Agenda 04/25/2023 Item #16D 6 (To provide home energy assistance aid to elders in the event of a home energy heating or cooling emergency)04/25/2023 EXECUTIVE SUMMARY Recommendation to approve an “After-the-Fact” Amendment 2 with Area Agency on Aging for Southwest Florida, Inc., for the Emergency Home Energy Assistance Program to authorize FY2022 funding for the EHEAP 203.21 Agreement to increase the award amount of $100,000 with revision to the Budget Summary for FY21 & FY22 and the supporting Budget Amendment. (Human Services Grant Fund 707) OBJECTIVE: To provide home energy assistance aid to elders in the event of a home energy heating or cooling emergency. CONSIDERATIONS: The Community and Human Services (CHS) Division’s Services for Seniors program has been providing support to Collier County’s frail and elderly citizens for over thirty (30) years through various grant programs. The grants are funded by the Florida Department of Elder Affairs (DOEA) through the Area Agency on Aging of Southwest Florida, Inc. (Agency). These grant fund services enable clients to remain in their homes and live with independence and dignity. The Collier County Services for Seniors Program is responsible for responding to seniors’ needs and managing the spending authority for the Federal and State Funded Services for Seniors Programs. Collier County, as the Lead Agency, manages the spending authority for the Emergency Home Energy Assistance Program (EHEAP). EHEAP provides crisis assistance to eligible low-income households with at least one (1) individual aged sixty (60) or older experiencing a heating or cooling emergency. The program allows for payments to utility companies, fuel suppliers for the repair or replacement of existing heating or cooling equipment, for the payment of deposits, late fees, disconnect and reconnection fees with Florida Power and Light (FPL) & Lee County Electric Cooperative (LCEC). The current service agreement for EHEAP 203.21 was approved “After-the-Fact” at the Board of County Commissioners (Board) meeting on June 22, 2021 (Agenda Item #16D10). The contract has a term that is, effective April 1, 2021, to September 30, 2023. Amendment 1, EHEAP 203.21.01 was approved “After-the-Fact” at the Board meeting on July 13, 2021 (Agenda Item #16D2) to replace attachment I, EHEAP Activity Report and attachment XVIII EHEAP Application and Eligibility Worksheet of the FY2021 EHEAP contract wherever stated to amend contract language. The proposed Amendment 2, EHEAP 203.21.02 is to authorize Fiscal Year 2022 funding to be added to the current EHEAP FY2021 contract effective April 1, 2023, through September 30, 2023. This time frame makes it impossible to process the document for Board consideration. Pursuant to CMA# 5330 and Resolution No. 2018- 202, the County Manager authorized the Public Services Department Head to sign the agreement. EMERGENCY HOME ENERGY ASSISTANCE PROGRAM THIS CONTRACT is entered into between the Area Agency on Aging for Southwest Florida, Inc. (Agency) and &ROOLHU County Board of County Commissioners (Contractor), collectively referred to as the "Parties." The term Contractor for this purpose may designate a Vendor, Subgrantee or Subrecipient. WITNESSETH THAT: WHEREAS, the Agency has determined that it is in need of certain services as described herein; and WHEREAS, the Contractor has demonstrated that it has the requisite expertise and ability to faithfully perform such services as an independent Contractor of the Agency. Contract Amount: The Agency agrees to pay for contracted services according to the terms and conditions of this contract in an amount not to exceed $ subject to the availability of funds. Any costs or services paid for under any other contract or from any other source are not eligible for payment under this contract. Renewals: By mutual agreement of the Parties, in accordance with Section 287.058(l)(g), Florida Statutes (F.S.), the Agency may renew the contract for a period not to exceed three years, or the term of the original contract, whichever is longer. The renewal price, or method for determining a renewal price, is set price, is set forth in the bid, proposal, or reply. No other costs for the renewal may be charged. Any renewal is subject to the same terms and conditions as the original contract and contingent upon satisfactory performance evaluations by the Agency and the availability of funds.
