EXECUTIVE SUMMARY
Request to appoint two at-large environmental members to the Collier County Planning Commission.
OBJECTIVE: To appoint two at-large environmental members to the Collier County Planning Commission to
four-year terms expiring October 1, 2027. (Note: 4/5ths vote needed)
CONSIDERATIONS: The seven-member Planning Commission is made up of five planning commissioners
selected by commission district and two at-large members with environmental expertise. The Planning
Commission assists in the formulation and review of the Comprehensive Land Use Plan, Land Development Code,
and amendments to both, and then submits their recommendations to the Board for final decision. Members are
required to file a Form 1 Statement of Financial Interest each year with the Supervisor of Elections. Terms are four
years. A list of the current membership is included in the backup.
The two at-large environmental seats on the CCPC will expire on October 1, 2023. As to the qualifications required
to fill these seats, the Collier County Planning Commission Ordinance (Ordinance No. 2009-29, as amended)
provides the following:
“Qualifications.
3. The two at-large environmental members are expected to provide the Planning Commission with
technical expertise on environmental matters, and shall demonstrate evidence of expertise in one or more of
the following areas related to environmental protection and natural resources management: air quality,
biology (including any of the subdisciplines such as botany, ecology, zoology, etc.), coastal processes,
estuarine processes, hazardous waste, hydrogeology, hydrology, hydraulics, land use law, land use
planning, pollution control, solid waste, stormwater management, water resources, wildlife management, or
other representative area deemed appropriate by the BCC, with a Board preference for one of these
members with an expertise in biology and/or wildlife management, and the other with an expertise in water
and/or hydrology.”

LEGAL CONSIDERATIONS: This item was prepared by the County Attorney, is approved as to form and
legality, and requires a four-fifths vote to appoint or reappoint the two at -large environmental members to the
Planning Commission. -JAK
RECOMMENDATION: That the Board of County Commissioners appoints two at-large environmental members
to serve four-year terms expiring October 1, 2027, and directs the County Attorney to prepare a resolution
confirming the appointments.

RE: Collier County Planning Commission Vacancies Selection Representing Commission
Districts 3, 1, and the Non-voting School Board Rep.
As noted in your e-mail today, Paul Shea, Joseph Schmitt, and Amy Lockhart have applied to be reappointed
to fill the above referenced vacancies on the Collier County Planning Commission (CCPC).
It should be noted that Ordinance Number 2013-50 (CCPC Membership qualifications) requires the
members of the CCPC to be permanent residents and qualified electors of Collier County. The CCPC
members are also to reside in the Commission District allocated for each vacancy. Please be advised that the
applicants are permanent residents of Collier County with Commissioner Shea residing District #3, and
Commissioner Schmitt residing in District #1. Amy Lockhart has been selected by the School Board to serve
as the non-voting member. Lastly, each applicant is listed as registered voters.
Furthermore, this section states that although no specific experience is necessary as a prerequisite to the
appointment, consideration shall be given to applicants who have experience or who have shown interest in
the areas of planning, zoning, and related fields. A further consideration in the appointment of Planning
Commission members shall be made to provide the CCPC with the needed technical, professional, business,
and/or administrative expertise to accomplish the duties and functions of the Planning Commission. The
resume provided by Mr. Shea indicates his involvement with the Collier County Affordable Housing
Committee and the CCPC. The resume submitted by Mr. Schmitt indicates his service on the Coastal Storm
Risk Management (CSRM) Advisory Committee and with the CCPC. Lastly, the resume submitted by Ms.
Lockhart indicates her continued employment with the School Board and service on the CCPC.
You have also forwarded the resumes submitted by Ronald Goldstein (District #1) and Andrew Blitch
(District #3) for consideration. Mr. Goldstein indicates his service on the Architectural Review Committee
at Artesia and a volunteer with Rookery Bay. Mr. Blitch indicates that he is a member of the Leadership
Collier Advisory Board and a member of the Naples Chamber of Commerce.
Based upon the information contained in attached applications, all the applicants are qualified to serve on
this advisory board.

This 7 member quasi-judicial committee was created by authority of Chapter 67-1246, Laws of
FL. The Planning Commission serves as the local planning agency, and reviews and makes
recommendations on applications for amendments to the Growth Management Plan, Land
Development Code, and the official Zoning Atlas. The Board of County Commissioners also
gave the Planning Commission the power and duty of serving as the County’s Environmental
Advisory Council under Ordinance No. 2009-32. There shall be one member from each of the
five County Commission Districts, and two at-large environmental members. Planning
Commission Candidates for the five County Commission District seats must be nominated by the
Commissioner of the District in which the candidate resides for both initial and subsequent terms
and receive a simple majority vote of the Board of County Commissioners. The two at-large
environmental members can be nominated by any Commissioner, but must receive a four-fifths
vote of the BCC for appointment or reappointment. Members are required to file a Form 1
Statement of Financial Interest each year with the Supervisor of Elections. Terms are four years.
Pursuant to Section 163.3174, F.S., the Collier County Planning Commission must include a
nonvoting member appointed by the District School Board of Collier County.
