EXECUTIVE SUMMARY
Recommendation that the Board of County Commissioners and also the Board of County Commissioners
acting in its capacity as the Community Redevelopment Agency Board (CRA) find good cause, and approve
the expenditure of CRA funds on the portion of the Bayshore Drive/Sugden Regional Park Boardwalk
Project located outside of the boundaries of the Bayshore Gateway Triangle Community Redevelopment
Area, and find that the expenditure is consistent with the goals of the Community Redevelopment Pla n.
OBJECTIVE: To authorize the expenditure of CRA funds outside of the Community Redevelopment Area in
order to construct a boardwalk connecting Bayshore Drive to Sugden Regional Park (the “Park”), as set forth by the
Community Redevelopment Plan.
CONSIDERATIONS: The much-anticipated Bayshore Drive/Sugden Regional Park Boardwalk Project (the
“Boardwalk Project”) will connect the CRA’s 17-Acre Parcel, Bayshore Drive, and the greater Community
Redevelopment Area to the Park. The Boardwalk and this connection are expected to become an incredible
recreational destination, and they will also create safe, beautiful pedestrian and bicycle linkages, facilitate
community events, invite additional desirable redevelopment, and allow more citizens to better access t he
Park.
On March 14, 2023, the BCC, acting in its capacity as the CRA Board, unanimously approved the
Boardwalk’s “central alignment” and directed staff to complete the design of the Boardwalk Project, including
two parking areas.
On May 9, 2023, the BCC, acting in its capacity as the CRA Board, approved Change Order No. 1 to
Agreement No. 21-7845 with Stantec Consulting Services, Inc., to complete the design and permitting of the
Boardwalk Project.
Currently, the CRA is working with Stantec to complete the design and permitting of the Boardwalk Project
pursuant to the CRA Board’s direction and the attached Estimated Project Timeline and Budget. As part of
the design and permitting process, a Site Development Plan (SDP) Application and Site Development Plan
Insubstantial Change (SDPI) Application are required. The SDP Application corresponds to that portion of
the Boardwalk Project falling on the 17-Acre Parcel. The SDPI Application corresponds to that portion of the
Boardwalk Project located on/in the Park.
Normally, the expenditures associated with these routine processes would be handled administratively. In
fact, the application fees associated with the SDP Application have already been paid. However, as to the
$3,698.97 associated with the SDPI Application, there are special circumstances that necessitate action by the
BCC and the BCC acting in its capacity as the CRA Board.
The Park is technically outside of the Community Redevelopment Area, which ends at the eastern property
line of the 17-Acre Parcel/western property line of the Park. As a result, as shown in the attached Conceptual
Plan, approximately 52 feet of the 1,367 linear feet of the project are outside of the Community
Redevelopment Area.
Due to the wording of the applicable Florida Statutes and the Florida Attorney General’s Opinion 2009-32,
Florida’s community redevelopment agencies generally limit the expenditure of tax increment revenue to
redevelopment and related activities within the designated community redevelopment area unless specifically
authorized by Florida Statutes or for good cause shown.
In this case, staff believes that good cause is shown by the following facts:
· The adopted Community Redevelopment Plan references “Sugden” no less than 25 times and
specifically identifies the Boardwalk Project as a priority, as highlighted by the “Short Term (1 -5
years) Capital Projects” on Page 5-4-6: “General Parks Improvements in the Bayshore Area-general

item to address connections to parks and amenities, including any associated with the 17-Acre Site
and Sugden Regional Park.”
· Sugden Regional Park is contiguous to the Community Redevelopment Area and the Boardwalk
Project is physically connected to the Community Redevelopment Area.
· In addition to being a defined project in the Community Redevelopment Plan, the Boardwalk Project
benefits the Community Redevelopment Area and advances the CRA’s efforts.
· The portion of the Boardwalk Project falling outside of the Community Redevelopment Area and
corresponding expenditures are de minimis in nature, constituting less than 4% of the whole.
· The SDPI Application fee payable to the Collier County Grown Management Department is
$3,698.97.
LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires a majority vote of
each Board for approval. (HFAC)
FISCAL IMPACT: Total project cost is estimated at $3,000,000 with an estimated $120,000 associated with the
portion outside of the Community Redevelopment Area. Funding for this project is available in Bayshore Gateway
Triangle Capital Fund (1021), Project Number 50208.
GROWTH MANAGEMENT IMPACT: The project is consistent with the BGTCRA Redevelopment Plan.
ADVISORY BOARD RECOMMENDATION: On June 29, 2023, the BGTCRA Local Redevelopment Advisory
Board voted 7-0 to recommend approval of the proposed expenditure.
RECOMMENDATION: Recommendation that the Board of County Commissioners and also the Board of County

expenditure is consistent with the goals of the Community Redevelopment Plan, find good cause, and approve the
