04/25/2023 EXECUTIVE SUMMARY Recommendation to ratify the County Manager’s awarding of Invitation to Bid (“ITB”) No. 23-8111, “Collier 2023 Emergency Berm Truck Haul and Construction, Reach A” to Phillips & Jordan, Inc., in the amount of $6,723,041.50, “Collier 2023 Emergency Berm Truck Haul and Construction, Reach B” to Earth Tech Enterprises Inc., in the amount of $8,422,934.50, authorize the Chairman to sign the attached Agreements, approve the attached budget amendments, and make a finding that this item promote s tourism (Hurricane Ian, Project 50280). OBJECTIVE: To award the attached agreements to construct an emergency berm for Barefoot, Vanderbilt, Pelican Bay, Naples, and South Marco beaches. CONSIDERATIONS: On September 28, 2022, Hurricane Ian passed offshore of Collier County beaches producing extreme waves and storm surge that heavily eroded County beaches and dunes. The County immediately tasked APTIM Environmental and Infrastructure, LLC (“APTIM”) with surveying the sand losses from the beaches and dunes to determine the necessary repairs needed to re-establish the protection provided to beachfront structures. Following the hurricane, during October of 2022, representatives from the Florida Department of Environmental Protection, Federal Emergency Management Agency (“FEMA”), and U.S. Army Corps of Engineers conducted on- site damage assessments of County beaches with County staff. All three agencies expressed concern for the heavy dune losses and the vulnerability of upland structures from coastal storm flooding. FEMA policy allows for the reimbursement of eligible emergency measures by local governments to provide protective measures to protect improved property from floodwaters. FEMA typically requires all emergency work to be completed within six months of an emergency declaration in order to be eligible for reimbursement. At its December 13, 2022, meeting (Agenda Item 11.D), the Board certified the existence of a valid public emergency to approve the issuance of a standard County Work Order to APTIM for the surveying, design, permitting and post-design services for the emergency berm. APTIM’s preliminary construction cost estimate of $24,000,000 requires the purchase, hauling and placement of approximately 400,000 cubic yards of beach compatible sand with an in-place average cost of approximately $60 per cubic yard. On January 24, 2023 (Item 11.B), the Board authorized the expenditure of Tourist Development Tax funds in a not - to-exceed amount $24,000,000 for the construction of an emergency berm for eligible beaches and authorized the Board to delegate authority to the County Manager to execute contracts for the berm construction, subject to being later ratified by the Board at its next regular meeting. On February 28, 2023, exercising its discretion as permitted through 44 CFR §206.204(c)(2)(ii), the Florida Division of Emergency Management (FDEM) issued a time extension of three months for the completion of emergency work associated with Hurricane Ian, extending the deadline from March 29, 2023, to June 29, 2023. The construction of an emergency berm must begin immediately in order to complete construction by the new deadline. Further, unless the emergency berm is completed prior to the 2023 hurricane season starting June 1st, gulf-front properties will be left exposed to potential flooding from tropical systems. Only those beaches with public access are eligible for Tourist Development Tax funding. Portions of the beach deemed ineligible will require alternate funding sources. If the County is successful in meeting FEMA deadlines, the County may expect/seek FEMA reimbursement of 75% of the costs associated with the construction of the emergency berm plus an additional 12.5% share from the State of Florida Emergency Management Services. Legislation related to the Hurricane Ian and Nicole recovery plan, recently signed by the Governor of Florida may provide additional funding for the non -federal cost share of the project. The County received four bids by the March 10, 2023, deadline as summarized below. Staff determined Phillips and Jordan, Incorporated as the lowest responsive and responsible bidder for Reach A, and Earth Tech Enterprises, Inc. as the lowest responsive and responsible bidder for Reach B. Phillips and Jordan, Incorporated has been doing business in Florida since 1974 and has worked successfully on many projects for Collier County. Earth Tech Enterprises, Inc. has been doing business in Florida since 2000 and has worked successfully on many projects for Collier County. Staff and engineering consultant APTIM determined the low bids to be fair and reasonable and recommends awarding the contract to Phillips and Jordan, Incorporated for Reach A, and Earth Tech Enterprises, Inc. for Reach B. The engineer consultant and project manager evaluated references and deemed them acceptable in determining work of a similar magnitude completed within the last five years as a judge of its experience, skill and business standing and of its ability to conduct the work as completely and timely as required under th e terms of the attached agreement. Phillips and Jordan, Incorporated’s bid is approximately 35% below the engineer consultant’s $10,276,053.24 opinion of probable cost. Earth Tech Enterprises, Inc.’s bid is approximately 18% below the engineer consultants $10,262,384.22 opinion of probable cost. The County Manager has approved and executed the agreements, which is subject to formal ratification by the Board. If the approval by the County Manager is not ratified by the Board, the County Manager’s approval shall be enforceable against Collier County only to the extent authorized by law in the absence of such ratification by the Board. ADVISORY COMMITTEE RECOMMENDATIONS: On January 12, 2023, the Coastal Advisory Committee (CAC) authorized the expenditure of Tourist Development Tax funds in a not-to-exceed amount $24,000,000 for the construction of an emergency berm, voting unanimously (8-0). The Tourist Development Council (TDC) also 11.A Packet Pg. 215 04/25/2023 authorized the expenditure on January 23, 2023, voting unanimously (8-0). Both CAC and TDC made a finding that the expenditure promotes tourism. GROWTH MANAGEMENT IMPACT: There is no impact to the Growth Management Plan related to this action. FISCAL IMPACT: Funding for this project is available in both TDC Beach Renourishment Fund (195) and FEMA Grants Fund (727), within Hurricane Ian Project (50280).
