EXECUTIVE SUMMARY
Recommendation that the Board approve the closure of Southbay Drive for Stock Development, the
Developer of the Ritz Carlton Residences within the One Naples Planned Unit Development.
OBJECTIVE: To have the Board approve the closure of Southbay Drive by Stock Development for the
construction of Ritz Carlton Residences.
CONSIDERATIONS: On March 1, 2021, the Board of County Commissioners (“Board”) approved the One
Naples Mixed-Use Planned Unit Development (PUD; Ordinance 21-09). To construct the Ritz Carlton Residences
(formerly known as One Naples), the Developer requests to close a portion of Southbay Drive for safety reasons
from September 27, 2023 through September 30, 2025, through right -of-way permit PRROW20230834385.
Southbay Drive separates the bayside residences from the primary tower residence. The road closure is vital for
public safety due to the heavy equipment use that will be utilized between the two sides of the roadway during
construction. Additionally, the road closure will also allow for a reduction of the overall construction timeline.
Stock Development, responsible for the Ritz Carlton Residence project, has made substantial investments in right-of-
way improvements for the immediate surrounding areas, as were required Developer Commitments per the PUD
Ordinance. These investments include closed drainage systems, utility upgrades, new roads, bike lanes, brick paver
sidewalks, landscape and hardscape enhancements, garage technology improvements, and installing a traffic signal at
the intersection of Vanderbilt Beach Road and Gulf Shore Drive. Such extensive improvements signify Stock
Development's commitment to enhancing the area's infrastructure and overall quality of life. Stock Development has
spent over $5,260,829 completing these beneficial public projects and improving the area's public infrastructure.
The closure of Southbay Drive is motivated by concerns for public safety. With ongoing construction activities for
the Ritz Carlton Residences project, closing the road ensures a secure environment for construction workers and the
general public. Establishing an unobstructed construction zone minimizes the risk of accidents and injuries,
including to the public, and prioritizes the well-being of all parties involved. The road closure is mitigated by the
availability of alternative routes in the immediate surrounding area, including Vanderbilt Beach Road and Gulf
Shore Drive. The closure has been designed in such a way as to minimize disruptions for the surrounding residents
and businesses.
Stock Development approached Growth Management Community Development staff in July 2023 regarding this
request and has made extensive efforts with the neighboring property owners, to include the residents of Barefoot
Pelican and Vanderbilt Palms, Buzz’s Lighthouse Restaurant, Collier County Emergency Management Services,
and the North Collier Fire District, all of whom have supported the road closure for public safety concerns (please
see attached letters of support) for the two year period. If approved, the developer shall be responsible for all costs,
enforcement, public concerns, and maintenance of traffic operations for the extent of the road closure period.
FISCAL IMPACT: The applicant has paid the Right-of-Way permit fee ($2000) associated with this permit.
Additionally, extension fees or approximately $8,000 (3 month-renewals at $1,000 per renewal) will be paid to the
County to keep the permit active for the entire road closure.
GROWTH MANAGEMENT IMPACT: There is no impact to the Growth Management Plan related to this
action.
LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires a majority vote for
Board approval.-DDP
RECOMMENDATION: To approve the road closure of Southbay Drive for the devel opment of the Ritz Carlton
Residences in the interest of public safety.

Southbay Drive. Please confirm we have your support for the closure of Southbay. We
will keep the westernmost gates on Southbay and they can remain open if you choose,
but in any event if they are closed, as with all the gates, should there be a need for

All went well at our annual meeting this afternoon. We showed your plan for the street closure and there was no
objection.
However, there was some comments and concerns about how the intersection at SouthBay and Vanderbilt beach road
would work out. Some were suggesting there may be lots of congestion during construction timeframe, at the
intersection, making it difficult to navigate. Just wanted to make you aware of some of the comments. Time will tell
though.

Thank you for sharing your logistics plan with us. After reviewing it with the owners at our last board meeting, there
were a few concerns. Specifically, several mentioned they were concerned about turning left onto Vanderbilt Beach
Road from Southbay. Recognizing that there are challenges now with the traffic flow and how much worse it might be if
they can't use the alternate exit from Southbay onto Gulf Drive.
We discussed that the improvements being made by One Naples with the enhancement of the beach parking garage
access, signage before 41 and Vanderbilt Drive, as well as the new traffic light at the corner of Gulf Drive and Vanderbilt
Beach, there might not be a need to be concerned.
There was also mention of the beach goers parking on either side of Southbay
and how much worse that might get during Spring break, though we have already noticed an improvement since you
added the no parking signs on the construction barrels.
As a suggestion, it might be a good idea to indicate with signage that the road is closed so that we won't have people
trying to turn around in our driveway.
Aside from those few concerns, in general the owners at the Barefoot Pelican feel that you have sufficiently addressed
our needs and we have no problem with the plan to close Southbay during construction of RCR.

A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY,FLORIDA, SUPERSEDING RESOLUTION 2012-225,
WHICH ESTABLISHED A REVISED SCHEDULE OF FEES FOR RIGHT-
OF-WAY PERMITS, TO INCLUDE A WIRELESS FACILITY
APPLICATION FEE AND AN ANNUAL FEE FOR THE COLLOCATION
OF SMALL WIRELESS FACILITIES ON COUNTY UTILITY POLES
WITHIN THE COUNTY RIGHT-OF-WAY.
WHEREAS, Collier County Resolution No. 2000-455 established a schedule of
development-related review and processing fees; and
WHEREAS, the fees established in Resolution No. 2000-455 were subsequently amended
and revised pursuant to Resolution Nos. 2002-479, 2003-170, 2007-162 and 2012-225 and the
established fees are reflective of the actual cost of processing,reviewing,inspecting and evaluating
Collier County Right-of-Way permits as set forth in attached Exhibit "A;" and
WHEREAS, in its 2017 Session, the Florida Legislature enacted the "Advanced Wireless
Infrastructure Deployment Act" as codified in Section 337.401, Florida Statutes, which required
local governments to allow small wireless facilities within the public right-of-way by either
collocation on existing Utility Poles, or by establishing a new Utility Pole where collocation is not
possible; and
WHEREAS, the Act requires that the county establish nondiscriminatory and
competitively neutral rates, fees, and terms in compliance with the Act, and sets a limit of$150
per pole for the annual rate for the collocation of small wireless facilities on County Utility Poles;
and
WHEREAS, at its meeting on the 27th of June, 2017 this Board adopted an Ordinance
implementing the regulations and permitting process authorized by the Act.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
1. The Board of County Commissioners hereby declares and approves the fees set forth
in the Schedule of Fees for Right-of-Way Permits, attached hereto and incorporated
herein as Exhibit "A" as reasonable sums to be assessed to those who receive the
benefits of those services,review, and inspections required by the Collier County Code
of Laws and Ordinances, the Land Development Code and the County permitting
process.
2. That all County Projects within or adjacent to the County Right-of-Way shall be exempt
from the Lane Rental Fee as noted on Exhibit"A."

Right-of-way Permit Notes:
1.Unjustified delays meeting permitted deadlines shall require additional fees as authorized.
2.Small Commercial Development shall be defined as a non-residential (single-family or duplex)
project generating 600 vehicles trips per day or less.
3.Large Commercial Development shall be defined as a non-residential (single-family or duplex)
project generating greater than 600 trips per day.
4.A right-of-way use fee (chart attached) per day shall apply to all non-residential commercial

5.No refunds of unused fees shall be allowed.
6.Lane use fees shall be calculated by Collier County and shall be due and payable at the time of
permit application if a permit is issued. If a Notice of Intent to Issue a permit is provided by the
County in lieu of a permit,then the lane use fee shall be due and payable at the time of issuance
of the actual permit.
7.If work continues beyond the originally estimated lane use period, then additional lane use fees
shall be due and payable within two working days of notice to the Permittee of such additional
fees. Failure to provide the additional fees to the County within three working days of such notice
shall be cause for the project to be"red-tagged"and shut down. Lane use fees shall continue to
accrue during any period of shutdown and shall be added to the additional lane use fees
calculated by Collier County.
8.Any deviation from the above must be approved by the ROW Permitting and Inspection manager
or designee prior to implementation.
9.All future County Projects shall be exempt from the Lane Rental Fee Incentive Program.

SCOPE OF WORK:
•Coordinate with Sunshine 811 for existing utility locations
•Provide survey services to locate 2 each roadside signs based on specific locations provided by Stock
Development. Information at minimum shall include post locations closest to the road and sign angle position
relative to the roadway for each sign
•Furnish and Install reinforced concrete foundations as per plan for each sign
•Furnish and Install steel superstructure with designed break aways as per plan for each sign
•Install 2 each roadside signs as per all pertinent engineered design criteria
•Restore grade with sod replacement. Maintenance of sod to maturity by others
•Coordinate rough and final inspections for our work
ASSUMPTION:
•A MOT Plan is not required
BY OTHERS:
•All Permits
•Maintenance of replacement sod to maturity
•Electrical Installations to Sign and Cellular Services
•Provide GPS Coordinates for column closest to roadside and angle of sign relative to roadway.
