Agenda 06/13/2023 Item #10A (To award 3 year contract for Legal Services for the CEB and CLB)10.A 06/13/2023 EXECUTIVE SUMMARY Recommendation to award a three-year contract for Legal Services for the Code Enforcement & Nuisance Abatement Board and Contractor Licensing Board. OBJECTIVE: To ensure that the Code Enforcement & Nuisance Abatement Board (CEB) and Contractor Licensing Board (CLB) continue to receive uninterrupted legal services. CONSIDERATION: The current contract for the Code Enforcement & Nuisance Abatement Board (CEB) expires on July 22°d, 2023, and the Contractor Licensing Board (CLB) expires on August 21', 2023. The current attorney for the CEB is Patrick White and the current attorney for the CLB is Kevin Noell of Noell Law P.L.L.C. Patrick White is retiring, and Kevin Noell provided a quote for the new contract. On March 10t1i, 2023, a Request for Quote (RFQ) was emailed to fourteen Law Firms to enter into contract with licensed practicing attorneys/firms for the provision of legal counsel for the CEB and CLB. The intent of the County is to obtain competent legal representation in a cost-effective manner. The Growth Management Community Development Department (GMCDD) received the following three quotes: Bidder Amount Andrew Diekman $1,5504ne. $ Q 600/y. Patrick Neale $2,000/mo. $24,000/yr. Kevin Noell / Noell Law P.L.L.C. $3,500/mo. $42,000/yr. Andrew Dickman withdrew on April 18', 2023. Of the remaining quotes, Patrick Neale is the current Code Enforcement Special Magistrate and Kevin Noell is the current Contractor Licensing Board attorney. FISCAL IMPACT: Annual contract amount not to exceed the amount specified in the bid tabulation above based on the Board's selection, which at most would be $42,000 annually or $126,000 over the 3 year term of the agreement. Funding for legal services is available within the Unincorporated General Fund (1011) and Planning Services (1014). GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action. LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney. As stated above, Patrick Neale is the current Code Enforcement Special Magistrate and Kevin Noell is the current Contractor Licensing Board attorney. There are two issues I would like to bring to the Board's attention. The first issue is that although the selection of Patrick Neale as the attorney for the Code Enforcement Board would not violate the constitutional dual office prohibition, as the attorney for the Code Enforcement Board is not considered an office, the issue of compatibility may arise with his appointment as attorney for the Code Enforcement Board and as Special Magistrate, as they hear similar cases. Attorney General Opinion 91-13 indicates incompatibility exists "where one office is subordinate to another, subject to its supervision or control, or the duties clash, inviting the incumbent to prefer one obligation over the other ... If the duties of the two are such that when placed in one person they might deserve the public interests, or if the respective officers might or will conflict even on rare occasions it is sufficient to declare them legally incompatible." For example, if Patrick Neale has ruled on a case in his capacity as the Special Magistrate and then a repeat violation is heard regarding the same property or same violator by the Code Enforcement Board, possible incompatibility exists as the Code Enforcement Board attorney would be advising the Board regarding the amount Packet Pg. 187 10.A 06/13/2023 of fines based upon the history of violations, including a prior order by the Special Magistrate. If the Board wishes to award the Code Enforcement Board attorney contract to Mr. Neale, the issue can be prevented by the Board directing staff to forward the cases of repeat or additional violations to the same violations body (either the Code Enforcement Board or Special Magistrate) that heard the initial violation. Put another way, so long as Mr. Neale is counsel to the Code Enforcement Board, once someone appears before the Code Enforcement Board, in the future they will appear before the Code Enforcement Board, and likewise, once someone appears before the Special Magistrate, in the future they will appear before the Special Magistrate. In addition, as violations by law run with the land, in cases where the property was sold, continued violations of that property would also appear before the same body as heard the initial violation. No issues of incompatibility are anticipated with the placement of Kevin Noell as both the Contractor Licensing Board attorney and the Code Enforcement Board attorney. Traditionally there were separate counsel for the CLB and the CEB. Staff is looking to combine the functions. If the Board wishes to continue this separation, the Board can elect to award these positions separately (as had been previously done), as opposed to just one of the candidates, and the candidates would need to revise their compensation request (which was based on two positions). The costs of these services this past year were as follows: Noell Law PLLC - Contractors Licensing Board Contract Expiration Date: 08/21/2023 Annual Billing: $19,800.00 Patrick G. TERM OF CONTRACT The contract term, if an award(s) is/are made is intended to be for three (3) years. Prices shall remain firm for the initial term of this Purchase Order. Surcharges will not be accepted in conjunction with this contract, and such charges should be incorporated into the pricing structure. All goods are FOB destination and must be suitably packed and prepared to secure the lowest transportation rates and to comply with all carrier regulations. Risk of loss of any goods sold hereunder shall transfer to the COUNTY at the time and place of delivery; provided that risk of loss prior to actual receipt of the goods by the COUNTY nonetheless remain with VENDOR. AWARD CRITERIA RFQ award criteria are as follows: ➢ For the purposes of determining the winning bidder, the County will select the vendor with the lowest price as outlined below: • Lowest Lump Sum ➢ Collier County reserves the right to select one, or more than one supplier, award on a line -item basis, establish a pool for quoting, or other options that represents the best value to the County; however, it is the intent to: Identify a Single Awardee ➢ The County reserves the right to issue a formal contract or standard County Purchase Order or utilize the County Purchasing Card for the award of this solicitation. Packet Pg. 191 10.A.1 DETAILED SCOPE OF WORK The County desires to enter into contract with licensed practicing attorneys/firms for the provision of legal counsel for the Code Enforcement & Nuisance Abatement Board and Contractor Licensing Board. The intent of the County is to obtain competent legal representation in a cost-effective manner. Admission to practice law in the State of Florida by the Florida Supreme Court/Florida Bar Association Membership is mandatory for the proposer including all attorneys working under this contract. Anyone not qualified shall be rejected as non- qualified. Proposers shall submit an offer for the services listed, including the submission of a proposed firm, fixed, flat annual fee. The annual fee shall be paid by the County in twelve (12) equal monthly installments. Services shall include but not be limited to the following: Required Services: 1. Represent the Code Enforcement & Nuisance Abatement Board and Contractor Licensing Board at hearings including: a. Review of case files; and b. Preparation of Board orders (including but not limited to, judgment directed to respondent, served by certified mail), contact with County Attorney's Office, Code Enforcement & Nuisance Abatement Board members, Contractor Licensing Board members as well as County staff, regarding administrative and/or procedural matters associated with the Board. c. Swear -in all persons as required for all licensing hearings, or license reviews. 2. Attend hearings in person (not remotely) for regularly scheduled monthly Code Enforcement Board meetings and Nuisance Abatement Board meetings, which are scheduled on an as -needed basis. Estimated number of cases is twenty to twenty- five (20-25) monthly. 3. Attend hearings in person (not remotely) for regularly scheduled monthly and Contractor Licensing Board meetings, which are scheduled on an as -needed basis. Estimated number of cases is fifteen to twenty (15-20) annually. 4. Prepare necessary documents in advance of meetings. 5. Prepare orders and obtain signatures (Chairman, etc.) and distribute orders issued by Board (within ten (10) days of action). 6. Review and prepare ordinances, amendments, Board rules and regulations, fine reductions, liens, and other matters. 7. Advise Board on legal issues which arise during hearings. Minimum Qualifications: * Proposers must have familiarity with and knowledge of ordinances for the Code Enforcement and Nuisance Abatement Board, as well as Chapters 119 and 162 F.S. and County ordinances. * Proposers must have familiarity with and knowledge of appropriate ordinances for the Contractor Licensing Board, as well as Florida Statutes Chapters 489, 119 and 162, and County ordinances. * Experience with quasi-judicial boards or proceedings, other governmental entities and/or other administrative proceedings are required. * Must be a current Notary Public for the State of Florida. The selected attorney/firm shall not have a conflict in representation. Should such a conflict occur, the attorney shall advise the County and the Board of any conflict in representation. In this regard, no attorney/firm may ever represent a person or entity in a matter before the Board if that attorney/firm is also counsel for the Board in question. Likewise, a Board attorney/firm may not represent the interests of an individual Board member during the period the attorney/firm serves as counsel to the Board. Other potential conflict situations shall be resolved on a case -by -case basis. In instances where the attorney/firm must recuse himself/itself, the attorney/firm will not be paid for that month. If a meeting is canceled due to lack of quorum or other reason outside the control of the attorney/firm (other than a conflict of interest), then the attorney/firm shall still receive its monthly payment.
