Respondent,Ernest J.Valdastri, is the owner of the subject property(the"Property"). 2. Respondent,having been notified of the date of hearing by certified mail and posting, did not appear at the public hearing to testify as to his efforts to abate the violations. 3. The Property located at 30 Creek Cir., Naples, FL 34114, Folio No. 49532360004 (Legal Description: HENDERSON CREEK PK BLK G LOT 5)is in violation of Collier County Code of Laws and Ordinances, Chapter 54, Article VI, Section 54-181 and Collier County Land Development Code Ord. No. 04-41, as amended, Section 2.02.03,in the following particulars: Overgrown weeds along the side and rear of the mobile home.Litter and outside storage consisting of but not limited to plastic jugs, pressure washer, propane tank, cooler, unknown item underneath a tarp in the driveway,tools,pile of tree branches,and other miscellaneous debris. 4. The violations have not been entirely abated as of the date of this hearing. 5. This is a repeat violation of those violations found in Case No. CENA20190004829, Order of the Board recorded at OR BK 5652,PG 846 et seq. CONCLUSIONS OF LAW Based upon the foregoing facts,the Board makes the following Conclusions of Law: 1. All notices were properly and timely issued,and the Board has jurisdiction pursuant to Chapter 162,Florida Statutes,and Chapter 2,Article IX,Code of Laws and Ordinances of Collier County,Florida. 2. The preponderance of the evidence shows that violations of Collier County Code of Laws and Ordinances, Chapter 54, Article VI, Section 54-181 and Collier County Land Development Code Ord. No. 04-41, as amended, Section 2.02.03,do exist,and that Respondent committed,and was responsible for maintaining or allowing the violations to continue as of the date of this hearing. 3. Pursuant to Secs. 162.06(3), 162.09(2)(a), and 162.21,F.S.,because this is a repeat violation of violations found in Case No. CENA20190004829, a civil penalty may be imposed along with a fine of up to$500.00 per day. Respondent is found guilty of violating Collier County Code of Laws and Ordinances, Chapter 54, Article VI, Section 54-181 and Collier County Land Development Code Ord. No. 04-41, as amended, Section 2.02.03. B. Respondent is ordered to pay a civil penalty in the amount of$250.00 for the repeat violation on or before November 26,2022. C. Respondent must abate all violations by removing all unauthorized accumulations of litter and all other items not permitted for outside storage to a site designated for such use, or store desired items in a completely enclosed structure,on or before November 26,2022,or a fine of$500.00 per day will be imposed for each day the violations remain thereafter. D. If Respondent fails to comply with this Order,Collier County may abate the violations using any method to bring the violations into compliance and may use the assistance of the Collier County Sheriff's Office to enforce the provisions of this Order and all costs of abatement shall be assessed to Respondent. E. Respondent is ordered to pay operational costs for the prosecution of this case in the amount of$59.28 on or before November 26,2022. F. Respondent shall notify Code Enforcement within 24 hours of abatement of the violations and request the investigator to perform a site inspection to confirm compliance.
