EXECUTIVE SUMMARY
Recommendation to approve Change Order No. 1 adding fifty-eight (58) days to Agreement No. 21-7883-ST
(CMAR), Main Campus Chiller Plant Upgrades, with O-A-K/Florida, Inc. d/b/a Owen -Ames -Kimball Company and
authorize the Chairman to sign the attached change order. (Projects 50214 and 50189)
OBJECTIVE: To provide a fifty-eight (58) day time extension relative to pre -construction services for the Main
Campus Chiller Plant project under a Construction Manager at Risk (CMAR) agreement with O-A-K/Florida, Inc.
d/b/a Owen -Ames -Kimball Company.
CONSIDERATIONS: On May 10, 2022, the Board awarded Agreement No. 21-7883-ST (the "Agreement") to
the top -ranked firm, O-A-K/Florida, Inc. d/b/a Owen -Ames -Kimball Company ("O-A-K"), for a CMAR agreement
for the Main Campus Upgrades (Agenda Item No. 16.C.4). A CMAR is a project delivery method that entails a
commitment by the Construction Manager to deliver a project within a Guaranteed Maximum Price ("GMP"),
which is based on the construction documents and specifications at the time the GMP is determined, plus any
inferred items or tasks.
On May 24, 2022, the County issued a Notice to Proceed to O-A-K/Florida, Inc, and a final completion date for the
pre -construction services by March 18, 2023. On November 15, 2022, a stop work letter was issued for this project.
On March 16, 2023, the project was reactivated leaving 123 days remaining on contract and ultimately extending
the final completion date to July 17, 2023.
On September 28, 2022, Hurricane Ian made landfall near Fort Myers, Florida. This event caused a delay of the
change order that was in process to add additional time to amend the design for the New Chiller Plant Building K
project, the main component of the Main Campus Upgrades.
On November 17, 2022, staff issued the change order for the New Chiller Plant, Building K project. The by-product
of that change order required an extension of the time needed for pre -construction services. A change order to the
Agreement with O-A-K is necessary to add additional time for pre -construction services to accommodate for the
development of the GMP for construction services.
FISCAL IMPACT: There is no new fiscal impact associated with this Executive Summary. Funding is available
in the Infrastructure Sales Tax, Fund (3018), Projects 50214 and 50189.
GROWTH MANAGEMENT IMPACT: There is no impact to the Growth Management Plan associated with
this Executive Summary.
LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires majority vote for
Board approval. -SRT
