Recommendation to approve Petition VAC-PL20220000374 to disclaim, renounce and vacate the County and the public interest in two unimproved 30-foot-wide public right-of-ways described as Avenue “B” and First Street, according to the COL-LEE-CO TERRACE subdivision plat, as recorded in Plat Book 1, Page 32, of the Public Records of Collier County, Florida. The subject property is located on the south side of U.S. 41 between Fredrick Street and Palm Street in Section 11, Township 50 South, Range 25 East, Collier County, Florida; and to approve a Developer Agreement with TB East Trail LLC (Developer) and Collier County (County) to provide $528,431.35 for a stormwater management improvement between Spruce Street and Pine Street. _____________________________________________________________________________________ OBJECTIVE: To adopt a Resolution to vacate the County and the public interest in two unimproved 30-foot-wide public right-of-ways, described as Avenue “B” and First Street, according to the COL-LEE-CO TERRACE subdivision plat, as recorded in Plat Book 1, Page 32, of the Public Records of Collier County, Florida, located in Section 11, Township 50 South, Range 25 East, Collier County, Florida, being more specifically shown in Exhibit “A”; and to approve a developer agreement with TB East Trail LLC where they will provide $528,431.35 for a stormwater management improvement between Spruce Street and Pine Street. CONSIDERATIONS: Petition VAC-PL20220000374 has been received by the Development Review Division, Growth Management Community Development Department on behalf of the property owner to vacate the County and the public interest in two unimproved 30-foot-wide public rights-of-way, described as Avenue “B” and First Street, according to the COL-LEE-CO TERRACE subdivision plat, as recorded in Plat Book 1, Page 32, of the Public Records of Collier County, Florida, located in Section 11, Township 50 South, Range 25 East, Collier County, Florida. TB East Trail LLC, a subsidiary of Barron Collier Management, LLC (“BCM”), and adjacent property owner Denkenrick, Inc. (collectively, the “Owners”), own 4.28-acres of land located on the south side of Tamiami Trail East (US 41), between Frederick Street and Palm Drive in Collier County (specifically, Lots 17 -34 and 35-45, COL-LEE-CO TERRACE subdivision). The property is bisected by two unimproved road rights-of-way, Avenue “B” and First Street (also known as George Street and Jay Avenue, respectively), which are highlighted in the attached exhibit. BCM is seeking to vacate these unimproved road rights -of-way in order to unify the property for potential redevelopment. The existing rights-of-way are not paved or currently used for public access and only serve the properties controlled by Owners. The surrounding road network of US 41, Frederick Street, and Palm Street provide the transportation, drainage, and utility needs of the surrounding neighborhood. The County Street System Requirements as specified in LDC Section 6.06.01 N. require a minimum sixty-foot-wide right-of-way for a local street. The existing rights-of- way are only thirty feet in width, which is insufficient to support a code-compliant roadway. In order to construct public roads to current standards, the County would need to acquire additional right-of-way or easements. With that said, BCM seeks to create a greater public benefit by providing a $528,431.35 stormwater management improvement project, which includes demolition, re-grading, storm pipe and structure installation, asphalt re- surfacing and striping, as well as nearby lake exotic removal, located between Spruce Street and Pine Street, as further described in the attached developer agreement. Staff recommends approval of the developer agreement as part of approval of the vacation. An existing County sewer line extends east from Frederick Street through the First Street right-of-way and then north within the Avenue “B” right-of-way. This sewer line currently only provides service to the Little Italy Restaurant. The restaurant is located on property under contract by BCM, has not been open for over a year, and will be removed in order to develop the entire BCM property as a single-use commercial development. A replacement County Utility Easement will be provided for the portions of the sewer line that will remain when the property is redeveloped. 17.D Packet Pg. 2347 04/25/2023 Approval of the Vacation request will benefit the public in removing the necessity for the County to obtain additional right-of-way or easements to improve the roadways, eliminating any need for continual maintenance of the public streets, providing for an adjacent stormwater management improvement project, and allowing the property to be developed as a single-use commercial development, thereby increasing the taxable value realized by the County. FISCAL IMPACT: The Growth Management Community Development Department, Development Review Division staff has collected a $2,000 “Petition to Vacate” fee from the petitioner which covers the County’s cost of recording and processing the Petition. Within 60 days of approval of this item, the Developer shall remit $528,431.35 for stormwater management improvements identified in the Developer Agreement. Once the funds are received, County staff will present an agenda item to the Board to recognize the revenue. GROWTH MANAGEMENT IMPACT: There is no growth management plan impact associated with this Executive Summary. LEGAL CONSIDERATIONS: Petitioner is requesting vacation of the County and the public interest in in two unimproved 30-foot-wide public rights-of-way, described as Avenue “B” and First Street, according to the COL- LEE-CO TERRACE subdivision plat, as recorded in Plat Book 1, Page 32, of the Public Records of Collier County, Florida. Pursuant to Resolution 2021-243 and Florida Statutes Sections 177.101, 336.09, and 336.10, the Board, with respect to property under their control, may adopt a resolution to vacate, abandon, disconti nue and close any existing public or private street, alleyway, road, highway, or other place used for travel, or any portion thereof, other than a state or federal highway, and to renounce and disclaim any right of the County and the public in and to any land in connection therewith, and may adopt resolutions vacating plats in whole or in part of subdivisions in Collier County, returning the property covered by such plats either in whole or in part into acreage, when the following criteria are met: 1. The request is in the interest of the general public welfare, or no public detriment is established; 2. The request does not invade or violate individual property rights; 3. The Petitioner owns the fee simple title to the whole or that part of the parcel sought to be vacated; and 4. The vacation will not affect the ownership or right of convenient access of persons owning other parts of the subdivision. This item has been approved as to form and legality and requires a majority vote for Board approval. - DDP RECOMMENDATION: 1) Approve the attached Resolution, relating to Petition VAC-PL20220000374, which will vacate two unimproved 30-foot-wide public rights-of-way, described as Avenue “B” and First Street, according to the COL-LEE-CO TERRACE subdivision plat, as recorded in Plat Book 1, Page 32 of the Public Records of Collier County, Florida, located in Section 11, Township 50 South, Range 25 East, Collier County, Florida, being more specifically shown in Exhibit “A”, 2) Direct the Clerk to the Board to record a certified copy of the Resolution in the Public Records of Collier County, Florida and to make proper notation of this Resolution on the plat of COL-LEE-CO TERRACE, as recorded in Plat Book 1, Page 32 of the Public Records of Collier County, Florida, 3) accept the replacement CUE, and 4) approve and authorize the Chairman to execute the developer agreement.
