EXECUTIVE SUMMARY
Recommendation the Board of County Commissioners approve an access easement and temporary
construction easement for the construction of an eight-foot concrete noise wall on two County-owned
properties to abate noise from Veteran’s Memori al Boulevard in accordance with the 2006 Settlement
Agreement for the Sandalwood PUD.
OBJECTIVE: To have the Board of County Commissioners approve an access easement and temporary
construction easement to allow the construction of an eight -foot concrete noise wall on two County-owned
properties on the northern side of the Sandalwood PUD, to abate noise from Veteran’s Memorial Boulevard, in
accordance with the Sandalwood Settlement Agreement and PUD Ordinance.
CONSIDERATIONS: The Sandalwood PUD was approved as a result of a Settlement Agreement in September
2006 (Case No. 06-384-CA); approval of the settlement agreement included the following Developer Commitment:
“A noise mitigation wall adjacent to future Veteran’s Memorial Boulevard if warranted by impro vements to future
Veteran’s Memorial Boulevard, shall be the responsibility of the developer and not Collier County.”
The Secoya Reserve Homeowners’ Association, the subdivision within the PUD, initiated discussions with Collier
County staff to construct the wall per the commitment to abate the noise generated by Veteran’s Memorial
Boulevard, which is currently under construction. AIM Engineering completed a noise study during the current
construction project's pre-and-post-design phases and determined Secoya Reserve meets the warrants for a noise
wall.
The Collier County Water-Sewer District owns two parcels of land directly south of Veteran’s Memorial Boulevard
(Tracts B and C of Sandalwood subdivision; Plat Book 50, Pages 55-58), between the road and the subdivision.
Considering field conditions, Collier County staff worked with the developer to locate the wall as close to the
southern property line of the County-owned parcels as feasible, with exception to the County Utility Easement area,
and approves of the wall’s location.
The proposed access easement and temporary construction easement must be approved by the Collier County Board
of County Commissioners, as there is no other mechanism to approve such an easement. The easement and wall
location do not pose any threat to public health, safety, or welfare. Upon approval of the access easement and
temporary construction easement, the developer will submit an insubstantial change to the plat to show the location
of the walls and easements and will pay for the construction and maintenance in accordance with the Sandalwood
Settlement Agreement and PUD Ordinance.
FISCAL IMPACT: Applicant is responsible for covering the cost of recording fees.
GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact associated with this Executive
Summary.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires a majority vote
for Board approval. -DDP

construction of an eight-foot concrete noise wall on two County-owned properties to abate noise from Veteran’s
