UTILITY EASEMENT
THIS EASEMENT, made and entered into this a7 day of , 2023,
by VILLAGE WALK HOMEOWNERS ASSOCIATION OF NAPLES, IN ., a Florida not-
for-profit corporation, whose mailing address is c/o KW Property Management
Consulting, 3200 Village Walk Circle, Suite 100, Naples, FL 34109, as Grantor, to the
BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, AS THE
GOVERNING BODY OF COLLIER COUNTY AND AS EX-OFFICIO THE GOVERNING
BOARD OF THE COLLIER COUNTY WATER-SEWER DISTRICT, whose mailing
address is 3335 Tamiami Trail East, Suite 101, Naples, FL 34112, its successors, and
assigns, as Grantee.
(Wherever used herein the terms "Grantor" and "Grantee" include all the parties to this instrument and their respective
heirs,legal representatives,successors,or assigns.)
WITNESSETH:
Grantor, for and in consideration of TEN DOLLARS ($10.00) and other valuable
consideration paid by the Grantee, the receipt and sufficiency of which is hereby
acknowledged, hereby conveys, grants, bargains and sells unto the Grantee, its
successors and assigns, a perpetual, non-exclusive utility easement, license, and
privilege for utility and installation purposes, on the following described lands located in
Collier County, Florida, to wit:
See attached Exhibit "A" which is incorporated herein by reference.
Subject to easements, restrictions, and reservations of record.
THIS IS NOT HOMESTEAD PROPERTY.
Grantee agrees that it shall, at the Grantee's sole cost and expense, restore and
repair any and all damage caused to Grantor's property or improvements as a result of
Grantee's use of this Utility Easement.
TO HAVE AND TO HOLD the same unto the Grantee together with the right to
enter upon said land, excavate, and place or remove materials including, but not limited
to, sewer lines and pipes, and other equipment or improvements appurtenant thereto or
thereunder for the purpose of constructing, operating, installing an odor control unit, and
maintaining utility facilities thereon. Grantor and Grantee are used for singular or plural,
as the context requires. The easement granted herein shall constitute easements
running with the land and shall burden the lands described above.

Corporation Affidavit

Before me, the undersigned authority, personally appeared SUSAN HOFFMAN, who
being by me first duly sworn, on oath deposes and says that:
1. She is the President on behalf of VILLAGE WALK HOMEOWNERS
ASSOCIATION OF NAPLES, INC., a Florida not-for-profit corporation.
2. Said corporation is currently in existence under valid Articles of Incorporation
and Bylaws and has not been terminated or dissolved.
3. That she is authorized by the Articles of Incorporation and/or Bylaws to execute
deeds, easements, and mortgages on behalf of the corporation, and all
necessary consents have been obtained.
4. The Corporation is not currently in any bankruptcy proceedings and is not a
debtor in bankruptcy.
5. Affiant further states that she is familiar with the nature of an oath and with the
penalties as provided by the laws of the State of Florida for falsely swearing to
statements made in an instrument of this nature. Affiant further certifies that she
has fully read this affidavit and understands its contents.
6. This Affidavit is given to induce Commonwealth Land Title Insurance Company
to issue its title policy insuring the contemplated transaction
