Agenda 09/12/2023 Item #16A 7 (Final acceptance of utility easement for One Naples Right-of-way improvements and Utility Relocaation)09/12/2023 EXECUTIVE SUMMARY Recommendation to approve final acceptance of the potable water and sewer facilities and accept the conveyance of the potable water and sewer facilities and appurtenant utility easement for One Naples Right - of-Way Improvements and Utility Relocation, PL20220002615. OBJECTIVE: To have the Board of County Commissioners, as Ex-Officio Governing Board of the Collier County Water-Sewer District, approve final acceptance of these potable water and sewer facilities, in accordance with the Collier County Utility Standards and Procedures, Ordinance No. 2004-31. CONSIDERATIONS: 1) The Developer of One Naples Right-of-Way (ROW) Improvements and Utility Relocation has constructed the potable water and sewer facilities within dedicated easements t o serve this private development. The potable water and sewer facilities were offered for conveyance to the County, as described in O.R. Book 6262, Page (PG) 251, and are located within County utility easements and/or right of way (Vanderbilt Beach Road) dedicated by the plat of Conner’s Vanderbilt Beach Estates Unit 1, recorded in Plat Book 3, PG 8; by the plat of Vanderbilt Beach Center, recorded in Plat Book 3, PG 16; by Warranty Deed as recorded in Deed Book 15, PG 121; and by appurtenant Deed of Utility Easement recorded in O.R. Book 6262, PG 196, of the Public Records of Collier County, Florida. These water and sewer facilities (Assets) were valued at $280,101.80 and $36,520.90, respectively. 2) Staff recorded all final acceptance documents associated with the facilities being conveyed to the County in the public records of Collier County, which were reviewed and approved by the County Attorney’s office as to form and legality. The County acquired its interest in the potable water and sewer facilities by Warranty Deed and Bill of Sale recorded at Official Records Book 6262, PG 251 (“the Utilities Facilities Deed”). 3) The Development Review staff conducted a final inspection of materials and workmanship on June 20, 2023, in coordination with Public Utilities, and these facilities have been found to be satisfactory and acceptable. 4) Staff recommends final acceptance of the subject potable water and sewer utilities facilities and the acceptance of the Utilities Facilities Deed, and the facilities described therein. 5) This final acceptance is in accordance with Collier County, Ordinance No. 2004-31, as amended. 6) Staff is unaware of any issues that would serve to negate the recommendation to approve this final acceptance. FISCAL IMPACT: Approval of this Executive Summary will result in the Collier County Water-Sewer District receiving title to the potable water and sewer utility facilities, which have a gross value of $316,622.70 (no depreciation applied), and an asset will be recorded in the financial records of the county. GROWTH MANAGEMENT IMPACT: No growth management impact is associated with this action. LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires a majority vote for Board approval. -DDP RECOMMENDATION: To approve final acceptance and accept the conveyance of the potable water and sewer utility facilities and appurtenant utility easement for One Naples R.O.W.
