FIRST AMENDMENT TO AGREEMENT No.22-7992R FOR "PALM RIVER PUBLIC UTILITIES RENEWAL PROJECT AREAS 1 AND 2" -Y4\ THIS FIRST AMENDMENT, made and entered into on this 1 ( day of L 2023, by and between Haskins, Inc. (the "Contractor") and Collier County, a political subdivision of the State of Florida, (the "County" or"Owner") (collectively,the"Parties"): WHEREAS, on January 10, 2023, Item 11.A., the County entered into Construction Agreement No. 22-7992R (the "Agreement") with the Contractor for the construction of the public utilities renewal project in Palm River; and WHEREAS, the Parties desire to amend the Agreement to revise the Technical Specifications, attached as Exhibit J to the Agreement, to modify the schedule and progression of the work so that Areas 1 and 2 can be constructed concurrently at the Contractor's request. NOW, THEREFORE, in consideration of the mutual promises and covenants herein contained, it is agreed by the Parties as follows: Words Struck-Through are deleted; Words Underlined are added: 1. The above recitals are hereby incorporated into this First Amendment as if fully set forth herein. 2. The following portion of commencing on Exhibit J, Section 11-1 of the Technical Specifications is amended as follows: As mentioned above,the project is phased to minimize impacts to residents within each Area per the description below. The Contractor will not be allowed to progress from one phase to another until the proposed improvements are Functionally Complete(installed,backfilled,tested,cleared for use,and placed into service)and rough grading is complete. The Contractor shall have 30 calendar days to complete the ROW to ROW restoration including landscape/sod,roadway base, limerock, and first lift of asphalt in each phase once the phase is deemed functionally complete. If not complete in 30 calendar days, the Contractor shall cease all work except for restoration work. If restoration is not complete within 30 calendar days from the Functional Completion date and the contractor does not cease work on all work less restoration, pay applications will not be approved. Notwithstanding the specified phasing of the project to promote the orderly progression of the work,at the request of the Contractor and with the consent of the Owner, construction can be conducted concurrently on Areas 1 and 2 if it will Page 1 of 3 promote the expeditious completion of the Project without negatively impacting the residents. * * * 3. Exhibit J, Section 11-5 of the Technical Specifications, is revised as follows: * * * All proposed sanitary sewer and stormwater systems within Phase 1D shall be functionally complete (installed, backfilled,tested, cleared for use, and placed into service) and restored as detailed above. When the Owner, CEI, and FOR have deemed Phase 1D to be functionally complete, a Phase 1D functionally complete notification letter shall be provided to the Contractor by the County and Contractor may begin o,, _n rea At the request of the Contractor and with the consent of the Owner,the construction can be conducted concurrently on Areas 1 and 2 if it will promote the expeditious completion of the Project without negatively impacting the residents. * * * 4. The revised Project Schedule is attached hereto as Exhibit"A,"and is incorporated herein as part of the Agreement by reference. 5. All other terms and conditions of the Agreement, as previously amended, shall remain the same.
