09/26/2023 EXECUTIVE SUMMARY Recommendation to award Invitation to Bid (“ITB”) No. 23-8140, “Plumbing Contractors” to BC Plumbing & Drain, Inc., as Primary Vendor, and Ackerman Plumbing, Inc., as Secondary Vendor, and authorize the Chairman to sign the attached agreements. _____________________________________________________________________________________ OBJECTIVE: To obtain a plumbing contractor to provide as-needed services to maintain the integrity and continuous operation of the plumbing systems in various County owned and leased buildings and facilities. CONSIDERATIONS: Collier County Facilities Management Division is responsible for maintaining the plumbing systems in various County owned and leased buildings and facilities. To supplement the Facilities Ma nagement’s in-house plumbing team in maintaining the integrity and continuous operation of the plumbing systems, staff is recommending awarding contracts providing for as-needed maintenance, routine, and urgent plumbing repair services. On May 23, 2023, the Procurement Services Division released notices of ITB No. 23 -8140, Plumbing Contractors. Staff performed additional vendor outreach to promote competition and two bids were received by the June 23, 2023, deadline. Ackerman Plumbing, Inc. has been serving the Southwest Florida area since 2004. Staff Recommends awarding to BC Plumbing & Drain, Inc., as the Primary Vendor, and to Ackerman Plumbing, Inc., as the Secondary Vendor. FISCAL IMPACT: Historical spend for these services is estimated at $150,000.00 annually since 2018. Budget for this contract is provided in the General Fund Facilities Management Cost Center (0001-122240). Other County Manager Divisions utilizing this contract will provide funding from their respective budgets. GROWTH MANAGEMENT IMPACT: There is no Growth Management impact associated with this Executive Summary. The Contractor, at a minimum, must achieve the requirements of the Specifications. The results of this solicitation may be used by other County departments once awarded according to the Board of County Commissioners Procurement Ordinance. These specifications are intended to provide the information by which Contractors may understand the requirements of Collier County relative to providing labor, material and equipment to perform plumbing services as needed. Historically, Collier County departments have spent approximately $145,000.00 per year; however, this may not be indicative of future buying patterns. BACKGROUND Collier County is responsible for maintaining more than 930 buildings and structures throughout the County. It is the intent of this solicitation to obtain a source of plumbing contractors to provide prompt and reliable plumbing services on an as needed basis. The successful bidder(s) will provide labor, equipment, and parts for normal and urgent plumbing services, within but not limited to, all Collier County owned and leased properties, including the County Jails. It is also the intention of this solicitation to obtain plumbing services for repairs associated with Collier County’s Public Utilities Services. TERM OF CONTRACT The contract term, if an award(s) is/are made is intended to be for three (3) years with two (2) one (1) year renewal options. Prices shall remain firm for the initial term of this contract. Surcharges will not be accepted in conjunction with this contract, and such charges should be incorporated into the pricing structure. The County Manager, or designee, may, at his discretion, extend the Agreement under all of the terms and conditions contained in this Agreement for up to one hundred eighty (180) days. The County Manager, or designee, shall give the Contractor written notice of the County's intention to extend the Agreement term not less than ten (10) days prior to the end of the Agreement term then in effect. All goods are FOB destination and must be suitably packed and prepared to secure the lowest transportation rates and to comply with all carrier regulations. Risk of loss of any goods sold hereunder shall transfer to the COUNTY at the time and place of delivery; provided that risk of loss prior to actual receipt of the goods by the COUNTY nonetheless remain with VENDOR. 16.F.7.a Packet Pg. 2007 Attachment: 23-8140 Solicitation (26434 : Award ITB 23-8140, "Plumbing Contractors") AWARD CRITERIA ITB award criteria are as follows: The County’s Procurement Services Division reserves the right to clarify a vendor’s submittal prior to the award of the solicitation. It is the intent of Collier County to award to the lowest, responsive and responsible vendor(s) that represents the best value to the County. For the purposes of determining the winning bidder, the County will select the vendor with the lowest price as outlined below: • Lowest Total Bid Collier County reserves the right to select one, or more than one suppliers, award on a line item basis, establish a pool for quoting, or other options that represents the best value to the County; however, it is the intent to: • Award Primary, Secondary and Tertiary The County reserves the right to issue a formal Agreement or standard County Purchase Order or utilize the County Purchasing Card for the award of this solicitation . DETAILED SCOPE OF WORK The Division is seeking the services of Plumbing Contractors, licensed to operate in the State of Florida within Collier County and in possession of all current Professional Licenses necessary to perform the services required. All licenses must be valid and current throughout the life of the agreement (copies to be provided upon bid submission or prior to the Notice of Recommended Award). Normal and urgent services will be required Countywide and include but not be limited to the following types of work: • Hot water heaters, toilets, faucets, and other plumbing fixtures – installation, repair and replace • Water lines– installation, repair and replace • Leaks – detection and repair • Water pressure issues-identify and repair 1. WORK HOURS: Normal business hours are Monday through Friday between 7:00 AM and 5:00 PM, excluding County observed Holidays. After-hours are considered before 7:00 AM and after 5:00 PM on weekdays and at any time on Saturday, Sunday, or County Observed Holidays. After-hours rate will be calculated at 1.5x the hourly rate provided in the bid schedule. If a requested service starts during normal business hours, and extends into the after-hours period, the after-hours rate shall only be charged for time worked during the after-hours period. The awarded Contractor(s) will provide the Division Representative or designee telephone number(s) for normal, after-hours, and urgent services, for twenty-four (24) hours a day, seven (7) days per week, 365 days per year. 2. REQUEST FOR SERVICE: A. Normal services: • The Contractor shall have one (1) business day to respond to a request for normal service and notify the County that they are willing and able to commence and complete the work. If requested, the Contractor shall provide a written quote to the Division Representative or designee via email within two (2) business days from the Division Representative or designee’s request. • The Division Representative or designee would expect the as needed service to commence within one (1) business day of the purchase order being issued, unless otherwise directed by the Division Representative or designee. • No work shall begin until the Contractor is in receipt of an approved purchase order. B. Urgent services: • The Contractor shall acknowledge an urgent services request via e-mail or phone call within one (1) hour of the request being sent by the Division Representative or designee. • An urgent services request requires that the Contractor be on-site within two (2) hours after the County’s initial request and within three (3) hours for the Immokalee and Everglades City areas. The Division Representative or designee must approve a response time that exceeds two (2) hours and three (3) hours for the Immokalee and Everglades City areas, respectively. • A one-time $250 Urgent Service Call Fee is allowed when responding in addition to the applicable hourly rates. Should the Primary Contractor fail to respond within the required response times for requests for both Normal and Urgent services or be unable to perform the work within the requested time, the Division Representative or designee reserves its rights to move to the 16.F.7.a Packet Pg. 2008 Attachment: 23-8140 Solicitation (26434 : Award ITB 23-8140, "Plumbing Contractors") secondary and tertiary, as necessary. A Purchase Order shall survive contract expiration to allow completion of work that has commenced prior to the contract expiration date. The Division reserves the right to solicit services outside of the awarded contract, if determined to be in the best interest of the County. The County reserves the right to supply all necessary parts for selected projects and repairs. 3. CONTRACTOR EMPLOYEE REQUIREMENTS: The Contractor shall employ people to work at all Collier County facilities who are qualified, competent and physically capable of doing the work. Each employee shall be neat in appearance. The Division Representative or designee shall require the Contractor to remove from the work place all employees deemed careless, incompetent, insubordinate, or otherwise objectionable, or whose continued employment on the job is deemed to be contrary to the best interests of Collier County. Work that is requested of the Contractor in the County Jails will require thorough background checks of personnel and a search of tools/materials taken into the jails. Employees must pass and comply with all screening procedures to enter secured government buildings, which include background checks of service personnel at the time of contract and possible rechecks upon entry to the jail. A deputy shall escort service personnel while inside the jail. All employees must always wear identification badges while performing services at County facilities. 4. SUBCONTRACTORS: The use of subcontractors is allowed under the resulting contracts. The subcontractor must comply with all Collier County provisions. Subcontractor charges may be invoiced at cost plus 15% markup and hourly rates shall not exceed the Contractor’s. A copy of the subcontractor’s invoice shall be required with the Contractor’s invoice. Detailed sub-Contractor invoices may be requested to be accompanied with the Contractor’s invoice to the County. 5. REPLACEMENT/REPAIR PARTS: All replacement/ repair parts must be approved and be of genuine and original manufacturer's parts. The Contractor will be required to provide proof of the Original Manufacturer’s parts through providing invoices or photographs at the time of invoice submission. The Contractor shall be required to expressly warrant that all replacements are new and free from defects, warranted for their merchantability and meet the performance specifications of the original equipment. In the event a portion, or the complete order, is found to be defective when delivered and/or installed, the Contractor shall immediately replace the equipment at no cost to Collier County. Refurbished / remanufactured equipment is only permissible for use at the direction of the Division Representative or designee. All refurbished / remanufactured equipment is required to be expressly warranted by the contractor to be free from defects and meet the performance specifications of the original equipment. Markup on actual cost of parts, materials, and rental equipment shall not exceed 15%. 6. WORK QUALITY: The Contractor will be expected to examine surfaces scheduled to receive the work under this resultant Agreement and locate conditions which will adversely affect the performance and quality of the work. Surfaces can include but are not limited to countertops, walls, ceilings, floors, cabinets, concrete, etc. The Contractor shall advise the Division Representative or designee of all such conditions and secure further directions as required. The Contractor must fully clean up the job site and leave the site with all trash, parts, and material removed once the job is complete. Emergency repairs, such as broken pipes, floods, or serious leaks are to be reported to the Division Representative or designee immediately. In the event of unsatisfactory performance, the Division Representative or designee will call the Contractor, and the Contractor shall return the call within one (1) hour of the initial call to arrange for the Contractor to correct any deficiencies within two (2) business days from notification, at the Contractor’s expense. 16.F.7.a Packet Pg. 2009 Attachment: 23-8140 Solicitation (26434 : Award ITB 23-8140, "Plumbing Contractors") 7. INSPECTIONS: The Division Representative or designee and the Contractor may conduct an inspection of completed services provided to Collier County. Any deficiencies noted during an inspection shall be corrected before final acceptance. Such deficiencies will be corrected within two (2) business days after receipt of notification, at the Contractor's expense. 8. WARRANTY: The materials and workmanship provided under the resultant Agreement shall be guaranteed to be new and free of defects. Warranty will be for a period of one (1) year commencing upon the date of final completion of each project. 9. EQUIPMENT INVENTORY: The Contractor shall, under no circumstances, remove any equipment containing a County asset sticker. The Contractor shall request that, when replacing equipment, the asset sticker be removed by an appropriate County staff member authorized to adjust the equipment inventory records. 10. ADDITIONS AND DELETIONS OF EQUIPMENT/SERVICES: The County retains the right to add or the delete any facilities, equipment, or services provided under the resultant contract as described herein, upon notification by the Division Representative or designee to the Contractor. 11. INVOICES: Invoices shall contain details of services performed, number of hours worked by skilled trade level, helper/apprentice and laborers, along with materials furnished for the job. Invoices shall include any applicable markups. No markup shall be permitted on ancillary charges, taxes, and freight/shipping. The Contractor(s) shall provide copies of receipts for materials costing $500.00 or more, subcontractor invoice, and/or equipment rental receipt with the invoice Contractor(s) may only charge hourly rates for hours worked at the job site. Hourly rates shall be per the awarded bid schedule for labor and specialty equipment listed. The labor rates provided by the Contractor are to be fully burdened to include overhead, insurance, profit, travel related expenses, and use of company owned small tools and equipment (excluding rental equipment). The County’s purchase order number must appear on each invoice. 12. SECURITY, BACKGROUND AND IDENTIFICATION: The Contractor is required to comply with County Ordinance 2004-52, as amended. Background checks are valid for five (5) years and the Contractor shall be responsible for all associated costs. If required, Contractor shall be responsible for the costs of providing background checks by the Collier County Facilities Management Division for all employees that shall provide services to the County under this Agreement. This may include, but not be limited to, checking federal, state and local law enforcement records, including a state and FBI fingerprint check, credit reports, education, residence and employment verifications and other related records. Contractor shall be required to maintain records on each employee and make them available to the County for at least four (4) years. All of Contractor’s employees and subcontractors must wear Collier County Government Identification badges at all times while performing services on County facilities and properties. Contractor ID badges are valid for one (1) year from the date of issuance and can be renewed each year at no cost to the Contractor during the time period in which their background check is valid. All technicians shall have on their shirts the name of the contractor’s business. The Contractor shall immediately notify the Collier County Facilities Management Division via e-mail (DL- FMOPS@colliercountyfl.gov) whenever an employee assigned to Collier County separates from their employment. This notification is critical to ensure the continued security of Collier County facilities and systems. Failure to notify within four (4) hours of separation may result in a deduction of $500 per incident. The Collier County Sheriff’s Office (CCSO) requires separate fingerprinting prior to work being performed in any of their locations. This will be coordinated upon award of the contract.
