EXECUTIVE SUMMARY
Recommendation to 1) Accept the findings of the Board’s Emergency Medical Authority; 2) Accept the
findings of the Director of the Bureau of Emergency Services; 3) Grants the Certificate of Public
Convenience and Necessity to MedTrek Medical Transport, Inc.; 4) Authorizes the Chairman to execute
the Permit and Certificate; and 5) Approve a Budget Amendment to recognize and appropriate the $250
application fee.
OBJECTIVE: To proceed in the best interest of the public health, safety, and welfare by awarding a
Certificate of Public Convenience and Necessity (COPCN), Class 2 Advanced Life Support (ALS) for inter-
facility ambulance transport services in Collier County to MedTrek Medical Transport, Inc. These certificates
are subject to certain conditions noted below.
CONSIDERATIONS: Collier County's Bureau of Emergency Services received an application from MedTrek
Medical Transport, Inc. for a COPCN for Class 2 ALS for inter-facility ambulance transport services in Collier
County. A COPCN may be approved by the Board as provided by Section 50-57 of the Collier County Code of
Laws and Ordinances governing medical transportation services.
The Board’s Emergency Medical Authority has reviewed the application and recommends that the Certificate be
granted for a period of one (1) year following the approval of the Board. MedTrek Medical Transport, Inc. will
commission five (5) ambulances with three (3) ambulances authorized to operate twenty-four (24) hours a day and
two (2) ambulances available in reserve.
FISCAL IMPACT: There is no fiscal impact in granting the Certificate. The Board shall also recognize and
accept the $250 application fee as revenue in Fund (001).
GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact resulting from this
action.
LEGAL CONSIDERATIONS: This item is approved for form and legality and requires a majority vote for
Board action. - RTT
Additionally, Section 50-57 of the Collier County Code of Laws and Ordinances, governing medical transportation
services, outlines the requirements for Board approval in granting the Certificate as follows:
“The Board of County Commissioners shall not grant a certificate unless it shall find, after public hearing and
based on competent evidence that each of the following standards has been satisfied:
(1) That there is a public necessity for the service. In making such determination, the Board of County
Commissions shall consider, as a minimum, the following factors:
(a) The extent to which the proposed service is needed to improve the overall Emergency
Medical Services (EMS) capabilities of the County.
(b) The effect of the proposed service on existing services with respect to quality of
service and cost of service.
(c) The effect of the proposed service on the overall cost of EMS service in the
County.
(d) The effect of the proposed service on existing hospitals and other health care
facilities.
(e) The effect of the proposed service on personnel of existing services and the
availability of sufficient qualified personnel in the local area to adequately
staff all existing services.

(2) That the applicant has sufficient knowledge and experience to properly operate the proposed service.
(3) That, if applicable, there is an adequate revenue base for the proposed service.
(4) That the proposed service will have sufficient personnel and equipment to adequately cover the
proposed service area.”
Further, Section 50-58 of the Collier County Code of Laws and Ordinances provides:
“In making the determinations provided for in 50-57 above, the board may, in its sole discretion, appoint a
Hearing Officer to hold a public hearing and to make factual findings and conclusions as a result of the hearing.
Should a Hearing Officer be appointed, said Hearing Officer shall render a written report to the Board within 30
days of the hearing, which report shall contain the officer's findings and conclusions of fact, and a recommended
order. The findings and conclusions of fact shall be binding upon the Board, but the recommended order shall be
advisory only.”
RECOMMENDATION: To 1) Accept the findings of the Board’s Emergency Medical Authority; 2) Accept the
findings of the Director of the Bureau of Emergency Services; 3) Grants the Certificate of Public Convenience
and Necessity to MedTrek Medical Transport, Inc.; 4) Authorizes the Chairman to execute the Permit and
Certificate; and 5) Approve a Budget Amendment to recognize and appropriate the $250 application fee.
