EXECUTIVE SUMMARY
Recommendation to approve a Resolution repealing and superseding Resolution 2013-63, providing for an
updated distribution of the Five Cents and Six Cents Local Option Fuel Taxes between the County, the City
of Naples, the City of Marco Island, and Everglades City, and to authorize submittal of the Resolution and
findings to the Florida Department of Revenue for implementation.

OBJECTIVE: Update the Local Option Fuel Tax Distribution for submittal to the Florida Department of Revenue
for implementation.
CONSIDERATIONS: The Local Option Fuel Taxes are distributed among the County and the three
municipalities within the County pursuant to provisions of Section 336.025, Fla. Stat., which provides for
distribution based on a calculation of proportional transportation expenditures. Currently, Resolution 2013 -63
controls the local distribution of proceeds utilizing the distribution method referenced above. Pursuant t o
requirements of Section 336.025, Fla. Stat., the distribution proportions must be recalculated every 10 years based
on the transportation expenditures of the immediately preceding 5 years. The attached Resolution repeals and
supersedes Resolution 2013-63 and provides the updated distribution proportions consistent with these
requirements.
The methodology used to develop the proportional distribution adopted in Resolution 2013 -63 is based on Local
Highway Finance Report (FHWA-536) as provided annually to Florida Department of Transportation by all local
government entities. As required by Section 218.322, Fla. Stat., this report collects and compiles data from local
government entities on receipts and expenditures used for transportation purposes. This distribution update utilizes
FHWA-536 reports submitted for the FY 18 through FY 22 period.
Letters dated August 1, 2023, and emails dated August 2, 2023, communicating the results of the update and
requesting comments by August 18, 2023, were sent to the City of Naples, the City of Marco Island, and
Everglades City. Staff has not received a response.
FISCAL IMPACT: The Florida Department of Revenue estimate of the Local Option Fuel Tax distribution to
Collier County for the fiscal year ending September 30, 2023, is $18,403,709. Using that estimate, the impact of the
updated distribution is illustrated in the following table.

Local Option Fuel Tax Distribution Analysis
The updated distribution will be applied beginning with the January 2024 Fuel Tax Distribution to the County and
municipalities within the County. Local Option Fuel Tax distributions will be included in the Gas Tax -Road
Construction Fund (313) budget.
GROWTH MANAGEMENT IMPACT: The Five Cent and Six Cent Local Option Fuel Taxes are used to
support the Transportation Element of the Growth Management Plan.
LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires a majority vote for
approval. -SAA
RECOMMENDATION: To approve and authorize the Chairman to execute the Resolution repealing and
superseding Resolution 2013-63, providing for an updated distribution of the Five Cents and Six Cents Local
