CESM Minutes 08/04/2023 August 4, 2023 1 MINUTES OF THE HEARING OF THE COLLIER COUNTY SPECIAL MAGISTRATE Naples, Florida, August 4, 2023 LET IT BE REMEMBERED the Collier County Special Magistrate, having conducted business herein, met on this date at 9:00 AM in REGULAR SESSION in Administrative Building “F,” 3rd floor, Collier County Government Complex, Naples, Florida, with the following persons present: SPECIAL MAGISTRATE: Honorable Patrick H. Neither Collier County nor the Special Magistrate shall be responsible for providing this record. I. CALL TO ORDER-SPECIAL MAGISTRATE PATRICK H. NEALE PRESIDING The Honorable Special Magistrate Patrick H. Neale called the Hearing to order at 9:00 AM. All those testifying at the proceeding did so under oath. II. Pledge of Allegiance The Pledge of Allegiance was recited. Prior to conducting the Hearing, Respondents were given an opportunity to speak with their Investigating Officers for a Resolution by Stipulation. CASE NO: CEROW20170015842 OWNER: Elizabeth Fox OFFICER: Ryan Cathey VIOLATIONS: Collier County Code of Laws and Ordinances, Chapter 110, Article II, Sections 110-31(a) and 110-32. Failed culvert pipes under driveways along Ridge Drive and a failed/blocked drainage culvert/swale along the north side of the property between Ridge Drive and Goodlette-Frank Road, impeding stormwater flow. FOLIO NO: 67184800004 PROPERTY ADDRESS: 110/122 Ridge Drive, Naples, FL 34108 Officer Cathey and Colleen Kerins, Assistant County Attorney represented the County. Jeff Wright of Henderson, Franklin, Starnes and Holt, P.A. represented Dr. Fox. Discussion occurred on the filing of the Motion for a Rehearing with all parties agreeing it was filed within the required timeframe. August 4, 2023 4 Mr. Wright testified:  A lien was filed on Dr. Fox’s property on May 3rd in the amount of $50,000 plus Operational Costs following the granting of a County Motion for Imposition of Fines and Liens for failure to abate violations in a timely manner.  The original violations included 2 issues, culvert work in the right-of-way for the driveway and debris in a swale along the north property line.  Dr. Fox complied with abated the violations.  The bulk of the fines were based on the aggravating factors for the swale flooding the adjacent property per the testimony of the neighbor.  There is no County right-of-way on the north property line where the drainage swale in question is located and the fines were imposed improperly as the County has no interest in the swale along the property line.  The violation cited noncompliance with Collier County Code Chapter110, Section 31.a – Permits: “It shall be unlawful for any responsible party to dig, excavate, obstruct, or place any construction or other material, or perform any other work which disturbs the existing structure and/or compaction of soil in any right-of-way provided for public use in Collier County, including any public right-of-way maintained by Collier County…”  The requirements of the code may not be applied where no right-of-way exists.  The other Section cited, Chapter 110, Section 32 states “Offending material is a public nuisance and is subject to removal by Collier County as follows: 1) Upon becoming aware of the presence of offending material, Collier County shall attempt to notify any responsible party by certified mail, return receipt requested, or other actual notice of the obligation to remove the offending material not more than 30 days after receipt of such notice”  Offending material is defined as “Means any object placed, constructed, or grown in any public right-of-way with or without a Collier County permit and that may endanger any person, damage the right-of-way, restrict existing or planned drainage, or impair normal maintenance…”  The definition references a right-of-way, and none exists along the property line.  Given these factors, the Stipulation executed is erroneous and defective.  A Notice of Appeal with the court was filed to preserve Dr. Fox’s rights. He requested the Lien Order be amended as it is defective given the aggravating factors cited in the decision are contrary to the evidence as no right-of-way exists along the property line. Dr. Fox is willing to pay 10 times the County’s costs to ensure the taxpayers are made whole. Further, testimony for the any aggravating factors on flooding provided by the neighbor involves complicated issues such as hydrology, etc. and is non competent. The Motion for Rehearing involves the following factors: 1. Striking the non-expert testimony regarding aggravating factors in the Order. 2. Rescinding the Order. 3. A lien be imposed with a lower amount. 4. The Motion for Rehearing be granted. Assistant County Attorney Kerins noted: August 4, 2023 5 1. There is already an appeal filed in court for the case. 2. The Stipulation executed in October of 2020 required the issues with the north property line swale and driveway culvert be alleviated. The failure to do so in the prescribed timeframe was the basis for the Motion for Imposition of Fines. 3. She does not object to rehearing, however requests the scope be limited to the Imposition of Fines and value assessed. 4. For clarity moving forward, the driveway culvert and property line swale issues be analyzed separately for the purposes of identifying the mitigating and aggravated factors. Special Magistrate Neale noted the fines accrued were $146,200 which he reduced to $50,000 taking substantial mitigating factors into account. Ms. Kerins noted the fine amount for the culvert issue in the right-of-way was in the range of $111,000. Special Magistrate Neale GRANTED the Motion for a Rehearing with the case to be heard at the September hearing date. The case be separated between the culvert right-of-way work for the driveway and the swale along the property line with the proceeding limited to the Aggravated and Mitigating factors utilized to derive the fine amount for the Imposition of Fines and Liens. Special Magistrate Neale requested both parties to submit a written summary of their position on the matter within 7 days of the hearing date. VII. PUBLIC HEARINGS A. HEARINGS 18. CASE NO: CEEX20230006274-DAS-V23-016260 OWNER: Jenlike Rolanda Joseph OFFICER: Connie Hunt VIOLATIONS: Collier County Code of Laws and Ordinances, Chapter 54, Article II, Section 14-35(1)(B). Running at large dog named “Apollo” off owner’s property, fourth offense. FOLIO NO: PROPERTY ADDRESS: Sugden Park, Avalon Dr, Naples, FL 34112 Connie Hunt, Domestic Animal Services represented the County and noted the case involves a 4th offense for the dog running at large. The 4th Citation was issued on 4/24/23 due to a complaint of a dog unattended at Sugden Park. The dog was microchipped, and the owner was identified as Jenlike Joseph. Evidence Entered: Exhibit 1: 1 photo. Exhibit 2: 1 photo Exhibit 3: 1st Citation Exhibit 4: 2nd Citation Exhibit 5: 3rd Citation Exhibit 6: 4th Citation She recommended a fine in the amount of $300.00 - $500.00 be imposed for the violation. Ms. Joseph testified the incidents occurred when she was at work and a family member was watching the dog. She has taken measures to prevent the events from re-occurring including August 4, 2023 6 fencing the yard and repairing any deficiencies in the fenced area, walking the dog on a leash. There has not been a 5th offense and she paid all previous costs associated with the Citations. Special Magistrate Neale, after considering the testimony, found the Respondent in violation of the Ordinance and ordered her to pay a Fine of $100.00, Operational Costs of $50.00 and a $5.00 Administrative Fee for a total amount due of $155.00. Said amount to be paid within 30 days of this hearing. VI. STIPULATIONS 2. CASE NO: CEEX20230005803-PU-5783 OWNER: TOLL FL XIII LTD PARTNERSHIP OFFICER: Michelle Scavone VIOLATIONS: Collier County Code of Laws and Ordinances, Chapter 134, Article VI, Section 134-174(C). Illegal tampering of Collier County owned RPZ/backflow device, the back leg of the RPZ pulled out of the ground presenting a Health, Safety, and welfare issue. FOLIO NO: 21800010826 PROPERTY ADDRESS: 14564 Kingfisher Loop, Naples, FL 34120 Date of Hearing Notice by Certified Mail: 7/10/23 Officer Scavone requested the hearing. The Stipulation was entered into by the Respondent’s representative Tyler Panariello on July 27, 2023. Special Magistrate Neale, fining the Notice of Hearing was properly served, found the Respondent GUILTY of the alleged violation and ordered them to: 1. Pay Operational Costs in the amount of $50.00 incurred in the prosecution of the case. 2. Pay an Administrative Fee of $5.00 and a Civil Penalty of $7,500.00 for a total amount due of $7,555.00 payable within 30 days of this hearing. Total Amount Due: $7,555.00 3. CASE NO: CEEX20230006188-PU-5784 OWNER: LENNAR HOMES LLC OFFICER: Kenneth Thompson VIOLATIONS: Collier County Code of Laws and Ordinances, Chapter 134, Article VI, Section 134-174(N). A PVC pipe was connected to the Collier County owned curb stop. The pipe was removed by Collier County, Health, Safety and Welfare issue. FOLIO NO: 69039017940 PROPERTY ADDRESS: 2664 Vine Ave, Naples, FL 34120 Date of Hearing Notice by Certified Mail: 7/17/23 Officer Thompson requested the hearing. The Stipulation was entered into by the Respondent’s representative Jack Turno on July 25, 2023. Special Magistrate Neale finding the Notice of Hearing was properly served, found the Respondent GUILTY of the alleged violation and ordered them to: 1. Pay Operational Costs in the amount of $50.00 incurred in the prosecution of the case. August 4, 2023 7 2. A broken, deteriorated, and obstructed galvanized culvert pipe in a driveway, abutting improved occupied residential property. The Stipulation was entered into by Armando Mendez on July 18, 2023. Special Magistrate Neale finding the Notice of Hearing was properly served, found the Respondent GUILTY of the alleged violation was ordered to: 1. FOLIO NO: 388200001 PROPERTY ADDRESS: 7 Grouper Dr, Naples, FL 34112 Date of Hearing Notice by Certified Mail: 7/12/23 Date of Property/Courthouse Posting: 7/12/23 Supervisor Mucha requested the hearing. The Stipulation was entered into by Jo Ann Woods on July 27, 2023. Unpermitted concrete block deck built on association property. FOLIO NO: 00725720005 PROPERTY ADDRESS: 1008 Dockside Ct, Naples, FL 34114 Supervisor Mucha represented the County. Carlos Fernandez, Property Manager, Arturo Arguelles, General Contractor and Yesenia Moncada, unit owner represented the Respondent. Discussion occurred on the exact address for the violation and who is responsible to execute the Stipulation and abate the violation (the Association vs. the unit owner) given the deck was constructed by an owner on common lands. Mr. Arguelles noted there are many decks installed at the rear of units within the Association on common lands and at this point, this is the only one cited as a violation. The Association Members generally agree they should be allowed but is required to undertake the necessary legal steps to permit them on the common lands. Dominic Lucarelli, son of Angelo and Gail reported they have been searching for the most cost effective means to remove the infestation. They were not allowed to utilize machinery or kill the vegetation in place. One avenue was using platforms for the machinery which was cost prohibitive. Mike Delate of Q. Grady Minor testified:  The firm was engaged a year ago and they are working on development permits for the site.  Applications have been filed with the Florida Department of Environmental Protection, and the South Florida Water Management District given the site contains wetlands.  The goal is to minimize mediation costs. If the exotics are removed, the wetlands will be valued higher under the permit processing, penalizing the Lucarelli’s.  He anticipates permits will not be issued for at least 4 – 6 months based on the current workload of the agencies. Mr. Brown agreed with Mr. Delate’s assessment of the permit process. Special Magistrate Neale noted a Stipulation was signed by the Lucarelli’s in August of 2019 and a Vegetation Removal Permit issued by the County in May of 2020. The Stipulation was not complied with. Mr. Lucarelli noted they were unaware of the permit restrictions and costs associated with removal of the vegetation and should not have signed the Stipulation at the time.
