Agenda 09/26/2023 Item #16C 2 ((Purchase of specialized equipment needed to repair, and maintain operations at water and wastewater plants, pump stations and wastewater collection systems)09/26/2023 EXECUTIVE SUMMARY Recommendation to approve and authorize expenditures under sole and single-source waivers for the purchase of specialized proprietary equipment and services needed to establish, repair, and maintain operations at water and wastewater plants, pump stations, and wastewater collection system to meet demand and maintain compliance. (Not to exceed $5,525,000 annual spending for 1 year from CCWSD Funds (4008, 4012, 4014)) (This item is a companion item 16C1) _____________________________________________________________________________________ OBJECTIVE: To continue consistency with the reliable products, equipment, and services that are standardized and utilized at the critical infrastructure, water plants, wastewater plants, and wastewater collection system for staff to provide continuous operation and maintenance of those critical facilities. CONSIDERATIONS: The Collier County Water Sewer District (“CCWSD”) continues to evaluate products and equipment that are both east vulnerable to cyber-attacks and supply chain interruptions of global market as much as possible, to serve and provide life sustaining services to our customers 24/7/365, in compliance with the applicable Laws. On July 10, 2018, (Agenda Item 16.C.9), the Board authorized two single-source waivers and 26 sole-source waivers for the purchase of equipment, including service parts, kits, interface components, software, service, and support for existing and replacement applications for a period of five years. On December 10, 2019, (Agenda Item 16.C.4), the Board authorized eight additional sole-source waivers. Staff completed a Waiver of Competition Request form and the Procurement Director approved for a period of July 10, 2018, through September 30, 2023, for the following: Manufacturer Sole Source Authorized Vendor Data Flow Systems Data Flow Systems (Data Flow Systems the Board Approved Collier County Water-Sewer District Utility Standards Manual under Ordinance 2018-36 BCC meeting July 10, 2018, items 17.D and 17.E). John Mader Enterprises, Inc. d/b/a Mader Electric Motors Teledyne ISCO Instrument Specialties Inc. Emerson Electric Company / Rosemount, Inc. Fluid Controls Specialties With continued expansion of the County and the need for maintenance support, repair and replacement, operational, and capital improvements projects, PUD recommends allowing future purchases under a sole source waiver for Data Flow Systems, and under single-source waivers for Komline-Sanderson Corporation systems, Lazenby & Associates, Inc., Florida Service Painting, John Mader Enterprises, Inc., Instrument Specialties, Inc., and Fluid Controls Specialties. Staff's due diligence and performance based testing further enhances the benef its of standardization including best value efficient operations, fewer spare parts, less spare part storage, thus reducing the need for additional warehouse space, less spare part obsolescence, reduced training, and more efficient integration with the utility. The highly specialized proprietary equipment and services those companies provide, are required as needed, to construct, repair, and maintain water and wastewater treatment facilities to ensure compliance and meet customer demand. This equipment requires regular maintenance to sustain 24/7 operations, meet customer demand, and stay in compliance with all regulatory agency requirements. 16.C.2 Packet Pg. 1214 09/26/2023 The specific items sought by this request are required because they: • Are proprietary in nature and cannot be directly replaced with an alternate product. • Must be purchased by an authorized seller. • Require the Board’s approval to purchase them as either a sole or single -source waiver from the competitive process. • Are processes and structures tailored to a product’s physical configuration, treatment capacity, and efficiency, which prevents alternate products from being installed without significant rework. Attachment 1 contains the Waiver Request forms with the Sole and Single Source letters from the manufacturers/distributors for the specific products and services, which includes the purpose, explanation, market research, and manufacturing. Note, there are two separate Fluid Control Specialties waiver requests - one which covers Emerson, Rosemount, Rosemount Analytical, AMS TREX, and Micromotions products as presented herein; and the second companion waiver request (Accela #26320) which covers the previous standardization approval from July 10, 2018 for Rotork valve actuators, replacement parts, and repair services. Separate contract file tracking mechanisms will be established with Procurement in SAP to delineate the $100,000 for Emerson, Rosemount, Rosemount Analytical, AMS TREX, and Micromotions products and the $100,000 for Rotork parts and services. In accordance with Section Eleven, subparagraph 10 (Sole Source) and subparagraph 11 (Single Source) of the Collier County Procurement Ordinance, as amended, staff requests that the Board find that it is in the best interest of the County to waive competition and allow procurement of the requested products and services required to meet PUD’s operational needs. Waiver annual amount not to exceed by manufacturer and authorized vendor is summarized in the fiscal section. Increases to the annual amount not to exceed from previous Board approvals are due to supply chain challenges, raw material & chemical cost increases, new plant expansions coming on-line within the waiver request time frame, and expansion of utility operational maintenance, repair, rehabilitatio n and capital improvement programs. Staff is requesting approval to purchase from the authorized vendors listed above for Fiscal Year 24 from October 1, 2023, through September 30, 2024, as an opportunity to pursue utilization of piggyback contracts, competitively bid, or negotiate contracts to include but not be limited to availability, warranty, pricing schedules, and cost increases. County staff will continue to utilize piggyback contracts as available. FISCAL IMPACT: Funds are available in the Collier County Water-Sewer District Operating Fund (4008), the Water User Fee Fund (4012) and the Wastewater User Fee Fund (4014). As the utility system ages, the quantity of materials purchased will vary depending on the actual repair/replacement needs. Data Flow Systems (DFS) is the sole supplier of the County's implemented SCADA equipment and technical support. Our research concluded that DFS continues to be the market leader in telemetry and control equipment and software with systems that were designed and manufactured specifically for the wastewater utilities. DFS has obsolescence proof SCADA with free SCADA software updates, no annual software license fees, thus no expensive upgraded needed as the systems is scalable. DFS has proven multiple decades of reliable service with technical support members with over 40 years of experience. Since DFS manufactures all the equipment as well as software, there is a single point of contact for total support. This system was selected for the County over twenty years ago because of its reliability and scalability. Data Flow's customer service and technical support have remained excellent throughout the years. The County has invested over $6 million in the product. Staff have been extensively trained on the equipment and software. Changing to a different vendor would require extensive and expensive technician and operator training, and SCADA redesign. Existing equipment may not be compatible with the new SCADA software so expensive and extensive equipment upgrade may be required. Other SCADA software systems require yearly licensing fees as well as upgrade charges. Other SCADA systems do not provide obsolescence proof software and equipment thus adding another expensive cost to the County. (formerly Bristol, Inc.) to upgrade their existing system. Their decision was based on their current investment with Emerson's SCADA products and the results of RFI-01108 SCADA Process Control System advertised on October 23, 2018 and additional market research performed by Miami-Dade's Procurement. The research revealed other companies providing SCADA systems, such as, Survalent, Open Systems International, Advanced Control Systems, Inc., GE Energy, and Schneider Electric, however, it was determined not all SCADA systems are inter-operable and completely changing systems would require significant transition time, and may create risks of properly maintaining the system which could ultimately lead to health risks. When used as coating/liner, can resurface, rebuild, and protect all͈in͈one͈ shot as a sealed system preventing infiltration and exfiltration, and combating the effects of corrosion. Many times corrosion can deteriorate concrete and risk the integrity of the structure. It boasts impressive structural properties due to its blend or resin and reinforcing fibers; 16,000 psi compressive strength with high flexural strength. It can adhere and cure under water (used to repair seawalls underwater). This is a unique quality that is needed and used often in the water and wastewater industry to solve logistical challenges, such as working in “live” environments. Very few systems can withstand high levels of moisture without failing. It performs well in humid environments (especially found in closed environment structures) such as closed tanks, pipes and underground structures.
