approved budgets under federal or State grant contracts with the MPO. The determination of eligible costs shall be in accordance with 2 CFR § 200 and all other applicable rules, regulations, and laws (both State and federal), as appropriate. Administration over grants will also follow the policies and procedures set forth in the County's Grant Administration Handbook and CMA 5330, which is compliant with 2 CFR Part 200. 3.01 Local Share The MPO will provide cash or in -kind services for the required match for federal funds from the Federal Highway Administration (FHWA), the Federal Transit Association (FTA), FDOT and the Florida Commission for Transportation Disadvantaged (CTD), where appropriate. These funds may also be derived from financial contributions made by the MPO's member local governments, including Collier County and the Cities of Naples, Marco Island and Everglades City. 3.02 Invoices and Progress Reports The MPO shall provide to the FDOT or appropriate federal agencies quarterly progress reports and invoices for reimbursement for all federal grants with FHWA, FTA and State grants received through the CTD. The progress reports and invoices shall be in sufficient detail for audit purposes. Packet Pg. 88 9.D.3 3.03 Payment Payment to the County of all monies by the MPO is contingent upon the MPO first receiving the funds for the work tasks from the FDOT, FHWA, FTA or CTD. Requests for County services may not be made unless sufficient funding is available to reimburse the County for related expenditures. 3.04 Travel Expenses Reimbursement from federal and State funds for per diem and mileage expenses incurred by MPO staff and Board members for MPO business shall be consistent with the federal government rates. 4.00 Information and Reports The County will provide all required information and reports and will permit access to its books, records, accounts, and other sources of information, and its facilities as may be determined by FDOT, FHWA, or FTA to be pertinent to ascertain compliance with such regulations, orders, and instructions. Where any information required of the County is in the exclusive possession of another who fails or refuses to furnish this information, the County shall certify to FDOT, FHWA, or FTA as appropriate, and shall set forth what efforts it has made to obtain the information. 5.00 Continuity of Operations Plan (COOP) The MPO shall adhere to Collier MPO's Continuity of Operations Plan (COOP). The COOP is consistent with Collier County's Comprehensive Emergency Management Plan (CEMP). Collier County shall provide the MPO with an alternate facility for a reasonable period if one is required. 6.00 Amendment of Agreement The County and the MPO may, upon initiation of either party, amend this Agreement to cure any ambiguity, defect, omission or to grant any additional powers, or to confer additional duties which are consistent with the intent and purpose of this Agreement. This Agreement shall become effective upon approval by the MPO and the County and remain in effect for a period of three years. At that time, the MPO shall review this Agreement to determine if any changes are warranted. CONSIDERATIONS: During the June 9, 2023 MPO meeting, the Commissioners and Council Members provided direction to staff on actions to be taken in order to recruit candidates for the position of Executive Director. The position was posted from August 3, 2023 through September 5, 2023, with a total of eight (8) interested individuals submitting applications and supplemental materials to the County. Each Commissioner and Council Member received applicant documents from Human Resources by PDF document electronically on September 19, 2023. Commissioners and Council Members completed their evaluation of the candidate submissions and provided a ranked or selected list by October 4, 2023, to be discussed at the October 13, 2023 MPO meeting. Based on the MPO Board's desire to have the next Executive Director selected by January 2024 for a February 2024 start date, the following are suggested next steps and a timeline for the selection process: • The MPO Board selects candidates at the October 13, 2023 meeting to be invited for personal interviews in December 2023. • The MPO Board decides the format and date(s) for candidate interviews. • The Board collectively determines candidate finalists at the December 2023 MPO Board Meeting. • Establish whether finalists for the Executive Director position will give a presentation regarding their candidacy to the MPO Board at the December 2023 or January 2024 meeting. RECOMMENDATION: That the MPO Board review and discuss the progress made for hiring of the next Executive Director and review the proposed selection process and timeline. The MPO is tasked to provide both the urban and rural areas of the County with a Continuing, Cooperative, and Comprehensive (3-C) planning process to ensure that highways, transit, bicycle, pedestrian and other transportation facilities are properly considered within the context of the overall transportation needs of the community. The MPO staff reports directly to the MPO Board and provides information and technical assistance to the MPO's advisory committees. The advisory committees, along with the MPO staff, provide recommendations to the MPO Board regarding short- and long-range planning, multimodal project prioritization and related issues. The MPO Board and each of its advisory committees operate under bylaws approved by the MPO Board. The advisory committees include the Technical Advisory Committee (TAC), Citizens Advisory Committee (CAC), Bicycle and Pedestrian Advisory Committee (BPAC), Local Coordinating Board (LCB) and the Congestion Management Committee (CIVIC). Members of these committees, various interested parties and citizens make up the MPO Master Database of Contacts. The committees review plans, documents and programs and provide comments and recommendations during the development of plans and major studies. Documents presented to the MPO Board for approval, endorsement or ratification have typically been reviewed by the TAC and CAC, and other committees as appropriate. As reported in the 2045 Long Range Transportation Plan (LRTP), Collier County is the largest county in Florida by land area. Approximately 67 percent of the County's land area has a land use designation of Conservation, is owned primarily by the federal and state government, and is restricted from development. Collier County had a population of 375,752 according to the 2020 Decennial Census. Florida led the state with inmigration during and after the COVID 19 pandemic. The U.S. Census Bureau's 2021 American Community Survey (ACS) 5-Year Estimates (2017-2021) place the Median Household Income in Collier County at $74,215 compared to $67,521 nationally; and Median age at 52.7 years compared to 38.2 in the United States. 11% of the population for whom poverty status is determined in Collier County (41.2k out of 376k people) live below the poverty line, a number that is lower than the national average of 12.8%. All of Collier County - including the cities of Naples, Marco Island, and Everglades City — experiences a large, seasonal increase in population and traffic between October and April, with the highest traffic volumes occurring in the months of February and March. Collier County has a large land area preserved undervarious conservation mechanisms in addition to State and Federal conservation lands, shown in green on the map on page 6. Urban form characteristics that affect transportation planning, such as regional transit and cycling connections, special places and gateways on major arterials are identified in the map on page 7. The conservation lands provide recreational opportunities and help sustain the natural environment. They also form an effective urban growth boundary, creating an edge condition for Collier County that is reflected in the sparse system of Federal Aid eligible roadways shown on the map on page 8. The Unified Planning Work Program (UPWP) establishes the 2-year operating budget for the MPO. Federal Planning (PL) funds are the primary source of revenue for the MPO's UPWP. PL funds are encumbered through an MPO Agreement between the Collier MPO and FDOT which runs concurrently with the UPWP's 2-year funding cycle. Year one funds can be spent in the second year as long as the budgeted task is identified in the second year of the UPWP. The MPO budget is reported by State Fiscal Year (SFY) which runs from July 1st through June 30t", so the reporting period differs from the Federal Fiscal Year. UPWP FY2023 ended June 30, 2023. We are currently in UPWP FY 2024. The MPO also received FTA 5305 Metropolitian Planning funds in the past that were allocated through a separate Public Transit Grant Agreement (PTGA) by the FDOT Public Transit Office on a different cycle. FDOT changed to a Consolidated Planning Grant process effective SFY 2023 which brings 5305 funds into play concurrently with PL funds to simplify the UPWP development and reporting process. In addition to the Federal funds, the MPO receives $8,000 in annual Local Funds contributed by member governments. These funds are not included in the UPWP and are used sparingly to cover expenses allowable under State law but ineligible for reimbursement under the Federal grants the MPO receives. The County's accounting system tracks the use of these funds. The following pie charts reflect typical fluctuations in the MPO's PL operating budget between FY 2023 and 2024. The variation is due to roll-over amounts from prior years. The MPO also uses a portion of its annual Surface Transportation Block Grant — Urban (SU) funds to fund consultant services to produce updates to the Long Range Transportation Plan (LRTP) and other major plans. The FY23/24 UPWP includes $550,000 in SU funds for the LRTP and $150,000 for the Transportation System Performance Report. Coordination has begun on assessing the impact of the reduction in statewide revenues forecasted for the two counties and the implications for regional road construction and congestion mitigation. CR951 between US 41 and 1-75 has no bridges to report and the pavement is in excellent condition. FDOT is responsible for bridge replacement and resurfacing projects on the NHS, and it is incumbent on Collier MPO to support FDOT's program commitments. FDOT reported that its 2021 statewide conditions met the targets: • 61.3% of NHS bridges (be deck area) in good condition, 0.5% in poor condition. • 70.5% Interstate pavement in good condition and 0.7 % in poor condition; and • 47.5% of non-Interestate NHS pavement in good condition; 1.1 % in poor condition. FDOT's FY 2024-2028 work Program includes $158.4 million for resurfacing and operations and $14.5 million for bridge replacement within Collier County. Ms. Dusty Siegler, who joined the MPO staff as Administrative Assistant in August, 2022, hit the ground running with her extensive background in the legal profession and was promoted to Senior Planner in April 2023. Mr. Sean Kingston, AICP and Certified Floodplain Manager, was hired as Principal Planner in October 2022 and quickly added Project Management Professional certification to his already impressive list of credentials. Suzanne Miceli joined the staff as the new Administrative Assistant in June 2023, with a wealth of experience in communications and website design. We have been conscientiously writing Standard Operating Procedures and training guides to preserve institutional knowledge for the incoming Executive Director anticipated to start work in the latter part of February so there is some overlap with the current Executive Director before my contract ends on March 9, 2024. As always, 2023 has been a busy year in terms of work completed and projects underway. Federal and State revenue projections are down for the 2050 Long Range Transportation Plan while construction cost estimates continue to rise. The cost of doing business as an MPO is increasing at a faster rate than increases in federal Planning (PL) funding, and the SU allocation for Collier MPO is down slightly. The charts below illustrate how potential increases in personnel costs leave fewer PL funds available for consultant services to develop plans and studies. Interstate 75 (1-75) from Golden Gate Parkway to Corkscrew Road: This project will provide capacity improvements to over 18 miles of 1-75 from Golden Gate Parkway to Corkscrew Road. The project will add one additional general -use lane in the northbound and southbound directions (six- to eight- lane widening) and auxiliary lanes as needed. Construction starts in Fall 2027. State Road (S.R.) 29 from County Road (C.R.) 846 East to New Market Road: This project will construct a new alignment of S.R. 29 as a four -lane divided roadway to serve as a loop around the downtown Immokalee area. The design will have four 12-foot travel lanes with curb and gutter on both sides, a 22-foot median, and 12-foot shared -use paths on both sides for the first mile. For the remainder of the project the design will have a 30-foot median and outside paved shoulders and 12-foot shared -use paths on both sides. The project also includes drainage improvements along the entire length of the corridor. Construction starts in Spring 2027. State Road (S.R.) 29 from New Market Road to S.R. 82: This project consists of widening an approximately 3-mile-long segment of S.R. 29. Perdue, P.E., FDOT leadership, and members of Florida's Legislature unveiled construction timelines for projects included in Governor DeSantis' Moving Florida Forward Infrastructure Initiative. These projects, which are slated to begin construction within the next four years, will bring much -needed congestion relief for Florida's motorists on major roadways across the state. Florida has experienced unprecedented population growth, with some areas of the state experiencing more than 20 percent growth rates. To address this influx of new Floridians, Governor DeSantis charged FDOT to address the most critical points of our infrastructure to relieve congestion in these communities and ensure a robust supply chain.
