K.1 08/08/2023 EXECUTIVE SUMMARY Recommendation to nominate and appoint an at -large member to the County Government Productivity Committee. OBJECTIVE: To nominate and appoint one at -large member to the County Government Productivity Committee, to fill its current vacancy. CONSIDERATIONS: This committee reviews the efficiency of departments and divisions of county government under the jurisdiction of the Board of County Commissioners, in order to assure taxpayers that tax dollars are being used appropriately and that waste of tax dollars is avoided. The committee annually reports its findings and recommendations to the BCC. The committee is composed of eleven members: one member from each of the Commission districts, and six members at -large. Candidates for the district seats must be nominated by the Commissioner of the district they reside in; at -large candidates may be nominated by any Commissioner. Terms are two years. A list of the current membership is included in the backup. Michael Dalby resigned from the committee on May 3, 2023 due to an out-of-state move, leaving an at -large seat vacant on the committee. The vacancy was advertised and applications were received from the following: APPLICANT DISTRICT VOTER ADVISORY COMMITTEES Donald Coates 1 Yes None Jesse Katzeff 4 Yes None COMMISSIONER NOMINATION: Concerning nomination and appointment of at -large members, Ordinance No. 21-16 states that "...Committee candidates for the five County Commission District seats must be nominated by the Commissioner of the District in which the candidate resides for both initial and subsequent terms and receive a simple majority vote of the Board of County Commissioners. The six at -large members can be nominated by any Commissioner, but must receive a four -fifths vote of the Board of County Commissioners for appointment or reappointment..." If a Commissioner wishes to nominate someone other than the two applicants, it is my recommendation that the matter be pulled from the Consent Agenda and continued to allow the nomination. If not, and the Board is satisfied with the Committee's recommendation, the matter can simply stay on Consent. COMMITTEE RECOMMENDATION: On July 20, 2023, the committee reviewed the above applications and unanimously recommended the appointment of Mr. Coates to fill the current at -large vacancy. A recommendation email is included in the backup. The current vacant term to be filled will expire on March 9, 2024. There are 7 months remaining in the term. When an advisory board vacancy to be filled is for a partial term instead of a full term, the applicant is appointed to fill the remainder of the vacant term. If the term remaining is 6 months or less, our custom has been to appoint the member to the remainder of the vacant term plus a full term following it, to avoid having the member need to reapply again so soon after having been appointed, and to reduce the administrative tasks involved in bringing the appointment back to the Board again within a very short time. In this case the remainder of the term is 7 months instead of 6 months, but for the same reasons we recommend that Mr. Coates be appointed for the remainder of the current term plus an additional full term of two years, resulting in a term expiration date of March 9, 2026. FISCAL IMPACT: None. GROWTH MANAGEMENT IMPACT: None. LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires supermajority vote for Board approval. -JAK Packet Pg. 944 16.
