EXECUTIVE SUMMARY
Recommendation that the Board of County Commissioners, as ex-officio the Governing Board of the Collier
County Water -Sewer District, approve a Work Order to Quality Enterprises USA, Inc., pursuant to a
Request for Quotation ("RFQ") under Agreement No. 20-7800 for the "Eagle Lakes Meter Assemblies
Replacement and Improvements" project, in the amount of $599,123, and authorize the Chairman to sign
the Work Order. (Project No. 70166.20)
OBJECTIVE: To meet demand, stay in compliance, and serve customers efficiently by providing a compliant and
reliable irrigation quality system.
CONSIDERATIONS: The proposed scope of work under Project No. 70166.20, "Eagle Lakes Meter Assemblies
Replacement and Improvements Project," is consistent with the FY2023 Budget approved by the Board on
September 22, 2022.
The Eagle Lakes pond complex is a man-made wetland that is operated under permit # FLA141356-003. There are
three ponds in the Eagles Lake Park that are managed under that permit, and those ponds are all filled using treated
effluent water from the South County Water Reclamation Facility ("SCWRF"). Those ponds are known as ponds
A, B and C. Ponds A and B are maintained as wetlands and pond C is used for storage and disposal of treated
effluent water. As designated wetlands, the permit governing ponds A and B requires the County to maintain lower
water levels during the dry season and deeper water levels in the wet season to parallel a natural occurring system.
The SCWRF monitors the water levels in each of the ponds and fills each pond to the required seasonal level. The
proposed project will enable the capability to monitor flows to each pond to maintain the wetland conditions
required under the Florida Department of Environmental Department's Environmental Resource Program. It will
also reduce the infrastructure footprint, make needed improvements to the controls and electrical infrastructure, as
well as address previous pipe leaks/repairs to prevent future leaks.
On February 22, 2023, the Engineering and Project Management Division sent an e-mail to all nine firms under
contract with the County under Agreement No. 20-7800 for "Underground Contractor Services" requesting a quote
for the construction of the Eagle Lakes Meter Assemblies Replacement and Improvements project. The County
received quotes back from three of the contractors by the March 17, 2023, deadline as summarized below.

No quotes were received from PWC Inc., Southwest Utilities Inc., Kyle Construction Inc., Mitchell & Stark
Construction Inc., Haskins Inc., and Cougar Construction. A subsequent e-mail was sent to those six contractors
requesting the reason for them not submitting a quote. Of the six contractors who did not submit a quote, four
responded in the following manner: three stated they did not provide a quote due to their current workload, and one
stated they did not think they would be able to complete/perform the job in a timely manner acceptable to Collier
County. The other remaining two contractors did not respond to the County's email requesting their reason for not
submitting a quote.
Staff determined all the bidders to be responsive and responsible and found Quality Enterprises USA, Inc. ("Quality
Enterprises"), a Collier County company, to be the lowest responsive and responsible bidder.
Staff and engineering consultant, Tetra Tech, Inc., determined the lowest bid is fair and reasonable, and staff
recommends awarding the work order to Quality Enterprises. Quality Enterprises' quote is approximately 26.9%
above the engineering consultant's $472,000.00 opinion of probable cost. Tetra Tech stated that the reason the low

quote exceeded its opinion of probable cost was because current market conditions are still volatile due to ongoing
inflation, which is impacting all business sectors, along with the high volume of construction projects that are
currently in progress or are starting that also contributes to higher construction costs."
Quality Enterprises USA, Inc., is a corporation established fifty years ago, has been authorized to transact business
in the State of Florida since May 25, 1995, and has performed work on many Collier County Public Utilities'
projects over the last several decades.
Because there may be unforeseen conditions associated with the project, the solicitation incorporated an owner's
allowance of $50,000. The price for any additional work that will utilize this allowance will be negotiated prior to
commencement in accordance with the County's Procurement Ordinance and the terms of the Agreement.
Agreement No. 20-7800 requires all Work Orders issued over the amount of $500,000 be approved by the Board,
and that the awarded contractor on projects over $200,000 provide payment and performance bonds prior to the
issuance of the Work Order and the commencement of work. Subject to the Board's approval of this item, payment
and performance bonds in the quoted amount are attached as backup to this item.
FISCAL IMPACT: Funding in the amount of $599,123 for the Work Order is available in the Sewer User Fee
Capital Fund (414). The project is expected to be completed in early FY 2024. There is no anticipated change in
operating costs.
GROWTH MANAGEMENT IMPACT: This project meets current Growth Management Plan standards to
ensure the adequacy and availability of viable public facilities.
LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires majority vote for
Board approval. -SRT
RECOMMENDATION: That the Board, as ex-officio the Governing Board of the Collier County Water -Sewer
District, approve a Work Order to Quality Enterprises USA, Inc., pursuant to a Request for Quotation under
Agreement No. 20-7800 for the "Eagle Lakes Meter Assemblies Replacement and Improvements" project, in the
amount of $599,123, and authorize the Chairman to sign the attached Work Order.

Any changes in or under the Contract and compliance or noncompliance with any formalities
connected with the Contract or the changes do not affect sureties' obligation under this Bond
The provisions of this bond are subject to the time limitations of Section 255.0592. In no event
will the Surety be liable in the aggregate to claimants for more than the penal sum of this Payment
Bond, regardless of the number of suits that may be filed by claimants.

THE CONDITION OF THIS BOND is that if Principal
t. Performs the Contract at the times and in the manner prescribed in the Contract, and
2 Pays Oblige any and all losses. damages, costs and attorneys' fees that Oblige sustains because of
any default by Principal under the Contract, including, but not limited to, all delay damages, whether
liquidated or actual, incurred by Oblige, and
3 Performs the guarantee of all work and materials furnished under the Contract for the time specified
in the Contract, then this bond is void; otherwise it remains in full force. Any changes in or under the
Contract and compliance or noncompliance with any formalities connected with the Contract or the
changes do not affect Sureties obligation under this bond.
The Surety, for value received; hereby stipulates and agrees that no changes, extensions of time.
alterations or additions to the terms of the Contract or other work to be performed hereunder, or the specifications
referred to therein shall in anywise affect its obligations under this bond, and it does hereby waive notice of any
such changes, extensions of time, alternations or additions to the terms of the Contract or to work or to the
specifications.
