Agenda 5/23/2023 Item #16A1 (Final Acceptance for Abaco Pointe Phase 1 PL20190002237 on June 11, 2021)16.A.1 05/23/2023 EXECUTIVE SUMMARY Recommendation to approve final acceptance and conveyance of the pump station facilities that were inadvertently omitted from the potable water and sewer final utility acceptance approved by the Board of County Commissioners on September 14, 2021, for Abaco Pointe Phase 1, PL20190002237. OBJECTIVE: To have the Board of County Commissioners, as Ex-Officio Governing Board of the Collier County Water -Sewer District, approve final acceptance and accept the conveyance of pump station utility facilities. CONSIDERATIONS: 1) The Developer of Abaco Pointe Phase 1 has constructed the utility facilities within dedicated easements to serve this development. (See attached location map). The potable water and sewer facilities were approved by the Board of County Commissioners for final utility acceptance and bond release on September 14, 2021. Subsequently, County staff determined that the pump station was inadvertently omitted from the conveyance documents, and to rectify this issue, the Homeowner's Association has provided Contributory Assets for the conveyance of the pump station, and recorded a Warranty Deed and Bill of Sale, as described in OR Book 6227, Page 3781. The value of these sewer utility facilities (assets) is $350,000. 2) A final inspection to discover defects in materials and workmanship was conducted by the Development Review staff on June 11, 2021, in coordination with Public Utilities and these facilities have been found to be satisfactory and acceptable. 3) Staff recommends final acceptance of the subject pump station. Staff also recommends acceptance of the Utilities Facilities Deed and the facilities described in the Certification of Contributory Assets, which is attached to this Executive Summary. 4) This final acceptance is in accordance with Collier County Ordinance No. 2004-31, as amended. 5) Staff is unaware of any issues that would serve to negate the recommendation to release the applicable security. FISCAL IMPACT: Approval of this Executive Summary will result in the Collier County Water -Sewer District receiving title to the utility facilities, which has a total gross value of $350,000 (no depreciation applied) and an asset will be recorded in the financial records of the county. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action. LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires a majority vote for Board approval. -DDP RECOMMENDATION: To approve final acceptance and conveyance of the pump station facilities, that were inadvertently omitted from the potable water and sewer final utility acceptance approved by the Board of County Commissioners on September 14, 2021, for Abaco Pointe Phase 1, PL20190002237, and accept the conveyance of the Utilities Facilities Deed and the facilities described in the Certification of Contributory Assets.
