Agenda 09/26/2023 Item #16C 1 (Purchase of specialized equipment needed to repair, and maintain operations at water and wastewater plants, pump stations and wastewater collection systems)09/26/2023 EXECUTIVE SUMMARY Recommendation to authorize expenditures under Board approved standardization of goods, and accept single-source waivers, for the purchase of specialized proprietary equipment and services needed to establish, repair, and maintain operations at water and wastewater plants, pump stations, and wastewater collection system to meet demand and maintain compliance. (Not to exceed $6,000,000 annual spending for 1 year from CCWSD Funds (4008, 4012, 4014)) (This item is a companion item 16C2) OBJECTIVE: To continue consistency with the reliable products, equipment, and services that are standardized and utilized at the critical infrastructure, water plants, wastewater plants, and wastewater collection system for staff to provide continuous operations and maintenance of those critical facilities. CONSIDERATIONS: Collier County Water Sewer District (CCWSD) continue to evaluate products and equipment that are both least vulnerable to cyber attacks and supply chain interruptions of global market a s much as possible, to serve and provide life sustaining services to our customers 24/7/365, in compliance with the applicable Laws. For over 30 years, the Public Utilities Department (“PUD”) has been using Allen-Bradley/Rockwell Automation products. On May 28, 2013 (Agenda Item 16.C.2.), the Board waived competition and authorized sole-source purchases of Allen-Bradley/Rockwell Automation products from Rexel for a period of five years. On July 10, 2018, (Agenda Items 17.D and 16.C.9), the Board authorized the standardization of the following two highly specialized proprietary product categories needed to repair and maintain potable water production facilities, wastewater treatment facilities, and distribution/collection systems infrastructure necessary to maintain compliance and meet customer demand: 1) Allen-Bradly/Rockwell Automation electrical control and power equipment; and 2) Endress+Hauser magnetic flowmeters, based on staff’s recommendation to reassess the market within 10-years supported by an independent third-party engineering review. Staff completed a Waiver of Competition Request form, which the Procurement Director approved for a period starting July 10, 2018, through September 30, 2023, for the following: Manufacturer Single Source Authorized Vendor Allen Bradley/Rockwell Rexel USA Endress + Hauser TriNova These products ensure that the Collier County Water and Wastewater Division (the "Division") remain in regulatory and operational compliance with Florida Administrative Code Chapter 62 - 600 (Domestic Wastewater Facilities), Chapter 62-610 (Reuse of Reclaimed Water and Land Application) and Chapter 62-555 (Permitting, Construction, Operation and Maintenance of Public Water Systems), as well as other local, State, and federal rules and regulations. Staff's due diligence and performance based testing further enhances the benefits of standardization including best value efficient operations, fewer spare parts, less spare part storage, thus reducing the need for additional warehouse space, less spare part obsolescence, reduced training, and more efficient integration with the department’s Supervisory Control and Data Acquisition Systems (SCADA) controls. On July 10, 2018 (Agenda Item 17.D and 17.E), the Board also approved including the recommended standardized items in the Utilities Standards Manual for installation at Master Pump Stations, Submaster Pump Stations, and Wastewater/Water Treatment Facilities, and included a County Approved Products List as Appendix F in the Board approved Collier County Water-Sewer District Utility Standards Manual under Ordinance No. 2018-36. The approved listed consisted of specialized proprietary equipment and services from Evoqua Water Technologies, Fluid Controls Specialties, Rexel USA, TriNova, and Xylem. With the continued expansion of the County, and in support of the general need for maintenance, repair, replacement, operational, and capital improvements projects, PUD recommends allowing future purchases under single-source Waivers for the purchase of specialized proprietary equipment and services from Evoqua, Fluid Controls Specialties, Rexel USA, TriNova, and Xylem as needed to construct, repair, and maintain water and wastewater treatment facilities to maintain compliance and meet customer demand. This equipment requires regular maintenance to sustain 24/7 operations, meet customer demand, and stay in compliance with all regulatory agency requirements. These specific items are required because they are proprietary in nature and cannot be directly replaced with an alternate product and require the Board’s approval to purchase them under a single source waiver. Further, processes and structures are tailored to a product’s physical configuration, treatment capacity, and efficiency, which prevents alternate products from being installed without significant rework. Attachment 1 contains the Waiver Request forms with the single-source letters for those products and services, which, as to each, includes the purpose, explanation, market research, and manufacturing relevant to acquiring those specialty items and services. Note, there are two separate Fluid Control Specialties waiver requests - one which covers the previous standardization approval from July 10, 2018 for Rotork valve actuators, replacement parts, and repair services as presented herein; and the second companion waiver request (Accela #26427) which covers Emerson, Rosemount, Rosemount Analytical, AMS TREX, and Micromotions products. Separate contract file tracking mechanisms will be established with Procurement in SAP to delineate the $100,000 for Rotork and the $100,000 for Emerson, Rosemount, Rosemount Analytical, AMS TREX, and Micromotions products. In accordance with Section Eleven, subparagraph 11 of the Collier County Procurement Ordinance, as amended, staff requests that the Board find that it is in the best interest of the County to waive competition and allow procurement of the requested products and services required to meet the PUD’s operational needs. Waiver annual amount not to exceed by manufacturer and authorized vendor is summarized in the fiscal section. Increases to the annual amount not to exceed from previous Board approvals are due to supply chain challenges, raw material & chemical cost increases, new plant expansions coming on-line within the waiver request time frame, and expansion of utility operational maintenance, repair, rehabilitation and capital improvement programs. Staff is requesting approval to purchase from the authorized vendors listed above for Fiscal Year 24 from October 1, 2023, through September 30, 2024, as an opportunity to pursue utilization of piggyback contracts, competitively bid, or negotiate contracts to include but not be limited to availability, warranty, pricing schedules, and cost increases. County staff will continue to utilize piggyback contracts as available FISCAL IMPACT: Funds are available in the Collier County Water-Sewer District Operating Fund (4008), the Water User Fee Fund (4012), and Wastewater User Fee Fund (4014). As the utility system ages, the quantity of materials purchased will vary depending on the actual repair/replacement needs.
