EXECUTIVE SUMMARY
Recommendation to approve an Agreement for the purchase of a sidewalk, slope, and utility easement
(Parcel 513SWUE) required for construction of improvements for the Logan Boulevard at Vanderbilt Beach
Road Intersection (Project No. 60252).
OBJECTIVE: To acquire the sidewalk, slope, and utility easement needed for construction of intersection
improvements at Logan Boulevard and Vanderbilt Beach Road (the “Project”).
CONSIDERATIONS: Collier County is seeking to purchase a perpetual, non-exclusive sidewalk, slope, and
utility easement (Parcel 513SWUE) from The Cove Homeowners Association of Naples, Inc., needed for
construction of the Project. Parcel 513SWUE is a triangular shaped parcel, 283.27 square feet in extent, located on
the northwest corner of Logan Boulevard and Vanderbilt Beach Road.
The attached agreement is the result of amicable negotiations between the owner and County staff and provides for
a full reimbursement payment of $1,200 for Parcel 513SWUE. This amount was requested by the owner as
reimbursement for legal review costs and for the costs of relocating and reconfiguring its irrigation system. Staff
recommends that the Board of County Commissioners approve the agreement. If this parcel is not acquired by
negotiation, it may have to be condemned, in which case the County will be liable for payment of the owner’s
attorney’s, appraiser’s and other experts’ fees and costs, which, along with possible claims for severance damages
and costs to cure, could far exceed the negotiated full compensation amount.
FISCAL IMPACT: Funds in the amount of $1,300 will be required, being the compensation amount of $1,200
and miscellaneous closing and recording fees not to exceed $100. The source of funding for the acquisition is G as
Tax Fund 313.
No maintenance costs are anticipated until such time as the Project is constructed.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires a majority vote
for Board approval. -DDP
GROWTH MANAGEMENT IMPACT: This recommendation is consistent with the Long-Range Transportation
Plan and the Collier County Growth Management Plan.
RECOMMENDATION:
. Approve the attached Agreement and authorize the Chairman to execute same on behalf of the Board;
. Accept the conveyance of Parcel 513SWUE and authorize the County Manager, or their designee, to record the
conveyance instrument in the public records of Collier County, Florida;
. Authorize the payment of all costs and expenses that Collier County is required to pay under the terms of the
purchase agreement to close the transaction; and
. Authorize the County Manager or their designee to take the necessary measures to ensure the County’s
performance in accordance with the terms and conditions of the purchase agreement.
