Agenda 06/27/2023 Item #16F 6 (3rd Extension and Amendment to Interlocas Agreement w/City of Naples for Beach Parking facilities and park recreation programs through September 30, 2023)16.F.6 06/27/2023 EXECUTIVE SUMMARY Recommendation to approve the Third Extension and Amendment to Interlocal Agreement between Collier County and the City of Naples governing use of City of Naples beach parking facilities and park and recreation programs extending the term to September 30, 2023. OBJECTIVE: To continue the Beach Parking and Recreation arrangement enjoyed by the City of Naples and the County. CONSIDERATIONS: On November 18, 2008, Collier County and the City of Naples entered into an Interlocal Agreement ("Interlocal") allowing residents from the unincorporated Collier County to use and enjoy all of the City's parks, recreational facilities, and recreational programs on the same basis as those afforded to City residents in exchange for an annual base payment of $1,000,000 (adjusted each fiscal year by an adjustment factor). On November 14, 2017, Collier County and the City of Naples entered into an Extension and Amendment to the Interlocal extending the term to September 30, 2022 and increasing the payment to $1,500,000 for the fiscal years within the extended term. On September 13, 2022, Collier County and the City of Naples entered into a Second Extension and Amendment to the Interlocal further extending the term to June 30, 2022. This amendment maintained the total annual payment of $1,500,000, but modified the payment schedule to a monthly basis. This item proposes a Third Amendment and Extension to further extend the term to September 30, 2023 with no renewal period. No other modifications are proposed. On June 21, 2023, the City of Naples City Council approved the proposed Third Amendment and Extension. A City of Naples executed agreement was not available by the time of publication of this item. If this item is approved by the Board, the City of Naples signed agreement will be routed through the County Attorney's Office for Board Chair signature. FISCAL IMPACT: Approval of the Third Amendment and Extension will result in three additional monthly payments to the City of Naples totaling $375,000. The County will continue to remit monthly payments on the 25th of each month in the amount of $125,000 through September, for a total annual amount of $1,500,000. GROWTH MANAGEMENT IMPACT: There is no impact to the Growth Management Plan. RECITALS: WHEREAS, residents from the unincorporated areas of Collier County currently enjoy recreating within facilities owned and operated by the City of Naples, including but not limited to, Fleischman Park and beach areas and related parking areas within the City of Naples; and WHEREAS, the parties have over the years entered into separate interlocal agreements concerning the City's Parks and Recreational areas, including but not limited to an Interlocal Agreement for City -County Beach Parking, recorded at OR Book 3563, Pg 1889, which agreement expired September 8, 2008; and WHEREAS, Collier County and the City wish to enter into a long term agreement which would allow residents from unincorporated Collier County to use and enjoy all of the City's Parks, Recreational facilities and Recreational Programs, on the same basis as those afforded to City residents; and WHEREAS, the City is willing to allow the use of all of its Parks, Recreational Facilities and Recreational Programs to residents of unincorporated Collier County on the same terns and conditions as those afforded to residents of the City in exchange for an annual payment by the County in the sum of S 1,000,000, as adjusted in the manner set forth below. County residents shall be afforded the same rights and privileges as those granted to City residents to utilize all City Parks, Recreational facilities, and Recreational Programs, and shall pay the same fees and have access to the same parking as City residents. 4. With respect to beach access: A. The City and the County hereby continue their established reciprocal beach parking program whereby all residents of Collier County may obtain a beach parking sticker valid for free parking at any County or City beach parking location. B. The City will operate a beach patrol and maintenance program within the City to provide for beach and beach parking regulation enforcement, beach and beach parking cleanup, and beach and beach parking maintenance. C. For the term of this Agreement the City agrees to provide at least 1048 parking spaces located at street beach ends or City Beach Parks that will be available for vehicles of County residents with valid beach parking stickers. These spaces may be metered, restricted for permit parking, or handicapped parking spaces as determined by the City. All spaces regardless of designation will be made equally available at no cost to City and County residents. 5. The first and second year payments (FY 2009 and FY 2010) to the City shall be $1,000,000 (one million dollars) for each fiscal year. Commencing October 1, 2010, and each fiscal year thereafter, this payment will be adjusted, upward or downward, by multiplying the $1,000,000 base payment by an adjustment factor. The adjustment factor will be the ratio of ad valorem taxes paid to the County's General Fund by property owners located within the City in the fiscal year just ended, divided by the ratio of ad valorem taxes paid to the County's General Fund by property owners located within the City during the fiscal year ending September 30, 2008. 6. A $500,000 payment due shall be paid to the City not later than March 31 of each fiscal year. STAFF RECOMMENDATION Staff recommends City Council approve the Third Amendment to the Interlocal Agreement with Collier County. This action is being proposed to the Board of County Commissioners at an upcoming meeting. GENERAL INFORMATION On November 18, 2008, the City of Naples and Collier County entered into an Interlocal Agreement allowing residents from unincorporated Collier County to utilize all of the City's parks, recreational facilities, and recreational programs, on the same basis as those afforded to City residents in exchange for an annual payment by the County in the sum of $1,000,000 for each fiscal year. On December 1, 2017, the City of Naples and Collier County entered into an amendment to the Interlocal Agreement, extending the term to September 30, 2022, and increasing the annual payment from the County to $1,500,000 for the fiscal years within the extended term. On June 7, 2022, the City of Naples City Council held a joint meeting was held with the Board of County Commissioners (BOCC). The renewal of the 2017 Amended Interlocal Agreement was discussed, along with several other items. After a lengthy discussion, it was the consensus of both the City Council and BOCC to have Mayor Heitman and city staff work with Chairman McDaniel and county staff to discuss terms and payment methodology in preparation for the consideration of a new agreement. The two parties met on July 7 to begin the discussion. At this meeting, it was mutually agreed that it will take months to properly develop a new agreement that was fair to the city and county and an extension of the existing agreement should be approved prior to the September 30, 2022, expiration. Packet Pg. 1380 1 6.F.6.e At the July 12, 2022, regular meeting of the BOCC, the board expressed support to extend the current agreement with the City to June 30, 2023, through another amendment and maintain the total annual payment of $1,500,000 for this period but modifying the payment schedule to a monthly basis. The Second amendment was approved on September 13, 2022, regular meeting of the BOCC, and was approved unanimously by the board. Please see attached material from that meeting, which is inclusive of the original agreement, the first amendment, and the proposed second amendment. The proposed amendment before City Council for approval will be presented to the BOCC at an upcoming meeting. The prior agreement includes 2 annual payments ($750,000 in September and $750,000 in March). The September payment of $750,000 for the last year of the existing agreement is forthcoming. The Second Amendment approved by Council, commencing on October 1, 2022, the County will continue making prorated monthly payments of $125,000 through June 2023. The proposed Third amendment, if approved by Council, will extend the County making the prorated monthly payments of $125,000 through September 2023. The proposed extension of the existing agreement to through September will give Council and staff sufficient time complete the discussion and agree on the terms and payment methodology for a new agreement but will also allow time for the review of other interlocal agreements with the County. Staff believes the big -picture discussions and negotiations with the County brought more clarity to the City's contractual relationships with the County. In addition, these discussions have included evaluating the increased demand on City resources and residents resulting from the ever-growing increased level of service population being service within the City of Naples, the personnel demands, and the costs that continue to increase to maintain the expected level of service.
