Agenda 03/28/2023 Item #16D1 (State grant funds to complete the required sestoration of the historic cottages at Margood Harbor Park in Goodland)03/28/2023 EXECUTIVE SUMMARY Recommendation to accept an award from the Florida Department of State Division of Historical Resources in the amount of $256,436 for restoration of the historic cottages at Mar-Good Harbor Park in Goodland with a required one-to-one match and ten (10) year restrictive covenants, authorize the Chairman to sign the attached agreement and authorize the necessary Budget Amendments. (Public Service Grant Fund 709 and Public Service Match Fund 710) OBJECTIVE: To leverage state grant funds to complete the required restoration of the historic cottages at Mar- Good Harbor Park in Goodland. CONSIDERATIONS: Mar-Good Harbor Park was acquired in 2005 through a Florida Communities Trust (FCT) reimbursement grant. The park has been developed with a community building, playground, canoe/kayak launch, pathways and pavilions, and other recreational amenities and is operated by the Parks and Recreation Division. The park received a local historic designation in 2015 (Resolution #15-15). Restoration of the 1920s fishing cottages moved from Kelly Gantt’s Fish Camp on Caxambas to Mar-Good in the midcentury is a condition of the 2005 FCT grant. Failure to complete all commitments made in the grant application and land management plan invites the risk of the granting agency requesting reimbursement of all or part of the grant award. The award amount was $1,905,000.00. Furthermore, five other cottages on the Mar-Good site were demolished (with FCT permission) to allow for park development. Three of the four remaining cottages are the most historically significant of any structures that were extant when the land was acquired. FCT permission to demolish them is unlikely to be granted. Parks and Recreation has been steadily working toward fulfilling the commitment to restore the cottages. Architectural work toward this end was completed through a Division of Historic Resources Small Matching Grant in 2020. Florida Department of State Division of Historical Resources offers Special Category Grants for the purpose of providing funding to assist local, regional, and state-wide efforts to preserve significant historic structures and archaeological sites and promote knowledge and appreciation of the history of Florida. On April 1, 2021, the Department of State issued a funding notice with an application due date of June 1, 2021. Applications were evaluated on a competitive basis at a public meeting in the fall of 2021 by the Florida Historical Commission. Projects were ranked and then funded in rank order in the state budget in accordance with the legislative allocation beginning on July 1, 2022. Projects must be completed within two (2) years. The Museum Division prepared the application for the project to restore the cottages at Mar-Good Harbor Park in Goodland. Work will include: 1) demolition of the existing Cottage No. 4 to be replaced by a new outdoor pavilion/classroom; 2) repair to the existing cistern; 3) exterior restoration of Cottage Nos. 1, 2, and 3 to include repair and stabilization of foundations, repair and restoration of the existing deteriorated/missing siding, replacement of all the existing metal roofs, repair and restoration of all existing windows and doors, and repainting; 4) interior restoration of Cottage No. 1 and removal of its concrete porch/landing to be rebuilt with new ADA accessible ramp and handrails; and 5) installation of new concrete sidewalks and landscaping. On May 27, 2021, the County Manager approved the submittal of the application as authorized by CMA #5330. On June 22, 2021, Agenda Item #16D15, the Board of County Commissioners (Board) approved an “After-the- Fact” electronic submittal of the grant application to the Florida Department of State Division of Historical Resources (DHR) and authorized the Chairman to sign a resolution supporting the local cash match commitment. The resolution identifies a commitment of $261,476 in cash match which meet the 100% match requirement at the time of application (Resolution #2021-132). The local cash match commitment identified by the Board will be reduced by $5,040 to match the required match for the grant award. 16.D.1 Packet Pg. 1598 03/28/2023 Collier County was notified by DHR on June 6, 2022, that the Mar-Good Harbor Park project had been awarded the requested funding of $256,436 with a one-to-one match requirement, making the project total $512,872. Collier County received the agreement from DHR on November 2, 2022. A draft of the Deed of Restrictive Covenants is presented as an attachment and in accordance with DHR's instructions will be presented to the Board for ratification at a future date. The Museum Division will provide $100,000 toward the required grant match in recognition of the high demand on Parks ad valorem capital funding. Museums will also continue to provide technical assistance to Parks and Recreation for the restoration project and in development of interpretive signage and programming for the cottages. Moving forward, the Museum Division and Parks and Recreation will co-manage the location so that the strengths of each Division can be capitalized on. FISCAL IMPACT: The Florida Department of State will provide $256,436 in grant funding. The grant requires a hundred percent (100%) match requirement in the amount of $256,436. Budget Amendments are required to recognize the grant revenue and match within the Public Service Grant Fund (709), Project 80322, and Public Service Match Fund (710), Project 80322, Matching Funds are available in the forms of transfer from Museum Capital Fund (314) Master Plan Roberts Ranch Project 50519 in the amount of $100,000, Parks Ad Val CIP Fund (306), Artificial Turf Project 80385 in the amount of $153,445.69, and Mar-Good Cottage Project 80322 in the amount of $2,990.31 LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires a majority vote for Board approval. -DDP GROWTH MANAGEMENT IMPACT: Mar-Good Harbor Park is inventoried in the Parks and Recreation AUIR. WHEREAS, the Owner is the fee simple titleholder of the Property located at 321 Pear Tree Avenue, Goodland, Collier County, Florida, as described in Exhibit A, attached to and made a part hereof and WHEREAS, the Owner is a grant recipient and is to receive State Historic Preservation Grant assistance funds administered by the State of Florida, Department of State, Division of Historical Resources, R.A. Gray Building, 500 South Bronough Street, Tallahassee, Florida 32399-0250, hereinafter referred to as the Department, in the amount of $256,436, to be used for the preservation of the property of the Owner as described in Exhibit A, and WHEREAS, said State funds have been or will be expended for the purpose of preserving the historic qualities of the property or contributing to the historic character of the district in which the property is located, Now THEREFORE, as part of the consideration for the State grant, the Owner hereby make and declare the following restrictive covenants which shall run with the title to said Property and be binding on the Owner and its successors in interest, if any, for a period stated in the preamble above: 1. The Owner agree to maintain the property in accordance with good preservation practices and the Secretary of the Interior's Standards for Rehabilitation. 2. The Owner agree that no modifications will be made to the Property, other than routine repairs and maintenance, without advance review and approval of the plans and specifications by the Department's Bureau of Historic Preservation. 3. The Owner agree that every effort will be made to design any modifications to the Property in a manner consistent with the Secretary of the Interior's Standards for Rehabilitation. 4. The Owner agree that the Department, its agents and its designees shall have the right to inspect the Property at all reasonable times in order to ascertain whether the conditions of the Grant Award Agreement and these covenants are being observed. 5. The Owner agree that these restrictions shall encumber the property for a period of ten years from the date of recordation, and that if the restrictions are violated within the ten year period, the Department shall be entitled to liquidated damages pursuant to the following schedule: a. If the violation occurs within the first five years of the effective date of these covenants, the Department shall be entitled to return of the entire grant amount. b. If the violation occurs after the first five years, the Department shall be entitled to return of the entire grant amount, less 10% for each year past the first five. For instance, if the violation occurs after the sixth anniversary of the effective date of these covenants, but prior to the seventh anniversary, the Department shall be entitled to return of 80% of the original grant amount. 6. The Owner agrees to file these covenants with the Clerk of the Circuit Court of (Name of County) County, Florida, and shall pay any and all expenses associated with their filing and recording. 7.
