Notice is hereby given that a public hearing will be held by the Collier County
Board of County Commissioners on April 11, 2023, in the Board of County

Tamiami Trail East, Naples FL., to consider the enactment of a County Ordinance.
The meeting will commence at 9:00 A.M. The title of the proposed Ordinance is
as follows: AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY, FLORIDA, ESTABLISHING THE COLLIER COUNTY HEALTH
FREEDOM BILL OF RIGHTS; PROVIDING FOR CONFLICT AND SEVERABILITY;
PROVIDING FOR INCLUSION IN THE CODE OF LAWS AND ORDINANCES; AND
PROVIDING FOR AN EFFECTIVE DATE. A copy of the proposed Ordinance is on
file with the Clerk to the Board and is available for inspection. All interested
parties are invited to attend and be heard. NOTE: All persons wishing to speak on
any agenda item must register with the County Manager prior to presentation of
the agenda item to be addressed. Individual speakers will be limited to 3 minutes
on any item. The selection of any individual to speak on behalf of an organization
or group is encouraged. If recognized by the Chairman, a spokesperson for a

AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY, FLORIDA, ESTABLISHING THE COLLIER
COUNTY HEALTH FREEDOM BILL OF RIGHTS; PROVIDING FOR
CONFLICT AND SEVERABILITY; PROVIDING FOR INCLUSION IN
THE CODE OF LAWS AND ORDINANCES; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, numerous County residents have expressed their concerns to the Board of
County Commissioners ("Board") over the federal government's and the World Health
Organization's attempts to impose public health mandates and limit an individual's healthcare
freedoms and rights; and
WHEREAS,the State of Florida has recognized these concerns and in November of 2021,
Governor DeSantis signed into law Senate Bill (SB) 2-B and its companion House Bill (HB) 1-
B,1 as well as HB 3-B/SB 4-B, 2, now codified in Chapter 381, Florida Statutes, in large part
prohibiting the ability of private employers to impose a COVID-19 vaccination mandate amongst
other protections; and
WHEREAS, the State of Florida further protects its residents' health related rights and
freedoms through Section 381.026, Florida Statutes, the Florida Patient's Bill of Rights and
Responsibilities, which promotes the interests and wellbeing of patients of healthcare providers
and healthcare facilities; and
WHEREAS, the Board wishes to address the concerns of Collier County residents and
adopt the foregoing State Statutes into local law.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA:
SECTION ONE: Title
This Ordinance shall be known and cited as the "Collier County Health Freedom Bill of
Rights" Ordinance.
SECTION TWO: Purpose and Intent
The purpose of this Ordinance is to safeguard the healthcare rights and freedoms of Collier
County residents.
SECTION THREE: Definitions
The terms used in this Ordinance shall be defined as outlined in Chapter 381, Florida
Statutes, as may be amended from time to time.

SECTION FOUR: Applicability.
This Ordinance is applicable and limited to unincorporated Collier County.
SECTION FIVE: COVID-19 vaccine documentation prohibited.
(A) A business entity within Collier County, as defined in Florida Statutes Sec. 768.38, may not
require patrons or customers to provide any documentation certifying COVID-19 vaccination or
postinfection recovery to gain access to, entry upon, or service from the business operations in
Collier County. This subsection does not otherwise restrict businesses from instituting screening
protocols consistent with authoritative or controlling government-issued guidance to protect public
health.
(B) Collier County will not require anyone to provide any documentation certifying COVID-19
vaccination or postinfection recovery to gain access to, entry upon, or service from Collier
County's operations.
(C) Florida Statutes Sec. 381.00316 is incorporated herein by reference, as it pertains to
exemptions for health care providers.
SECTION SIX: Private employer COVID-19 vaccination mandates prohibited.
(A) A private employer within Collier County may not impose a COVID-19 vaccination
mandate for any full-time, part-time, or contract employee without providing individual
exemptions that allow an employee to opt out of such requirement on the basis of medical reasons,
including, but not limited to, pregnancy or anticipated pregnancy; religious reasons; COVID-19
immunity; periodic testing; and the use of employer-provided personal protective equipment. For
purposes of this section, the term "COVID-19" means the novel coronavirus identified as SARS-
CoV-2; any disease caused by SARS-CoV-2, its viral fragments, or a virus mutating therefrom;
and all conditions associated with the disease which are caused by SARS-CoV-2, its viral
fragments, or a virus mutating therefrom. Employers shall use forms adopted by the Department
of Health, or substantially similar forms, for employees to submit exemption statements.
(B) If an employer fails to comply with subsection(A) and terminates an employee based on the

SECTION ELEVEN: Florida Patient's Bill of Rights and Responsibilities.
Collier County hereby adopts in its entirety the Florida Patient's Bill of Rights and
Responsibilities, as codified in Florida Stat. Sec. 381.026, as may be amended from time to time.
SECTION TWELVE: Penalties.
To the extent not inconsistent with Florida law, violations of this Ordinance shall be
punishable as provided by law for the violation of county ordinances.
SECTION THIRTEEN: Conflict and Severability
In the event this Ordinance conflicts with State or Federal law, State or Federal law shall
apply. If any phrase or portion of the Ordinance is held invalid or unconstitutional by any court of
competent jurisdiction, such portion shall be deemed a separate,distinct and independent provision
and such holding shall not affect the validity of the remaining portion.
It is the intent of this Ordinance to mirror State law. Accordingly, this Ordinance shall be
automatically amended upon any amendment of Chapter 381, Florida Statutes, or any other
relevant State law.

Notice is hereby given that a public hearing will be held by the Collier County Board of
County Commissioners on April 11, 2023, in the Board of County Commissioners Meeting
Room, Third Floor, Collier Government Center, 3299 Tamiami Trail East, Naples FL., to
consider the enactment of a County Ordinance. The meeting will commence at 9:00 A.M.
The title of the proposed Ordinance is as follows: AN ORDINANCE OF THE BOARD OF
COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, ESTABLISHING THE
COLLIER COUNTY HEALTH FREEDOM BILL OF RIGHTS; PROVIDING FOR CONFLICT
AND SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE OF LAWS AND
ORDINANCES; AND PROVIDING FOR AN EFFECTIVE DATE. A copy of the proposed
Ordinance is on file with the Clerk to the Board and is available for inspection. All

8 WHEREAS, numerous County residents have expressed their concerns to the Board of
9 County Commissioners ("Board") over the federal government's and the World Health
10 Organization's attempts to impose public health mandates and limit an individual's healthcare
11 freedoms and rights; and

13 WHEREAS,the State of Florida has recognized these concerns and in November of 2021,
14 Governor DeSantis signed into law Senate Bill (SB) 2-B and its companion House Bill (HB) 1-
15 B,1 as well as HB 3-B/SB 4-B, 2, now codified in Chapter 381, Florida Statutes, in large part
16 prohibiting the ability of private employers to impose a COVID-19 vaccination mandate amongst
17 other protections; and

19 WHEREAS, the State of Florida further protects its residents' health related rights and
20 freedoms through Section 381.026, Florida Statutes, the Florida Patient's Bill of Rights and
21 Responsibilities, which promotes the interests and wellbeing of patients of healthcare providers
22 and healthcare facilities; and

24 WHEREAS, the Board wishes to address the concerns of Collier County residents and
25 adopt the foregoing State Statutes into local law, as well as to expand upon them.
26 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
27 COMMISSIONERS OF COLLIER COUNTY, FLORIDA:

29 SECTION ONE: Title
30 This Ordinance shall be known and cited as the "Collier County Health Freedom Bill of
31 Rights" Ordinance.
32 SECTION TWO: Purpose and Intent
33 The purpose of this Ordinance is to safeguard the healthcare rights and freedoms of Collier
34 County residents.
35 SECTION THREE: Definitions
36 The terms used in this Ordinance shall be defined as outlined in Chapter 381, Florida
37 Statutes, as may be amended from time to time.

39 SECTION FOUR: Applicability.
40 This Ordinance is applicable and limited to unincorporated Collier County.
41 SECTION FIVE: COVID-19 vaccine documentation prohibited.
42 (A) A business entity within Collier County, as defined in Florida Statutes Sec. 768.38, may not
43 require patrons or customers to provide any documentation certifying COVID-19 vaccination or
44 postinfection recovery to gain access to, entry upon, or service from the business operations in
45 Collier County. This subsection does not otherwise restrict businesses from instituting screening
46 protocols consistent with authoritative or controlling government-issued guidance to protect public
47 health.
48 (B) Collier County will not require anyone to provide any documentation certifying COVID-19
49 vaccination or postinfection recovery to gain access to, entry upon, or service from Collier
50 County's operations.

52 SECTION SIX: Private employer COVID-19 vaccination mandates prohibited.

54 (A) A private employer within Collier County may not impose a COVID-19 vaccination
55 mandate for any full-time, part-time, or contract employee without providing individual
56 exemptions that allow an employee to opt out of such requirement on the basis of medical reasons,
57 including, but not limited to, pregnancy or anticipated pregnancy; religious reasons; COVID-19
58 immunity; periodic testing; and the use of employer-provided personal protective equipment. For
59 purposes of this section, the term "COVID-19" means the novel coronavirus identified as SARS-
60 CoV-2; any disease caused by SARS-CoV-2, its viral fragments, or a virus mutating therefrom;
61 and all conditions associated with the disease which are caused by SARS-CoV-2, its viral
62 fragments, or a virus mutating therefrom. Employers shall use forms adopted by the Department
63 of Health, or substantially similar forms, for employees to submit exemption statements.
64 (B) If an employer fails to comply with subsection(A)and terminates an employee based on the
65 employee's noncompliance with a COVID-19 vaccination mandate,the terminated employee may

Good morning, Commissioners.
My name is Scott Kiley, resident Marco Island and member of the CTTF.
Let's bring clarity to 3 questions.
1. Why do we need a resolution?
2. Why do we need an ordinance?
3. Why can't we merge the two together?
Starting with,Why do we need a resolution?
Let's walk through the NINE MAJOR POINTS OF the Resolution and as we go, I will justify the
need for every point.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY, FLORIDA, that:
1. Right to No Medical Mandates: This is justified because
• Informed consent was denied. Testing transparency does not exist. Any mandate under
these circumstances is giving blind trust to big pharma that has not earned our trust.
• Further, the Use of a biological agent on civilians without informed consent is considered
human criminal experimentation and in violation of international laws
that protect human rights, including the Nuremberg Code and Geneva
Convention.
• Last, Hospitals, doctors and pharma companies OFTEN have no liability and huge
financial incentives to push new medications.This is an unacceptable conflict with
mandating anything and in violation of our right to not be harmed,
injured or deprived of life without due process of law under THE 5th and 14th
amendments.
Commissioners, IT IS OUR resolve to never allow this again by working toward NO MEDICAL
MANDATES!
2. Right to no discrimination:
• If you did not get vaccinated, turns out you were smart in not putting yourself at
increased risk for heart complications, autoimmune diseases, and even sudden death.
But today, if you need a medical procedure, should you be denied that procedure
because you did not get injected? If we allow this to ever happen again, they can

mandate any treatment or procedure and humanity will be forced to comply.
Commissioners,we must resolve to preserve freedom of choice without discrimination!
Informed consent without interference:
• The Nuremberg code foundational element is informed consent.
• What do we demand for ourselves and our children? Of course, informed consent is a
must have under all circumstances. It is unconscionable that any doctor would ever deny
informed consent to their patient.
We resolve to assure our citizens will aways receive informed consent.
4. Right of personalized care:
• Doctors have a personal history with their patients. They can weigh out all
circumstances and make a personalized healthcare plan in the best interest of the
patient, not the hospital's bottom line.
We resolve to never be subjected to anything less than personalized care created between
the patient and the doctor.
5. Right to exclude third party interference from the WHO.
• We stand united against the WHO's attempt to subvert or supersede our Constitutional
Rights, including usurping our bodily sovereignty and Healthcare freedom.
6. Right to not be refused care based on vaccine or health history:
• The HIPAA Privacy Rule establishes national standards to protect individuals' medical
records and other individually identifiable health information.
Commissioners,we resolve to guard and protect medical privacy.
7. Right of free movement: Health/Vaccine Passports MUST BE prohibited in Collier County.
• Vaccine passports are unconstitutional and an invasion of privacy.
OF COURSE, We DO NOT want to live in a society where vaccine passports dictate our level of
personal freedom.
8. Right to medical advocate:
• Medical advocates allow a check and balance to hospital staff that may get it wrong.
• Medical advocates know your health circumstances that can impact treatment
decisions.
• Medical advocates know your end of life wishes.
It is our resolve to assure all CC citizens have the right to a medical advocate.

9. Right to forego unlawful quarantine:
• In 2020, for the first time in history, we improperly and unlawfully quarantined the
healthy, including children.This cost lives, prolonged the pandemic,crushed the
economy, served no purpose, caused irreparable social and developmental
harm to children, and WE must never allow this to happen again.
In closing on the question of why we need a resolution, So much of what was recommended
by our health officials over the past 3 years was incorrect.New pandemics will come
and we must do better. The resolution highlights areas of concern and areas needing
improvement. We will use the resolution to educate citizens, rally and unite support within our
county, teach our constitution and change state statutes that desperately need
improvement.
The second question Why do we need an ordinance?
Commissioners, we have Florida state statutes that provide some protection for the citizens of
Collier.
These cumbersome, hard to read,contradicting statutes get passed and our collier citizens are not
aware of the benefits.
By adopting our own Health Freedom Bill of Rights ordinance that reflects these state statutes,we
can better educate and create awareness of the benefits to our Collier citizens. Examples:
a. We will break out the most pertinent beneficial elements in long lengthy statutes and
make it easy for citizens to understand.
b. We will teach citizens their options to opt their children out of medical mandates
and how to complete this process.
c. We will inform citizens of their rights against discrimination in the workplace.
d. We will shine a light on areas of state statutes that POSE A THREAT TO OUR HEALTH
SAFETY and we will mobilize citizens to get active and create the change in Tallahassee.
g. We will use all of this to make sure we are educated and prepared to fight back
against future government overreach.
h. Our ordinance also rejects any authority of the WHO or other international bodies. It is
critical that we spread this word around the state and the country as globalists are coming
for our freedom.

***Collier County will be the beacon of Freedom in all of Florida!
Finally, the last question,why can't we combine the ordinance and the resolution?The resolution list
items that are preempted by state statutes.
In Collier County,we cannot preempt or supersede state statutes or state laws. Because of this,the two
documents cannot be merged.
• The ordinance IS legally binding and reflects state statutes.
• The resolution acknowledges areas needing improvement and our resolve to do
better.
Commissioners, thank you for your time. I hope this brings clarity for the need of both. Please PROTECT
OUR CITIZENS AND pass the HEALTH FREEDOM resolution and the HEALTH FREEDOM BILL OF RIGHTS
ordinance.
