EXECUTIVE SUMMARY
Recommendation to approve Amendment No. 1 to the Interlocal Agreement with the School District of
Collier County, related to Agreement No. 20-7708, Design -Build Veterans Memorial Boulevard Extension,
Phase I (County Project Number 60198), for $17,752.35.
OBJECTIVE: To obtain additional funds from the School District of Collier County (the District) for the
additional work required to meet the District's needs.
CONSIDERATIONS: On October 27, 2020, Agenda Item 11A, the Collier County Board of County
Commissioners (Board) approved the Interlocal Agreement (IA) with the District for $1,382,720 as a companion to
Agreement No. 20-7708, Design -Build Veterans Memorial Boulevard Extension, Phase I (County Project Number
60198) with Quality Enterprises USA, Inc.
In accordance with the IA, on December 4, 2020, the District reimbursed the County for $1,382,720, Warrant No.
244974.
On November 20, 2020, staff issued the Notice to Proceed (NTP) to Quality Enterprises USA, Inc., to start the
Design -Build work for Veterans Memorial Boulevard Extension Phase I. As the work progressed, a few
commitments in the IA were impacted due to field revisions:
1. Force Main: The original estimation was to furnish and install a 12-inch force main. During the design process,
the size was reduced to an 8-inch force main. The reduction in the size of the sanitary force main has resulted in
a credit of $22,822.43 to the District.
2. Turn Lanes: The original estimation was for 400 feet dual left turn lanes at the Veteran's Memorial Elementary
School. During the review of the design, it was determined that 600 feet of dual left turn lanes were needed. The
additional 200 feet of dual left turn lanes has resulted in a cost increase of $40,574.78 to the District.
The modifications to the IA's commitments resulted in a total expense of $17,752.35 to the District.
The Interlocal Agreement Amendment No. 1 will be on the May 9, 2023, Collier County Public School Board
meeting agenda for approval.
FISCAL IMPACT: The School District of Collier County will reimburse the County in the amount of $17,752.35
for infrastructure and improvements benefiting the schools. Funds will be deposited in Project 60198 in fund (331).
GROWTH MANAGEMENT IMPACT: The project is in conformance with the goals and objectives of the
Transportation Element of the Growth Management Plan.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is approved as to form
and legality and requires majority vote for approval. -JAK

EXECUTIVE SUMMARY:
On November 10, 2020, the School Board and the Board of County Commissioners ("BOCC")
entered into an Interlocal Agreement ("the Agreement") concerning Phase I of the extension
of Veterans Memorial Boulevard in anticipation of the opening of the new Aubrey Rogers High
School (then referred to as High School GGG). The Agreement involved District
reimbursement to BOCC for the design and construction of the extension. Amendment No. I
to the Agreement pertains to the reimbursement of costs for the final construction plan
including a credit to the District because of the reduction in the size of the water main from
12 inches to 8 inches.

INTERLOCAL AGREEMENT AMENDMENT NO.1
(Veterans Memorial Boulevard Extension — Phase 1)
This AMENDMENT NO. 1 TO INTERLOCAL AGREEMENT (Amendment No.
1) is made and entered into this of , 2023 by and between
the SCHOOL DISTRICT of Collier County ("District"), on the one hand, and COLLIER
COUNTY, a political subdivision of the State of Florida and the Collier County Water -
Sewer District on the other (collectively referred to as the "County").
RECITALS:
WHEREAS, the County and the District have previously entered into an Interlocal
Agreement dated November 10, 2020, (the "Agreement"); and
WHEREAS, the County and the District are desirous of amending the Agreement.
WITNESSETH
NOW THEREFORE, in consideration of Ten Dollars ($10.00) and other good and
valuable consideration exchanged amongst the parties, and in consideration of the mutual Q.
promises, commitments and covenants contained herein, the parties agree as follows; E

1. Recitals. The parties agree and acknowledge that the recitals above are true and 0

correct. v
2. Reimbursement to County. The final construction Plans called for an 8-inch
sanitary force main instead of the 12-inch force main. The reduction in size of the sanitary
force main has resulted in a credit of $22,822.43 to the District. With respect to the
proposed turn lanes servicing the Elementary School, the school's internal circulation
needed to meet the demand of parents waiting on Veterans Memorial Blvd. to enter the
school. During review, it was determined that 1200' of storage was needed to
accommodate the waiting queue. Since dual left -turn lanes were proposed on this approach,
600' of dual left -tutu storage was needed to keep the approaching traffic from backing up
into the through lanes and causing a safety issue. Therefore, to accommodate the School
traffic the original design needed to be modified to add 200' of storage to provide the 600'
of storage that was needed. The additional costs to the District for this change is $40,
574.78. Accordingly, Exhibit B to the agreement is amended and replaced with Exhibit B
to this Amendment No. 1 to reflect these changes.

3. Legal Matters. This Amendment No. 1 shall be recorded by the County
in the Official Records of Collier County, Florida, within fourteen (14) days after it is
fully executed. Collier County shall pay all costs of recording this Amendment No. 1. A
copy of the recorded document will be provided to District within 15 days of recordation.
Except as expressly provided herein, the Agreement between the County and the District
remains in full force and effect according to the terms and conditions contained therein,
and said terms and conditions are applicable hereto except as expressly provided otherwise
herein.
