Agenda 07/11/2023 Item #16A1 (Final acceptance and approval of utility easement for Meadowood- Phase 1)16.A.1 07/ 11 /2023 EXECUTIVE SUMMARY Recommendation to approve final acceptance and accept the conveyance of the potable water and sewer utility facilities and appurtenant utility easement for Meadowood - Phase 1, PL20200001183, and authorize the County Manager, or designee, to release the Final Obligation Bond in the total amount of $4,000 to the Project Engineer or the Developer's designated agent. OBJECTIVE: To have the Board of County Commissioners, as Ex-Officio Governing Board of the Collier County Water -Sewer District, approve final acceptance and accept the conveyance of these potable water and sewer facilities and to release the Final Obligation Bond in the total amount of $4,000, in accordance with the Collier County Utility Standards and Procedures, Ordinance No. 2004-31. CONSIDERATIONS: 1) The Developer of Meadowood - Phase 1, has constructed the potable water and sewer facilities within dedicated easements to serve this development. (See attached location map). The potable water and sewer facilities were offered for conveyance to the County, as described in O.R. Book 5820, Page 1169, together with the appurtenant Deed of Utility Easement recorded in O.R. Book 5820, Page 1178, and located within County utility easements dedicated by the plat of Meadowood, recorded in Plat Book 66, Pages 65-69, of the Public Records of Collier County, Florida. 2) Preliminary acceptance of these utility facilities was approved by the Development Review staff on September 09, 2020. At that time, the value of these potable water and sewer utility facilities (assets) was $74,257.90 and $338,848.20, respectively. 3) Staff recorded all final acceptance documents associated with the facilities being conveyed to the County in the public records of Collier County, which were reviewed and approved by the County Attorney's office as to form and legality. The County acquired its interest in the potable water and sewer facilities by Utilities Facilities Warranty Deed and Bill of Sale recorded in O. R. Book 5820, on page 1169 ("the Utilities Facilities Deed"). 4) The potable water and sewer utility facilities have been operated and maintained during the required one (1) year warranty period, following preliminary acceptance. 5) A final inspection to discover defects in materials and workmanship was conducted by the Development Review staff on May 26, 2023, in coordination with Public Utilities and these facilities have been found to be satisfactory and acceptable. 6) Staff recommends final acceptance of the subject utility facilities and to release the Final Obligation Bond in the total amount of $4,000. Staff also recommends acceptance of the Utilities Facilities Deed and the facilities described therein. 7) This final acceptance is in accordance with Collier County Ordinance No. 2004-31, as amended. 8) Staff is unaware of any issues that would serve to negate the recommendation to release the applicable security. FISCAL IMPACT: Approval of this Executive Summary will result in the Collier County Water -Sewer District receiving title to the utility facilities, which at the time of preliminary acceptance, had a total gross value of $413,106.10 (no depreciation applied) and an asset will be recorded in the financial records of the county. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action.
