16.D.1 03/14/2023 EXECUTIVE SUMMARY Recommendation to approve "After -the -Fact" and authorize the Chairman to sign the Memorandum of Understandings with the Boys & Girls Club of Collier County, Florida, Inc. for the delivery of the 21s1 Century Learning Centers swimming skills and drowning prevention "Miracle 1 and Miracle 2" programs in Immokalee. OBJECTIVE: To provide swim lessons, drowning prevention, and recreation camps to elementary and middle school -aged children in Immokalee through funding provided by the United States Department of Education. CONSIDERATIONS: Boys & Girls Club of Collier County, Florida, Inc. (Boys & Girls Club) receives grant funds from the United States Department of Education to provide recreation opportunities for elementary -age children creating healthy lifestyles and lifelong skills for leisure and health. The Boys & Girls Club would like to partner with Parks and Recreation. The Miracle programs (1 & 2) will take place at the Immokalee Sports Complex and will provide round-trip transportation from school to park facilities for students. Students will learn basic swimming skills and drowning prevention. The program will provide for camps held from March - June 30, 2023, at Immokalee Sports Complex. Children will also participate in recreational and sports activities. Parks and Recreation will receive up to $31,500 for the Miracle programs (1 & 2). The Parks and Recreation Division has been a partner in the 21st Century Learning Centers Program for the past thirteen (13) years to offer the Miracle programs to the community. The 2023 Memorandums of Understanding (MOU) were received by County staff on March 1, 2023. The programs are to commence on March 13, 2023, and therefore require an "After -the -Fact" approval. FISCAL IMPACT: To provide the appropriate staffing for the Miracle programs, personal services, and operating costs will be impacted in the amount not to exceed $31,500. The Boys & Girls Club will provide up to $31,500 to fund the programs, depending on participation. It is estimated that the program will have one -hundred thirty (130) participants per day. The reimbursed amount will cover the personal service/operating cost as well as the cost of supplies/equipment necessary to run the program. Revenue is budgeted and will be processed through the appropriate cost centers within Collier County Parks and Recreation Unincorporated Area General Fund (111). GROWTH MANAGEMENT IMPACT: There is no Growth Management impact associated with this action. LEGAL CONSIDERATIONS: This item is approved for form and legality and requires a majority vote for Board action. - RECOMMENDATION: To approve "After -the -Fact" and authorize the Chairman to sign two (2) Memorandum of Understanding documents with the Boys & Girls Club of Collier County for the delivery of the 21 st Century Learning Centers swimming skills and drowning prevention "Miracle 1 and Miracle 2" programs in Immokalee. (hereinafter referred to as the `BGCCC") and Collier County, a political Subdivision of the State of Florida (hereinafter referred to as the "Parks and Recreation"). I. Purpose The purpose of this Memorandum of Understanding is to support the implementation of the 21 st Centur, Community Learning Centers grant program in Collier County, Florida, in a project known locally as Miracl sited in Eden Park, Highlands, Pinecrest, Lake Trafford, and Village Oaks Elementary and Immokalee Middl Schools. II. Services to be Provided by Parks and Recreation Division The Parks and Recreation Division agrees to: A. Parks and Recreation Division and the BGCCC agree that: 1. Each party is solely responsible for the negligent acts or willful omissions of its own designated agent and agrees to hold the other parties harmless against any claim or suit, including all costs and attorney' a, fees arising from the act, omission, or negligence of its own officers, agents, volunteers or employee., Y including, but not limited to, claims or suits based on allegations of discrimination on the basis of race creed, color, national origin, gender, age, sexual orientation, or disability; 2. The parties to this Memorandum of Understanding who are State agencies or subdivisions of Florid B agree to be responsible for the negligent acts or willful omissions of their own designated agents onl to the extent allowed by § 768.28, Florida Statutes; 3. Each party agrees to maintain the confidentiality of any shared student records as required by Florid L and Federal law, and that such Recreation records shall be used only for purposes allowed under r 1002.22, Florida Statutes, and shall be shared only with written parental permission; and 4. Any such revisions shall be in writing and agreed upon by both parties. VI. Termination Either party to this Memorandum of Understanding may terminate its responsibilities and agreements made herei upon no less than thirty (30) days advance notice to each of the other parties. In the event of termination by eithc party, payment will be made by the Boys & Girls Club of Collier County to Parks and Recreation Division fc services rendered through the effective date of termination.
