TEMPORARY CONSTRUCTION EASEMENT
THIS TEMPORARY CONSTRUCTION EASEMENT, is made and entered into this
25th day of April 2023, by the BOARD OF COUNTY COMMISSIONERS OF COLLIER
COUNTY, FLORIDA, AS THE GOVERNING BODY OF COLLIER COUNTY AND AS
THE EX-OFFICIO GOVERNING BOARD OF THE COLLIER COUNTY WATER-
SEWER DISTRICT, whose mailing address is 3299 Tamiami Trail East, c/o the Office of the
County Attorney, Suite 800, Naples, Florida 34112 (hereinafter referred to as "Grantor"), to
STOCK LUXURY HOMES, LLC, a Florida limited liability company, whose mailing address
is 2639 Professional Circle, Suite 101, Naples, Florida 34119 (hereinafter referred to as
"Grantee").
(Wherever used herein the terms "Grantor" and "Grantee" include all the parties to this
instrument and their respective heirs, legal representatives, successors and assigns. Grantor and
Grantee are used for singular or plural, as the context requires.)
WITNESSETH:
That the Grantor, for and in consideration of Ten Dollars ($10.00) and other valuable
consideration paid by the Grantee, receipt and sufficiency of which is hereby acknowledged,
hereby conveys, grants, bargains and sells to the Grantee, a Temporary Construction Easement to
enter upon the lands described as follows:
Tract B and Tract C of Sandalwood, a subdivision according to the plat thereof
recorded in Plat Book 50, Pages 55 through 58, inclusive, of the Public Records
of Collier County, Florida.
The term of this Temporary Construction Easement shall commence upon the date
hereof, and shall automatically terminate upon issuance of a Certificate of Completion for the
wall improvements to be constructed by Grantee in the above described easement area and
turnover of the same to the Secoya Reserve Homeowners Association, Inc., a Florida not for
profit corporation ("Association") pursuant to that certain Access Easement by and between
Grantor and said Association.
Upon completion of the installation of the wall improvements in the Easement Area,
Grantee shall use its best efforts to restore the surface of the easement area to its pre-existing
condition.

hereby conveys, grants, bargains and sells unto the Grantee, a perpetual, non-exclusive access
easement for the purpose of providing access, over, under, upon and across the lands described
and depicted on Exhibit "A — 1" and "A — 2" attached hereto ("Easement Area") for the
maintenance, repair and replacement of the wall and related facilities, if any, located within said
Easement Area.
Subject to easements, restrictions, and reservations of record.
THIS NOT HOMESTEAD PROPERTY
TO HAVE AND TO HOLD the same unto the Grantee, together with the right to enter
upon said Easement Area for the purpose of maintaining the wall and related improvements, if
any, therein. The parties agree and acknowledge that Grantee is solely responsible for all costs
and expenses associated with maintaining, repairing and replacing, said wall and related
improvements. The easement granted herein shall constitute easements running with the land and
shall burden the lands described above.
