INTERLOCAL AGREEMENT
BETWEEN COLLIER COUNTY AND
THE CITY OF NAPLES
THIS INTERLOCAL AGREEMENT dated this 7Z"aday of /qlvs./- ,2023, is
entered into as authorized by Ch. 163, Florida Statutes, Intergovernmental Programs, by and
between Collier County, a political subdivision of the State of Florida, (COUNTY) and the City
of Naples,Florida, a Florida municipal corporation(CITY).
WITNESSETH
WHEREAS, this Interlocal Agreement is required pursuant to the terms of the State of
Florida Department of Environmental Protection (FDEP) Standard Grant Agreement for
Biological Debris Removal within Collier County (Agreement No. RT015) dated April 11, 2023;
and
WHEREAS, the Grant Agreement provides funds to support local governments in
cleaning beaches and coastal areas, including interior waterways, to minimize the impacts of red
tide to residents and visitors; and
WHEREAS,Collier County is eligible for the FDEP funding through the Grant Agreement
and has worked with the City of Naples for the City of Naples to provide red tide cleanup efforts
on the City beaches, coastal, and interior waters including: containment, removal, cleanup,
elimination,transportation, and disposal of biological debris associated with the red tide event on
City beaches and waterways; and
WHEREAS, the City of Naples has completed the red tide cleanup efforts and submitted
documentation for reimbursement to the County which the County has approved for
reimbursement; and

WHEREAS,Collier County conducted its own red tide cleanup efforts on County beaches
and will submit its own request for reimbursement to FDEP together with the City's documentation
for reimbursement.
WHEREAS, following approval of this Interlocal Agreement,the County will reimburse
the City and submit the required documentation to FDEP for the County's reimbursement.
NOW,THEREFORE,in consideration of the above premises,and the mutual covenants,
terms,and provisions contained herein, the COUNTY and the CITY agree as follows:
SECTION I. MUTUAL RESPONSIBILITIES
The Parties agree to cooperatively work together to comply with the terms of the State of
Florida Department of Environmental Protection (FDEP) Standard Grant Agreement for
Biological Debris Removal within Collier County(Agreement No.RT015)(Exhibit A)for red tide
cleanup efforts to seek reimbursement for both the County and City's expenditures as related to
this Grant Agreement.
SECTION II: COUNTY RESPONSIBILITIES
The COUNTY agrees to:
A. Reimburse the City of Naples for expenditures made in compliance with the terms of the
Grant Agreement for the City of Naples' documented efforts for red tide cleanup efforts.
The City retained a vendor to complete this work and used City staff time and resources as
well. All efforts are reimbursable with the required documentation.
B. This Project is based solely on the terms of the FDEP Grant Agreement,
C. Work with the City and FDEP to secure reimbursement for the City up to $150,000.
SECTION III: CITY RESPONSIBILITIES
The CITY agrees to:

A. Provide red tide cleanup efforts on City beaches and waterways including containment,
removal, cleanup,elimination,transportation, and disposal of biological debris associated
with the red tide event.
B. Provide grant required documentation to support the City's claim for reimbursement for
red tide cleanup efforts.
C, Work with the County and FDEP to secure the reimbursement up to $150,000..
SECTION IV: AGREEMENT TERMS
A, This Interlocal Agreement shall remain in full force and effect from-the date_first•above
written and shall terminate upon the completion of all services and responsibilities
mutually performed by the COUNTY and the CITY including final payment under the
terms of the Grant Agreement.
B. Either Party may terminate this Interlocal Agreement thirty (30)days written notice to the
other Party.

RECITALS
WHEREAS, the Grantee and the Department entered into a State of Florida Department
of Environmental Protection Standard Grant Agreement, Number RT0 15, effective April 19, 2023,
for Biological Debris Removal with Collier County (the "Project"), which is by this reference
incorporated herein (the "2022 Standard Grant Agreement") and,
WHEREAS, prior to the expiration of the 2022 Standard Grant Agreement on June 30,
2023, the parties intended to extend its term with the execution of Amendment No. I to Agreement
RT0 15, a Grantee approved signed copy of which is attached hereto as Exhibit "A" and by this
reference incorporated herein (the "Proposed Amendment I"); and,
WHEREAS, in order to complete the Project as intended, the parties wish to enter into this
Standard Grant Agreement under the same terms and conditions as the 2022 Standard Grant
Agreement, as modified by the Proposed Amendment I.
NOW, THEREFORE, in consideration of the premises and mutual covenants contained
herein, the sufficiency of which is acknowledged hereby, the parties do agree as follows:
