WHEREAS, on September 22, 2020 the COUNTY entered into an Agreement with the

WHEREAS, on February 5, 2021 the COUNTY entered into an Amendment with the
United States Department of Housing and Urban Development (HUD) for Supplemental CARES
Act funding to execute and implement an Emergency Solutions Grant Program (ESG) grant in
certain areas of Collier County, pursuant to the Emergency Solutions Grant Program — CARES
Act Funding, Subtitle B of Title IV of the McKinney-Vento Homeless Assistance Act (42 U.S.C.
11371 et seq., and the CARES Act, Public Law 116-136); and
WHEREAS, on June 8, 2021, the COUNTY entered into a subrecipient agreement
(Agreement) with the SUBRECIPIENT to further the goals and objectives of the ESG-CV
Program; and
WHEREAS,on January 11, 2022,the Board of County Commissioners approved the First
Amendment to the Agreement to reduce the total amount of federal funds awarded, clarify
language needed to allocate funds among all components into one budget for the use of all eligible
activities, add an additional project component, revise Exhibit C, and clarify language in Section
E. Payment Deliverables at the request of the SUBRECIPIENT; and,
WHEREAS,on July 12, 2022, the Board of County Commissioners approved the Second
Amendment to the Agreement to respond to March 31, 2022 expenditure deadlines HUD set forth
in Notice CPD-21-08 (ESG-CV Notice), and reduce the award amount.
WHEREAS,the Parties desire to amend the Agreement to formally include HUD-required
duplication of benefit language that SUBRECIPIENT adhered to and applied throughout and
following the Agreement's period of performance.
NOW, THEREFORE, in consideration of foregoing Recitals, and other good and valuable
consideration, the receipt and sufficiency of which is hereby mutually acknowledged, the Parties
agree to amend the Agreement as follows:

F. Pursuant to HUD Notice CPD21-08:
"Prohibition Against Duplication of Benefits. Section 312 (42 U.S.C. 5155) of the
Robert T. Stafford Disaster Relief and Emergency Assistance Act, as amended (42
U.S.C. 5121 et seq.) prohibits duplication of benefits for programs that provide
financial assistance to people or entities suffering losses because of a major disaster or
emergency. "Duplication of benefits" occurs when Federal financial assistance is
provided to a person or entity through a program to address losses resulting from a
Federally-declared emergency or disaster, and the person or entity has received (or
would receive, by acting reasonably to obtain available assistance) financial assistance
for the same costs from any other source (including insurance), and the total amount
received exceeds the total need for those costs. Recipients must establish and maintain
adequate procedures to prevent any duplication of benefits with ESG-CV funds. HUD
will issue additional guidance to facilitate compliance with this requirement."
All ESG-CV SUBRECIPIENTS are required to establish and follow procedures to
ensure that DOB does not occur. SUBRECIPIENTS must include references and
definitions to the regulations affecting allowability of costs and duplication of benefits
in the Attestation including but not limited to:

WHEREAS, on October 26, 2021, the Board of County Commissioners approved the
Second Amendment to further amend the Agreement to clarify language needed to allocate funds
among all components into one budget for the use of all eligible activities, add additional project
components and remove one component at the request of the subrecipient; and
WHEREAS, on January 11, 2022, the Board of County Commissioners approved the
Third Amendment to the Agreement to add Emergency Shelter to the Scope of Work, clarify
language within Payment Deliverables, and increase the total amount of federal funds awarded at
the request of the subrecipient; and
WHEREAS, on July 12, 2022, the Board of County Commissioners approved the Fourth
Amendment to respond to March 31, 2022 expenditure deadlines HUD set forth in Notice CPD-
21-08 (ESG-CV Notice), and increase the total amount of federal awards, at the request of the
SUBRECIPIENT; and
WHEREAS,the Parties desire to further amend the Agreement to formally include HUD-

WHEREAS, on February 5, 2021 the aforesaid agreement with the United States
Department of Housing and Urban Development (HUD) was amended to provide Supplemental
CARES Act funding; and
WHEREAS, pursuant to the aforesaid agreement as amended, COUNTY has undertaken
certain activities to primarily benefit homeless individuals in Collier County with the use of ESG-
CV funds to improve the quality of life in Collier County by providing assistance for any of the
following five (5) program components (street outreach, emergency shelter, homelessness
prevention,rapid re-housing assistance,and Homeless Management Information System[HMIS]);
as well as eligible administrative activities; and
WHEREAS,the Board of County Commissioners of Collier County(Board)approved the
Collier County Consolidated Plan - One-Year Action Plan for Federal Fiscal Year f 2019-2020}for
the ESG Program on Tune 25, 2019-Agenda Item 16.D.2; and
WHEREAS, in accordance with HUD regulations and the Collier County Consolidated
Plan concerning the preparation of various Annual Action Plans, the COUNTY advertised the
019-2020 lAnnual Action Plan, on tApril 21, 20201, with a 5-day Citizen Comment period from
pril 21, 2020 Ito April 26, 20201; and
WHEREAS, the Board of County Commissioners of Collier County (Board) approved
substantial amendments to the Collier County Consolidated Plan for additional funding from the
ESG-CV Program Round 1 on May 12, 2020 H Agenda Item 16.F.1.F 1, and ESG-CV Program
Round 2 on November 10, 2020 H Agenda Item 16.D.8 ; and
WHEREAS, in accordance with the HUD Community Planning and Development Grant
Program Waiver Letter, issued April 2, 2020, the SUBRECIPIENT submitted a proposal for
participation in the Collier County ESG Program; and
WHEREAS,HUD provided changes to applicable deadlines as set forth on April 18,2022
in Notice CPD-22-06 (ESG-CV Notice); and
WHEREAS, on June 13, 2023, the Board of County Commissioners approved an
extension to the Emergency Solutions Grant-CV expenditure deadline to support shelter
oeprations; and
WHEREAS,the Parties desire to amend the Agreement to formally include HUD-required
duplication of benefit language that SUBRECIPIENT adhered to and applied throughout and
following the Agreement's period of performance.

RECITALS
WHEREAS, on September 22, 2020 the COUNTY entered into an Agreement with the
United States Department of Housing and Urban Development (HUD) for a grant to execute and

pursuant to the Emergency Solutions Grant Program — CARES Act Funding, Subtitle B of Title

WHEREAS, on February 5, 2021 the COUNTY entered into a grant agreement
amendment with the United States Department of Housing and Urban Development (HUD) for
Supplemental CARES Act funding to execute and implement an Emergency Solutions Grant
Program (ESG) grant in certain areas of Collier County, pursuant to the Emergency Solutions
Grant Program— CARES Act Funding, Subtitle B of Title IV of the McKinney-Vento Homeless
Assistance Act(42 U.S.C. 11371 et seq., and the CARES Act, Public Law 116-136); and
WHEREAS, on February 23, 2021, the COUNTY entered into a subrecipient agreement
(Agreement) with SUBRECIPIENT to further the goals and objectives of the ESG-CV Program;
and
WHEREAS, on June 22, 2021, the Board of County Commissioners approved the First
Amendment to add additional ESG-CV funding, services, clarify language in components, update
payment deliverables, revise Exhibit C, and modify the scope of service; and
WHEREAS, on November 9, 2021, the Board of County Commissioners approved the
Second Amendment to clarify language among all components, collapse the budget for the use of
all eligible activities, and add an additional project component at the request of the
SUBRECIPIENT; and
WHEREAS, on January 11, 2022, the Board of County Commissioners approved the
Third Amendment to revise the Scope of Work, clarify language in Component Seven, and revise
Exhibit C at the request of the SUBRECIPIENT; and
WHEREAS, on July 12, 2022, the Board of County Commissioners approved the Fourth
Amendment to respond to March 31, 2022 expenditure deadlines HUD set forth in Notice CPD-
21-08 (ESG-CV Notice), clarify Project Details, and increase the total amount of federal awards;
and
WHEREAS,the Parties desire to amend the Agreement to formally include HUD-required
duplication of benefit language that SUBRECIPIENT adhered to and applied throughout and
following the Agreement's period of performance.
NOW, THEREFORE, in consideration of foregoing Recitals, and other good and
valuable consideration,the receipt and sufficiency of which is hereby mutually acknowledged,the
Parties agree to amend the Agreement as follows:

F. Pursuant to HUD Notice CPD21-08:
"Prohibition Against Duplication of Benefits. Section 312 (42 U.S.C. 5155) of the
Robert T. Stafford Disaster Relief and Emergency Assistance Act, as amended (42
U.S.C. 5121 et seq.) prohibits duplication of benefits for programs that provide
financial assistance to people or entities suffering losses because of a major disaster or
emergency. "Duplication of benefits" occurs when Federal financial assistance is
provided to a person or entity through a program to address losses resulting from a
Federally-declared emergency or disaster, and the person or entity has received (or
would receive, by acting reasonably to obtain available assistance) financial assistance
for the same costs from any other source (including insurance), and the total amount
received exceeds the total need for those costs. Recipients must establish and maintain
