Case # 2007050343 - BCC vs. David & Zenaida Falato The Hearing was requested by the Respondent, Zenaida Falato, who was present on behalf of her husband and herself. Collier County Code Enforcement Investigator Azure Sorrels was also present. Violations: Ord. 04-41, the Collier County Land Development Code, as amended, Sec(s).4.05.03(A) Vehicle parked on unstablilized surface in back yard Address of violation: 130 2nd Street The Respondent submitted a letter requesting a rehearing of the matter and stated she was unable to appear at the previous hearing since she was out of town. Investigator Sorrels stated the County objected to the rehearing stating neither of the Respondents had contacted Code Enforcement asking for a continuance. She further stated this was not the first hearing for the Respondents and they had previously asked for a continuance in anothcr casc. Additionally, she stated the property had been posted and Mr. Falato was aware of the posting. The Investigator further stated she was informed by Mr. Falato that he did move the vehicle to the back yard, but she is not allowed on the property and cannot verify compliance. Finding the Notice of Hearing had been properly served, the Special Magistrate DENIED the Requestfor a Rehearing. 2. Case # 2007050344 - BCC vs. David & Zenaida Falato The Hearing was requested by the Respondent, Zenaida Falato, who was present on behalf of her husband and hcrself. Finding the Notice of Hearing had been properly served, the Special Magistrate DENIED the Request for a Rehearing. 3. Case # 2007051053 - BCC vs. Thomas J. Zenz & Susan L. Zenz The Hearing was requested by the Respondent, Thomas Zenz, who was present on behalf of his wife and himself. Collier County Code Enforcement Investigator Renald Paul was also present. Violations: Ord. 04-41 as amended, Sec(s). 4.05.03(C) Multiple vehicles parked on the front/rear yard Address of violation: 5353 Broward St. The Respondents had submitted a letter stating they had not received notice of the Hearing. Investigator Paul stated the County objected to the Rehearing. He stated he met with Mrs. Zenz at her home and told her a hearing would be scheduled. He stated the property had been posted. A certified letter had been sent to the Respondents and was received on July 31st. He further stated the property violations from July 24th were not abated until September 7'h The Respondent stated he had no idea when the hearing was scheduled. The property that was posted was rental property which he did not visit on a daily basis. He further claimed the letter he and his wife received was not via certified delivery, as they had received in the past. Arlene Harper, Code Enforcement Secretary, stated a letter was mailed via certified delivery and was returned to Code Enforcement as unclaimed. She further stated another letter was sent to the home address via regular delivery. The Special Magistrate stated posting of the property is sufficient. Finding the Notice of Hearing had been properly served, the Special Magistrate DENIED the Request for a Rehearing. V. PUBLIC HEARINGS A. Stipulations: 4 September 21, 2007 13. Case # 2007060851 - BCC vs. Guadalupe Garcia & Esperanza Bazan The Hearing was requested Collier County Code Enforcement Investigator Reggie Smith who was present. The Respondent, Esperanza Bazan Garcia, was present on behalf of her husband and herself. Elizabeth Garcia was present as translator for her mother. Violation(s): Ord. 04-41 as amended, Sec. 2.01.00(B)(3) Recurring commercial vehicles/equipment violation Address of violation: 5346 Hardee St., Naples, FL 34113 A Stipulation had been agreed to by Respondent. Guadalupe Garcia on September 6. 2007 and by Respondent, Esperanza Bazan Garcia, on September 21, 2007. The Investigator stated the violation had been abated. Finding the Notice of Hearing had been properly served, and finding the violation did exist but had been CORRECTED prior to today's Hearing, the Respondents were found GUILTY of the alleged violation(s) and were ordered to pay Operational Costs incurred during the prosecution of this case in the amount of $173.39 on or before October 21,2007. The Special Magistrate advised the Respondents to avoid any recurrences of this violation because it was a repeat violation. Any future violations of the same type would have a civil fine attached in addition to the Operational Costs. 17. Case # 2007010376 - BCC vs. Patricia K. Flick The Hearing was requested Collier County Code Enforcement Investigator Thomas Keegan who was present. The Respondent was not present. Violation(s): Ord. 04-58 Sec. 7 Rental registration Address of violation: 3073 Areca Ave., Naples, FL 34112 A Stipulation had been agreed to by the Respondent on September 20, 2007. The Investigator stated the violation had been abated and the late fee had been paid. Finding the Notice of Hearing had been properly served, and finding the violation did exist but had been CORRECTED prior to today's Hearing, the Respondent was found GUILTY of the alleged violation(s) and was ordered to pay Operational Costs incurred during the prosecution of this case in the amount of $181.40 on before October 21, 2007. 18. Case # 2007002557 - BCC vs. Sandra S. Combs Tr.. Carol R. Smith The Hearing was requested by Collier County Code Enforcement Investigator Thomas Keegan who was present. The Respondent was not present. 5 September 21, 2007 Violation(s): Ord. 04-58 Sec 6 Subsec. l2B, 12C & 121 Property maintenance Address of violation: 2348 Jackson Ave. A Stipulation had been agreed to by the Respondent on September 20, 2007. The Investigator stated the Respondent's attorney had reviewed the Stipulation which was signed by the Respondent. Finding the Notice of Hearing had been properly served, the Respondent was found GUILTY of the alleged violation(s) and was ordered to make all repairs to the walls, eves of the roof, and all damaged windows on or before November 21,2007, or a fine of $250.00 per day will be imposed for each day the violation remains thereafter unless altered by a subsequent Stipulation or Order of the Special Magistrate, The Respondent was ordered to pay Operational Costs incurred during the prosecution of this case in the amount of $216. 92 on or before October 21,2007. The Respondent is to notifY the Investigator within 24 hours of a workday to concur the violation had been abated. 8. Case # 2007050527 - BCC vs. Genevieve DeLisle & Deborah DeLisle The Hearing was requested by Collier County Code Enforcement Investigator Christopher Ambach who was present. Respondent, Deborah DeLisle, was present and represented her mother, Genevieve DeLisle, and herself. Violation(s): Ord. 04-58 Sec. 6, 12(1) Property maintenance Address of violation: 46 Derhenson Dr., Naples, FL 34114 A Stipulation had been agreed to by Respondent. Deborah DeLisle. on behalf of her mother. Respondent Genevieve Delisle. and herself The Investigator stated the violation has been abated. Finding the Notice of Hearing had been properly served, the Respondents were found GUILTY of the alleged violation(s) and were ordered to repair/replace all broken windows on enclosed porch on or before September 28,2007, or afine of $250. 00 per day will be imposed for each day the violation remains thereafter unless altered by a subsequent Stipulation or Order of the Special Magistrate. The Respondents were ordered to pay Operational Costs incurred during the prosecution of this case in the amount of $214.61 on or before October 21,2007. The Respondents are to notify the Investigator within 24 hours of a workday to concur the violation had been abated. There is a discrepancy. The written Stipulation allowed the Respondents up to 60 days to pay the Operational Costs and the Investigator stated that on the tape. The Special Magistrate stated October 2 I" on the tape.
