EXECUTIVE SUMMARY
Recommendation to direct staff to advertise an Ordinance adding a non -voting member of the Affordable
Housing Advisory Committee (AHAC) to the Development Services Advisory Committee (DSAC).
OBJECTIVE: To allow a member of the Affordable Housing Advisory Committee to be appointed as a non-
voting member of the Development Services Advisory Committee to better facilitate dialogue amongst the
development community and advocates for affordable housing to address the attainable housing needs in Collier
County and improve cross -communication between the committees.
CONSIDERATIONS: DSAC's primary purpose is to provide the Board of County Commissioners ("Board") with
technical, professional, financial, business, or administrative expertise and to provide recommendations to assist the
Board in the enhancement of operational efficiency and budgetary accountability within the Growth Management
Community Development Department (GMCDD); additionally DSAC serves as the primary communication link
between GMCDD, the development industry, and the citizens of Collier County. By ordinance, the membership of
DSAC represents various aspects of the development industry and includes an architect, general contractor,
residential or building contractor, environmentalist, land planner, land developer, landscape architect, professional
engineer, licensed contractor, and attorney. A secondary consideration in appointing members to DSAC is to have
advisory members that reflect the entire demographic and geographic population of Collier County.
The mission of AHAC is to review and make recommendations to the Board regarding the local housing
affordability options and incentives, evaluate established policies, procedures, ordinances, land development
regulations, and Collier County's Growth Management Plan.
By adding a non -voting representative from AHAC to DSAC, dialogue amongst the development community and
advocates for affordable housing will be better facilitated, and cross -communication between the committees will
be improved, to help address the affordable housing crisis in Collier County. Additionally, this will provide for
consistent messaging from the advisory boards to the Board and citizens of Collier County.
FISCAL IMPACT: There is no fiscal impact associated with this action.
GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact associated with this action.
LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires a majority vote for
Board approval. -DDP

WHEREAS, the Board of County Commissioners of Collier County ("Board") seeks to

WHEREAS, the Development Services Advisory Committee was established by

NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
SECTION ONE: Amending Section Two of Ordinance No. 93-76, as amended,
Appointment and Composition [of the Development Services Advisory
Committee].
(a) The development services advisory committee shall be composed of 4-5 16
members.
(b) Members shall represent the various aspects of the development industry with one
or more members from each of the following classifications: architect, general
contractor, residential or builder contractor, environmentalist, land planner,
land developer, landscape architect, professional engineer, utility contractor,
plumbing contractor, electrical contractor, structural engineer, a non -voting
member of the Affordable Housing_ Advisory Committee, and attorney. In the event
that members cannot be secured filling all the classifications listed above, other
individuals may be considered.

SECTION TWO: Inclusion in the Code of Laws and Ordinances.
The provisions of this Ordinance shall become and be made a part of the Code of
Ordinances of Collier County, Florida. The sections of this Ordinance may be renumbered or
relettered to accomplish such, and that the word "ordinance" maybe changed to "section,"
"article," or other appropriate word or phrase necessary to accomplish such intentions.
SECTION THREE: Conflict and Severability.
In the event this Ordinance conflicts with any other Ordinance of Collier County or other
applicable law, the more restrictive shall apply. If any court of competent jurisdiction holds any
phrase or portion of this Ordinance invalid or unconstitutional, such portion shall be deemed a
separate, distinct, and independent provision and such holding shall not affect the validity of the
remaining portion.
SECTION FOUR: Effective Date.
This Ordinance shall become effective upon filing with the Department of State.
PASSED AND DULY ADOPTED by the Board of County Commissioners of Collier
County, Florida, this day of 2023.

originally established by the County Manager in 1987 and has been
meeting regularly since that time; and
WHEREAS, Collier County Ordinance No. 86-41, as amended, sets
forth the requirements for creating County advisory boards.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
The Collier County Development Services Advisory Committee is
hereby created -to provide reports and recommendations to the Board
of County Commissioners to assist in the enhancement of
operational efficiency and budgetary accountability within the
Community Development Services Division and to serve as a prim--ry
communication link between the Community Development Services
Division, the development industry and the citizens of Collier
County. `
A. The Committee shall be composed of fifteen (15) members.
B. Members shall represent the various aspects of the

SECTION FOUR, Removal From Office: Failure to Attend Meetings.
A. Any member of the Committee may be removed from office,

B. In the event that any Committee member is absent from two

(2) consecutive Committee meetings without a satisfactory excuse

acceptable to the Committee Chairman, the Committee Chairman shall
state such fact at the next regularly scheduled Committee meeting
and shall thereafter notify, in writing, the Community Development
Administrator or his Designee of the Committee member's failure to
attend without satisfactory excuse. The Board of County
Commissioners shall review the Committee Chairman's notification
at a County Commission meeting and shall declare the Committee

member's position to be vacant if the Commission concurs that the

Committee member was absent from two (2) consecutive Committee
P. meetings without a satisfactory excuse and shall promptly fill the
vacant position. The Committee member shall not serve at any
meetings after his or her position is declared vacant.
C. If any member of the Committee is absent for more than
one-half of the Committee's meetings in a given fiscal year, it
shall be deemed that the member has tendered his resignation from
such Committee. The Board of County Commissioners shall as soon
' as practicable after such resignation, declare the position to be
vacant and shall promptly act to fill the vacancy. The Committee
member shall not serve at any meetings after his position has been
declared vacant by the Board of County Commissioners.
D. A member of the Committee shall be deemed absent from a
meeting when he/she is not present during at least 75% of the
meeting.
SECTION FIVE. Officers• Quorum: Rules of Procedure.
A. Annually the membership of the Committee shall elect a
chairman and vice chairman from among the members. Officers'
terms shall be for one (1) year with eligibility for re-election.
B. The presence of eight (8) or more members shall
constitute a quorum. A majority vote of those members present is
necessary to take action and transact business.
C. The Committee shall, by majority vote of the entire
membership, adopt rules of procedure for the transaction of
business and shall keep a written record of meetings, resolutions,
findings and determinations. Copies of all Committee minutes,
resolutions, reports, and exhibits shall be submitted to the
Board of County Commissioners.
b. Clerical and reasonable staff support shall be provided
by the Collier County Development Services Division.
SECTION SIX. Reimbursement of Expenses.
Members of the Committee shall serve without compensation,

but shall be entitled to receive reimbursement for expenses
reasonably incurred in the performance of their duties upon prior
approval of the Board of County Commissioners.
,SECTION SEVEN. Functions. Powers and Duties of the Committee.
The functions, powers and duties of the Committee shall be as
follows:
A. To serve as a primary communication link between the
Community Development Services Division and the development
industry, which includes Environmentalists, Designers,
Developers and Contractors involved in both site work and
building construction.
B. To make recommendations as to rules and procedures
to enhance the operational efficiency and budgetary
accountability which may include plan review, permit
issuance, inspections, code enforcement, contractor
licensing, facility improvements and building and development
related fees.
C. To identify concerns of the development industry
and present them at regularly scheduled Advisory Committee
meetings.
D. To provide input to staff regarding the creation of
new rules, processes and procedures associated with the
development industry.
E. To increase the awareness of adopted building and
development standards by promoting development industry
educational programs.
F. To prepare and recommend to the Board of County
Commissioners technical and administrative programs designed
to enhance the proficiency and customer services of the
Community Development Services Division.
G. To develop an Advisory Committee monitoring program
of the key review activities of the Division for the purpose
of providing continuing feedback on both the quality and

quantity of services rendered by the Division.
H. To design a Technical Review/Customer Service
^� evaluation form for response by users of the Community
Development Services Division.
I. To submit an annual report to the County Manager
and the Board of County Commissioners which shall summarize
findings and issues during the report year and the status of
their resolution.
'., J. Review proposed ordinances and codes that may affect
the Community Development Services Division prior to their
submittal to the Board of County Commissioners for approval.
K. To perform or assist with any other function or duty
as requested by the County Manager or the Board of County
Commissioners.
L. The Committee may adopt and amend "Guidelines" to
govern their meetings and operations, subject to the approval
of the Board of County Commissioners.
�! M. The Committee meetings shall be open to the public.
SECTION EIGHT. Duties of the Community Development Services
Division Administrator or His Designee.
The duties of the Community Development Services Division
Administrator or his Designee shall be:
A. To administer the activities of the Collier County
Development Services Advisory Committee in accordance with
established policies and guidelines of the Board of County
Commissioners.
B. To provide technical information, county operational
procedures and support relative to the community development
activities of the Community Development Services Division.
C. To assure that all reports, studies, plans, etc. are
forwarded to the County Manager and the Board of County
Commissioners for their review.
D. To attend, or have his Designee attend, all Collier

County Development Services Advisory Committee meetings.

SECTION NINE. Review Process,
This Committee shall be reviewed once every four (4) years
commencing in 1997, in accordance with the procedures contained in
Collier County Ordinance No. 86-41, as amended.
SECTION TEN. Conflict and Severability.
In the event this Ordinance conflicts with any other
ordinance of Collier County or other applicable law, the more
restrictive shall apply. If any phrase or portion of this
Ordinance is held invalid or unconstitutional by any court of
competent jurisdiction, such portion shall be deemed a separate,
distinct and independent provision and such holding shall not
affect the validity of the remaining portion.
,SECTION ELEVEN. Effective Date.
This ordinance shall become effective upon receipt of notice
from the Secretary of State that this Ordinance has been filed
with the Secretary of State.

A. Six (6) members to serve for two (2) years.
B. Five (5) members to serve for three (3) years.
C. Four (4) members to serve ?or four (4) years.
There after, each appointment or re -appointment shall be
for a term of four (4) years. Terms of office shall be limited
to two (2) consecutive terms of service. Appointments to fill
any vacancies on the Committee shall be for the remainder of the
unexpired term of office.
SECTION FOUR, Removal From Office: Failure to Attend Meetings.
A. Any member of the Committee may be removed from
office, with or without cause, by a majority vote of the Board
of County Commissioners.

B. In the event that any Committee member is absent from
two (2) consecutive Committee meetings without a satisfactory
excuse acceptable to the Committee Chairman, the Committee
Chairman shall state such fact at the next regularly scheduled
Committee meeting and shall thereafter notify, in writing, the
Community Development Ausl Environmental services Administrator
or his designee of the Committee member's failure to attend
without satisfactory excuse. The Board of County Commissioners
shall review the Committee Chairman's notification at a County
commission meeting and shall declare the Committee member's
position to be vacant if the Commission concurs that the
Committee member was absent from two (2) consecutive Committee
meetings without a satisfactory excuse and shall promptly fill
the vacant position. The Committee member shall not serve at
any meetings after his or her position is declared vacant.
C. If any member of the Committee is absent for more than
one-half of the Committee's meetings in a given fiscal year, it
shall be deemed that the member has tendered his resignation
from such Committee. The Board of County Commissioners shall as
soon as practicable after such resignation, declare the position
to be vacant and shall promptly act to fill the vacancy. The
Committee member shall not serve at any meetings after his
position has been declared vacant by the Board of County
Commissioners.
D. A member of the Committee shall be deemed absent from a
meeting when he/she is not present during at least 751 of the
meeting.
sECTION FIVE. Officers: Quorum: Rules of Procedure.
A. Annually the membership of the Committee shall elect a
chairman and vice chairman from among the members. Officers'
terms shall be for one (1) year with eligibility for
re-election.

B. The presence of eight (8) or more members shall
constitute a quorum. A majority vote of those members present
is necessary to take action and transact business.
C. The Committee shall, by majority vote of the entire
membership, adopt rules of procedure for the transaction of
business and shall keep a written record of meetings,
resolutions, findings and determinations. Copies of all
Committee minutes, resolutions, reports, and exhibits shall be
sufsmitted to the Board of County Commissioners.
D. Clerical and reasonable staff support shall be
provided by the Collier County Community Development Aad
Environmental Services Division.
SECTION SIX. Reimbursement of E menses.
Members of the Committee shall serve without compensation,
but shall be entitled to receive reimbursement for expenses
reasonably incurred in the performance of their duties upon
prior approval of the Board of County Commissioners.
SECTION SEVEN. Functions Powers and Duties of the Committee
The functions, powers and duties of the Committee shall be
as follows:
A. To serve as a primary communication link between
the Community Development and Fnvironmental Services
Division and the development industry, which includes
Environmentalists, Designers, Developers and Contractors
involved in both site work and building construction.
B. To make recommendations as to rules and procedures
to enhance the operational efficiency and budgetary
accountability which may include plan review, permit
issuance, inspections, code enforcement, contractor
licensing, facility improvements and building and
development related fees.

C. To identify concerns of the development industry
and present them at regularly scheduled Advisory Committee
meetings.
D. To provide input to staff regarding the creation
of new rules, processes and procedures associated with the
development industry.
E. To increase the awareness of adopted building and
development standards by promoting development industry
educational programs.

designed to enhance the proficiency and customer services
of the Community Development and Environmental Services

G. To develop an Advisory Committee monitoring
program of the key review activities of the Division for
the purpose of providing continuing feedback on both the
quality and quantity of services rendered by the Division.

evaluation form for response by users of the Community
Development Services Division.
I. To submit an annual report to the County Manager
and the Board of County Commissioners which shall summarize
findings and issues during the report year and the status
of their resolution.
J. Review proposed ordinances and codes that may
affect the Community Development and Environmental Services
Division prior to their submittal to the Board of County
Commissioners for approval.
K. To perform or assist with any other function or
duty as requested by the County Manager or the Board of
County Commissioners.

Ordinance is held invalid or unconstitutional by any court of
competent jurisdiction, such portion shall be deemed a separate,
distinct and independent provision and such holding shall not
affect the validity of the remaining portion.
