EXECUTIVE SUMMARY
Recommendation that the Board of County Commissioners determine a valid public purpose and authorize
payment, in the amount of $675, for Collier County Planning Commissioner, Joseph Schmitt, to attend the
Florida Chamber of Commerce 36th Annual Environmental Permitting Summer School, an Environmental
Permitting Seminar for the dates of July 18-21, 2023.
OBJECTIVE: To have the Board of County Commissioners (BCC) determine a valid public purpose and
authorize payment for Collier County Planning Commissioner (CCPC) Schmitt, to attend the Florida Chamber of
Commerce 36th Annual Environmental Permitting Summer School.
CONSIDERATIONS: Section 250-33(c)(3) of the Code of Laws (special act) provides:
"(3) Members of a planning commission may receive salary and such travel and other expenses while on official
business for the commission as are made available by the governing body for these purposes." In addition, Section
2-1160 of the Code of Laws (regarding the Planning Commission) provides: "The members of the Planning
Commission shall serve without compensation, but may be reimbursed for such travel, mileage, and/or per diem
expenses as may be authorized by the BCC."
Section 106-1(f) of the Code of Laws (regarding the land planning agency) provides:
"(f) Compensation. The members of the local planning agency shall serve without compensation but may be
reimbursed for such travel, mileage, and/or per diem expenses as may be authorized by the BCC. The BCC shall
appropriate funds at its discretion to the local planning agency for expenses necessary in the conduct of its work.
The local planning agency may, to accomplish the purposes and activities required by the Local Government
Comprehensive Planning and Land Development Regulation Act (F.S. § 163.3161 et seq.), expend all sums so
appropriated and other sums made available for use from fees, gifts, state or federal grants, state or federal loans,
and other sources; provided, acceptance of loans or grants must be approved by the board of county
commissioners."
PUBLIC PURPOSE: It should be noted that the CCPC also sits as the Environmental Advisory Council (EAC)
which is an advisory board to the BCC. In accordance with Section 2-1157 of the Collier County Code of Laws and
Ordinances, Joseph Schmitt was specifically appointed to fill one of the two CCPC membership positions that are
required to provide environmental technical expertise. This provision specifically requires that these two CCPC
members provide the Planning Commission with technical expertise on environmental matters, and shall
demonstrate evidence of expertise in one or more of the following areas related to environmental protection and
natural resources management that includes the following:
Biology (including botany, ecology, zoology, etc.).
Coastal processes, estuarine processes, hazardous waste, hydrogeology.
Pollution control, solid waste, stormwater management, water resources, wildlife
management, or other representative area deemed appropriate by the BCC, with a
Board preference for one of these members with expertise in biology and/or
wildlife management, and the other with expertise in water and/or hydrology.
As one of the two CCPC membership positions that are required to provide environmental technical expertise,
Joseph Schmitt's attendance at the Environmental Resource Permitting Seminar would be in support of his
activities on the CCPC/EAC. This seminar is comprised of 10 sessions. At each session, there are between 6-9
course choices providing insight into the regulatory, planning, and water supply development programs of Florida's
five water management districts that include Collier County. Other courses involve water resource development and
water supply planning that can assist in developing land use regulations for the County. This seminar will also
include updates on environmental permitting and enforcement that can have a direct bearing on the CCPC as the
local planning agency and in their role as the County's Environmental Advisory Council. The relevant classes
include the following topics:

• Federal Environmental Regulation and Enforcement Update
• Strategic Planning and Permitting For Development
• WMD Planning, Regulatory, and Policy Update

• Improving Coastal Resiliency in Response to the Threats of Sea Level Rise and
Climate Change
It should also be noted that Planning Commissioner Schmitt is employed by an environmental consulting firm that
does business in Collier County and that he may have a proprietary interest in the environmental consulting firm.
FISCAL IMPACT: The registration fee of $675 is to be paid from the Collier County Planning Commssioner's
travel budget, Fund 1014 Cost Center 138326.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action.
LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires a majority vote for
Board approval. -DDP
RECOMMENDATION: To approve a payment, in the amount of $675, for Planning Commissioner Schmitt to
attend the Florida Chamber of Commerce 36th Annual Environmental Permitting Summer School, an
Environmental Permitting Seminar for the dates of July 18-21, 2023, a function serving a valid public purpose.

Registration fee includes course materials from sessions accessible from SCHED (your on line conference scheduling program), continental breakfasts,

on Tuesday, July 18 from 1:00 - 5:00 p.m. Early Birds cannot be taken as a stand alone course. Summer School attendees can attend one of the early
bird discussion sessions for an additional fee of $100.

SUBSTITUTIONS WELCOMED
Continuing Education
FLORIDA BAR - Summer School participants will have the opportunity to earn Continuing Legal Education credits through the Florida Bar's Designation
Plan. The summer school has applied for approval for 25 hours of general credit, plus an additional 9 credits for those attending the "early bird"
discussion session "B" in the area of ethics (5 credits) and technology (4 credits). Course number and details on receiving these credits will be listed in
the conference program which will be distributed to attendees at the conference.
ENGINEERS - Florida Environmental Network, Inc. is an approved provider (0003339) of continuing education credits for registered engineers through
the Florida Board of Professional Engineers. Engineers can receive 20 PDHs by attending the Summer School program. Applicable forms will be available
at the conference for those wishing to apply for credit. In addition, the Board of Engineers requires 1 hour of credit for Board Laws and Rules and 1
hour of credit for Ethics. You can obtain the Board Laws and Rules and Ethics credit by attending Early Bird Session "A".
LICENSED ENVIRONMENTAL PROFESSIONALS - This course has qualified for continuing education (CE) credits through the International Society of
Technical and Environmental Professionals, Inc. (INSTEP). Credits apply to those currently registered by this association. Participants will receive 1 CE
credit for every actual hour of instruction. LEP's may enter their credits on the LEP Center Section of the INSTEP website.
