Florida Legal Exhaust Noise Summary
Florida legal exhaust noise summary:
Florida prohibits vehicles from
producing any excessive or unusual
noise. Laws require vehicles exhaust
systems to be equipped with muffler,
manifold pipe, and tail piping at all
times while in operation.
Motor vehicles manufactured after
January 1, 1979 may produce up to 72
db when speed limit is under 35 mph,
or 79 db where speed limit is over 35
mph.

solutions, lobby legislation for revisions to FL Statute

"any sound produced... that can be clearly
heard by a person using his or her normal
hearing faculties, at a distance of fifty (50)
feet or more from the source."

In a Referee Station for dB Reading
If you recently received a citation for modified/loud exhaust, you
may be directed by law enforcement to see a Referee.
The Referee can inspect your vehicle and issue a certificate if it passes.
The fee for a Referee noise inspection certificate is $108. Receiving a
certificate may not necessarily remedy the violation and the court could
still issue a fine in addition to the Referee fee.
In Florida, it is a law that all vehicles must have an adequate muffler to
prevent excessive noise and makes it illegal to have a vehicle that has an
exhaust noise louder than set standards for the state.
The referee will conduct a noise level test on the exhaust and if it does
meet the standard then you will receive a "Certificate of Compliance" that
you must take to the court. However, if your vehicle doesn't meet the
standard then you must have the car repaired to meet the standard and go
to court to pay fine. A
Are Jake Brakes Illegal.?
Specifically, in the United States, Canada, and Australia, communities have
taken to posting signs in areas where residents are not pleased with the
Annoyingly loud exhaust noise associated with Jake braking.

"Why in the world would a trucker use a Jake Brake on
level ground.? They were designed for Mountainous
Terrain, ie Pennsylvania, West Virginia, or areas of the
North West. Only one reason to use a Jake Brake in
Floridad Going over the Speed Limit. Why am I not
surprised. They get paid by the number of loads

NY, NJ, Tennessee,
California and Miami
Beach and many other

We need legislation to
revise the 316.293
Modified Muffler Statute
to allow Law Enforcment
to use noise cameras to
ticket.
In the U.S., the EPA says
that between 90 and 94
decibels are the legal limit
for noise. But in 2026 the
legal threshold goes down
to 68 dB.

When I bought a Condo here on 2002, Immakolee was a 2 lane road,
East of Collier, Collier was also 2 lanes from Golden Gate to
Immakolee! Now they are split lane, with 3 lanes both ways. I live on
Orangetree and when I go to work at 6:OOam, sit at our light to get on
Immakolee and watch 3 lanes if cars going by like it's the Daytona
500! The people running the show haven't got a clue how to expand
properly. Wonder how much kick back they are getting from deep
pocket developers! Starting to see people moving away. We are
planning on going back North in the next 2-3 years!
Omg when I moved here in 2015 it was so quiet and serene at Forest
Glen. I loved sitting outside .... Now it sounds like a race track.
Something needs done. This is an infringement on our rights Why
don't they just give them tickets or jail time?

STOP THE NOISE
Quiet Florida is a non-profit, community
organization working to preserve peace and quiet
in our neighborhoods.
More than a nuisance, modified mufflers are
illegal under Florida Statues 316.272 and 316.293.
(316.272) No person shall modify the exhaust system
of a motor vehicle or any other noise -abatement
device of a motor vehicle operated or to be operated
upon the highways of this state in such a manner that
the noise emitted by the motor vehicle is above that
emitted by the vehicle as originally manufactured.
(316.293) No person shall operate or be permitted to
operate a vehicle at any time or under any condition
of roadway grade, load, acceleration, or
deceleration in such a manner as to generate a sound
level in excess of the following (see full statute) limit
for the category of motor vehicle and applicable
speed limit at a distance of 50 feet from the center
of the lane of travel under measurement procedures
established under subsection (3).

For the first offense: $313
Subsequent offenses: $613
The Modified Muffler dilemma is an air and noise
pollution issue, negatively impacting the health
and quality of life of residents.
